Uwagi o wolności podejmowania i wykonywania działalności gospodarczej w prawie Republiki Białorusi

Legislator białoruski dla realizowania wolności gospodarczej na terenie swojego kraju ustanowił szereg zasad. Reguły te nie odbiegają od standardów państw demokratycznych. Działalność gospodarczą podjąć mogą zarówno obywatele państwa, jak również podmioty zagraniczne. Przedsiębiorca (inwestor) ma możliwość wyboru formy prawnej, w której chciałby prowadzić działalność gospodarczą, natomiast suweren nie ma prawa bezgranicznej ingerencji w tę działalność. Deklarowane przez ustawodawcę zasady korzystania z pomocy publicznej, czy obowiązki związane z kontrolą i nadzorem w gospodarce są jasne i klarowne. Analiza ustawodawstwa gospodarczego pozwala na wyprowadzenie wniosku, że od strony legislacyjnej Republika Białorusi spełnia wymogi demokratyczne w dziedzinie tej konkretnej wolności (wolności podejmowania i wykonywania działalności gospodarczej). Niemniej, wydaje się, że białoruska gospodarka rynkowa nie jest faktycznie silna, gdyż – jak do tej pory – podmiotem dominującym w zarządzaniu gospodarką nadal pozostaje państwo.

In order to envisage economic freedom Belarusian legislator implemented several rules. These rules do not really vary from those known to the democratic standards. Economic activity can be run by both: citizens and foreign units. It is possible for an entrepreneur to choose legal form in which they would like to start business activity. The sovereign is not to interfere infinitely with this entrepreneurship. Lawgiver declares the rules connected to the state support as well as other duties related to the governmental control and supervision in a clearly manner. Analysis of the Belarusian economic legislative implies that from the legislative point of view the Republic of Belarus meets the criteria of democratic freedom to undertake and run economic activity. However, due to the fact that – for the time being – the dominant entrepreneurship manager remains the state, it may be indicated, that the Belarusian market economy is not really strong.
