Doradca restrukturyzacyjny pełni ważną rolę w postępowaniu prowadzonym wobec dłużnika niewypłacalnego lub zagrożonego niewypłacalnością. Istotność tej funkcji podkreśla fakt, że mogą ją pełnić osoby posiadające odpowiednie uprawnienia potwierdzone przez Ministra Sprawiedliwości. Poniższy artykuł ma na celu wskazanie, jakie funkcje pełnią doradcy w postępowaniach naprawczych. Pokazano w nim również, jakie wymogi muszą oni spełnić, aby móc wykonywać czynności wynikające z zapisów ustawy. Dodatkowo sam proces restrukturyzacji został scharakteryzowany wraz ze wskazaniem jego rodzajów funkcjonujących w obrocie prawnym.

The restructuring advisor plays an important role in the proceedings against the debtor who is insolvent or threatened with insolvency. The significance of this function is emphasized by the fact that it can be held only by persons having appropriate qualifications confirmed by the Minister of Justice. The following article is intended to show what functions advisers perform in restructuring process. It also shows what requirements they must meet in order to carry out activities resulting from the provisions of the Restructuring Act. In addition, the restructuring process itself has been characterized along with an indication of its types operating in Poland.
