The purpose of this article is to attempt to investigate the issue of product placement, to analyze and systematize this innovative legal subject, from the point of view of European law. The aim of this study is also to present the difference between product placement and advertising. The major objective of this research is the introduction to the European regulations, as well as an examination of their history, in terms of both advertising and product placement itself, likewise demonstration that all the amendments of existing directives, regarding advertising and product placement, were directly dictated by the continuous technological progress, causing changes in the audiovisual sector, thereupon existing regulations had to be adapted, to provide equal rights for all European Union Members.

W artykule dokonano przeglądu aktywności instytucji Unii Europejskiej w kluczowych kwestiach unijnej polityki medialnej, podejmowanych w cieniu walki z pandemią COVID-19, w tym zwłaszcza planów związanych z wejściem w nowy etap strategii cyfrowej. Skutki digitalizacji w sektorze komunikacji i mediów obnażyły luki w dotychczasowych działaniach, legislacji oraz w zakresie zwalczania głównych zagrożeń. Komisja Europejska dostrzega groźny wpływ „infodemii”, negatywne skutki słabej harmonizacji prawnej oraz szkodliwe dla wolności mediów praktyki niektórych państw członkowskich, które ocenia jako podmywanie aksjologicznych fundamentów wspólnoty. Plany nowej Europejskiej Agendy Cyfrowej, europejski plan działania na rzecz demokracji oraz modernizacja dyrektywy o audiowizualnych usługach medialnych są względem siebie komplementarne. Mają one służyć „wzmocnieniu odporności demokratycznej”, podkreślając wizerunek i rolę Unii jako referencyjnego gracza nie tylko w przestrzeni rynkowej, ale także na polu globalnej walki o reguły demokratyczne.

The article reviews activities of the European Union institutions in the key issues of EU media policy, undertaken in the shadow of the fight against the COVID-19 pandemic, in particular the plans to enter a new stage of digital strategy. The effects of digitization in communication and media sectors have exposed gaps in the activities, legislation and to counter major threats in these areas. The European Commission recognizes the dangerous impact of infodemic, the negative effects of poor legal harmonization and the practices of some Member States that are detrimental to media freedom, which it views as undermining the axiological foundations of the community. The plans for the new Digital Agenda for Europe, the European Democracy Action Plan and the modernization of the Audiovisual Media Services Directive are complementary to each other. They are to “strengthen democratic resilience,” emphasizing the image and role of the European Union as a key player not only in the common market, but also in the field of global struggle for democratic rules.

Art. 20b ust. 3 ustawy o radiofonii i telewizji daje możliwość KRRiT wydania rozporządzenia w spra-wie listy ważnych wydarzeń z uwzględnieniem stopnia społecznego zainteresowania określonym wydarzeniem i jego znaczenia dla życia społecznego, gospodarczego i politycznego. W artykule przedstawiono kontekst powstania polskiej listy ważnych wydarzeń oraz kryteria, jakie były brane pod uwagę przy przyjmowaniu rozporządzenia KRRiT w tej sprawie.

Article 20b(3) of the Polish Broadcasting Act gives the Polish National Broadcasting Council – KRRiT – the authority to issue a biding act (in Polish: Rozporządzenie, that is, a regulation) creating a list of major events, having regard to the degree of social interest in the given event and its significance to social, economic and political life. The article presents the context of creating the Polish list and the criteria which were taken into consideration while the KRRiT was adopting it.
