This paper describes practical solutions of the management functions for governmental intelligence authorities, including especially Polish the Foreign Intelligence Agency. International intelligence co-operation and the general rules of recruitment processes at secret services have been also presented. Others intelligence problems within area of risk management, external expert co-operations and an accessibility to human intelligence sources have been exposed. Author also introduces some similarities between governmental intelligence management and business intelligence in enterprises.

Artykuł przedstawia problemy dotyczące realizacji w praktyce funkcji zarządzania w wywiadzie cywilnym, w szczególności w polskiej Agencji Wywiadu. Ponadto dotyczy również zagadnień międzynarodowej współpracy wywiadowczej oraz zasad rekrutacji do pracy w służbach specjalnych. Autorzy podejmują wiele innych problemów wywiadu związanych z zarządzaniem ryzykiem, współpracą z ekspertami zewnętrznymi i pozyskiwaniem osobowych źródeł informacji. Podają także pewne podobieństwa między zarządzaniem wywiadem państwowym a funkcjonowaniem wywiadu gospodarczego.

The themes in the paper include different aspects of civil intelligence service activities in the context of its relations with the sphere of national security, international politics, business and science. The article refers to a number of moral problems, which are not alien to competition between intelligence agencies in the democratic countries, during processes of economics integration and political interactions in order to ensure common military and civil security. The paper shows a number of management processes and interactions among people working inside the structures of intelligence agencies. The discussion of the possible moral assessments of the intelligence has been provided, concerning point of social views and the special services provision in countries of democratic structure, this in particular, belonging to NATO and the European Union.

Tematyka opracowania obejmuje różne aspekty pracy wywiadu cywilnego w kontekście jego powiązań ze sferą bezpieczeństwa państwa, polityki międzynarodowej, biznesu i nauki. Artykuł odnosi do szeregu problemów moralnych, które nie są obce konkurencji pomiędzy służbami wywiadowczymi krajów demokratycznych, w tym integrujących się gospodarczo i współdziałających politycznie w celu zapewnienia wspólnego bezpieczeństwa militarnego i pozamilitarnego. Pokazano procesy zarządcze i oddziaływania międzyludzkie występujące w strukturach wywiadu cywilnego. Przeprowadzono dyskusję możliwych ocen moralnych działalności wywiadu w odniesieniu do wyobrażeń społecznych i umiejscowienia służb specjalnych w państwach o ustroju demokratycznym, w tym w szczególności przynależnych do NATO i Unii Europejskiej.

This paper is entirely devoted to the prerequisite of obligatory suspension of an officer of the Internal Security Agency or the Foreign Intelligence Agency. This regulation is included in the Article 58 sec. 1 of the Act on the Internal Security Agency and the Foreign Intelligence Agency. Suspension from official duties is obligatory in the event of an initiation of criminal proceedings in the case of an intent offence subjected to a public accusation. Therefore, attention was focused on the wording: “initiation of criminal proceedings in the case of intent offence prosecuted with public accusation against an officer of the International Security Agency and the Foreign Intelligence Agency” as a condition enabling the use of the legal construct included in Article 58 sec. 1 of the Act on the International Security Agency and the Foreign Intelligence Agency. This happens in a situation of changing the phase of preparatory proceedings in the criminal case prosecuted against an officer of the International Security Agency or the Foreign Intelligence Agency from in rem to ad personam, submitting subsidiary indictment to the court and reopening of the criminal proceedings.

Artykuł został poświęcony problematyce związanej z przesłanką obligatoryjnego zawieszenia funkcjonariusza ABW albo AW w czynnościach służbowych. Ta regulacja jest zawarta w art. 58 ust. 1 Ustawy z dnia 24 maja 2002 r. o Agencji Bezpieczeństwa Wewnętrznego oraz Agencji Wywiadu. Zawieszenie w czynnościach służbowych jest obowiązkowe w przypadku wszczęcia postępowania karnego w sprawie o przestępstwo umyślne ścigane z oskarżenia publicznego. Uwagę skoncentrowano na sformułowaniu „wszczęcie postępowania karnego o przestępstwo umyślne ścigane z oskarżenia publicznego przeciwko funkcjonariuszowi ABW albo AW” jako na przesłance warunkującej zastosowanie konstrukcji prawnej zawartej w art. 58 ust. 1 ustawy o ABW i AW. Następuje to w sytuacji zmiany stadium postępowania przygotowawczego prowadzonego wobec funkcjonariusza ABW albo AW z in rem w ad personam, wniesienia subsydiarnego aktu oskarżenia do sądu, a także wznowienia postępowania karnego.

Discipline at work is an aspect of proper functioning of intelligence agencies. The presented paper sheds some light on the issue by presenting, for example, certain types of disciplinary action regarding an officer of an intelligence agency (both civil and military) who is guilty of disciplinary misconduct while performing service. Although the application of disciplinary measures seems unquestionable, in practice there appear to be a number of doubts arising during various proceedings. As a result, the literature of the subject increasingly postulates that disciplinary liability of uniformed services (therefore not only intelligence agencies) be regulated by a common normative act.

Dyscyplina służbowa to jeden z warunków prawidłowego funkcjonowania służb specjalnych. W niniejszym artykule przybliżono tę problematykę wskazując m. in. sankcje, które zostaną nałożone na funkcjonariusza służb specjalnych (cywilnych i wojskowych) w sytuacji, gdy dopuści się przewinienia dyscyplinarnego, które musi mieć związek ze służbą i wykonywanymi czynnościami służbowymi. I chociaż wydaje się, że stosowanie procedur związanych z postępo-waniem dyscyplinarnym nie powinno budzić zastrzeżeń, to jednak w praktyce powstaje szereg wątpliwości w toku prowadzonych postępowań. Dlatego też coraz częściej w literaturze przedmiotu podnosi się, by kwestię odpowiedzialności dyscyplinarnej służb mundurowych (a więc nie tylko służb specjalnych) uregulować we wspólnym akcie normatywnym.
