Without the adequate areas LFA support may be to abandonment of agricultural use of agricultural and potentially threatening rural biodiversity. The subject of the research was a population of individual farms situated in LFA areas in Poland. The work uses the information on the number of applications submitted for LFA payment and SAPS in 2004-2010. Additionally, areas of agricultural use declared in SAPS (2004-2010) and LFA (2004-2006) were subject to analyses. The work aim was to estimate the LFA areas in various groups of farms and describe their spatial differentiation in Poland. Due to data availability the simplest statistical time series analysis, regression analysis and chart visu-alisation were performed.

W rezultacie negocjacji akcesyjnych polskich rolników objęto wszystkimi instrumentami Wspólnej Polityki Rolnej UE. Szczególnie ważne było przyznanie polskim rolnikom wsparcia bezpośredniego. Poprzedziła je pomoc przedakcesyjna oraz implementacja wspólnotowego dorobku prawnego oraz wynikających z niego praw i obowiązków w zakresie wspierania rozwoju rolnictwa. Ważną rolę w tym zakresie odegrała powołana w 1994 roku Agencja Restrukturyzacji i Modernizacji Rolnictwa i jej 15 oddziałów wojewódzkich. Agencja ta, obok Agencji Rynku Rolnego, zaczęła pełnić funkcję agencji płatniczej w zakresie płatności bezpośrednich i ze środków współfinansowania programów z funduszy strukturalnych UE skierowanych na rozwój rolnictwa i obszarów wiejskich.

In result of accession negotiations, Polish farmers are covered by all the instruments of the EU Common Agricultural Policy. Particularly important was awarding Polish farmers with direct support. It had been preceded by the pre-accession aid and implementation of the acquis communautaireas well as the rights and obligations stemming therefrom as regards supporting agricultural development. An important role in this respect was played by the Agency for Restructuring and Modernisation of Agriculture established in 1994 and its 15 provincial branches. The Agency, besides the Agricultural Market Agency, began to fulfil the function of paying agency as regards direct payments and those from the funds for co-financing the programmes of the EU structural funds aimed at development of agriculture and rural areas.

This paper deals with the important issue arising from questionable interpreting the provisions of the Public Finance Act by the Minister of Treasury and the President of the Agency for Restructuring and Modernisation of Agriculture, concerning the ownership of shares and stock of companies that are agricultural wholesale markets and commodity exchanges. Regarding this issue, both bodies of public authority were frequently embroiled in litigation, resulting in many cases in contradictory decisions. The High Court tends to grant significant rights to the State Treasury, which may threaten the interests of the shareholders who are agricultural producers, and may also lead to dissipating significant public expenditure on the organization of the current ownership structure of wholesale markets and commodity exchanges.
