This article attempts to identify the essence of international logistics as part of the modern world economy. In view of the international transactions also identifies entities in connection with the processes implemented in this area, and specific conditions for organizing processes created by contract as an international trade agreement between a seller-exporter and buyer-importer.

Autor artykułu podejmuje problem zróżnicowania warunków zatrudnienia w nowoczesnej gospodarce. Procesy globalizacyjne wpłynęły na funkcjonowanie europejskich przedsiębiorstw w wielu aspektach. Jednym z nich jest aktywność na rynku pracy i zatrudnienie. Zachodzące procesy wymuszają dostosowania przedsiębiorstw, zarówno w kwestii wielkości popytu na pracę jak i jego struktury. Zachowanie pozycji konkurencyjnej wymaga elastycznego dostępu do czynników produkcji. Przedsiębiorstwa poszukują zatem możliwości wykorzystania zasobów pracy w miarę potrzeb produkcyjnych, które dynamicznie zmieniają się w czasie. Tradycyjny model zatrudnienia (umowa na czas określony, stały i pełny wymiar czasu pracy itp.), nie odpowiadają wymogom nowoczesnego procesu organizacji produkcji. W artykule omówiono konsekwencje procesów związanych ze wzrostem otwartości i intensyfikacja powiązań między gospodarkami dla kontraktu zatrudnienia. Wynikające z procesów globalizacyjnych potrzeby pracodawców w zakresie większej elastyczności zasobów pracy, pociągnęły za sobą wzrost udziału pracy wykonywanej w niestandardowy sposób, a tym samym – wyraźny rozwój różnorodności form zatrudnienia. Różnorodność ta dotyczy w szczególności wymiaru czasu pracy, stabilności zatrudnienia, typów zawieranych umów oraz organizacji czasu pracy. W tekście posłużono się prezentacją danych statystycznych pochodzących głównie z Eurostat. Wyniki potwierdzają postęp procesu heterogenizacji warunków zatrudnienia jaki miał miejsce większości krajów UE.

This paper takes on the issue of diversity of employment conditions in modern labour market. Globalization processes have strong impact on companies in many aspects. One of them is labour market performance and employment policy. Competitiveness on globalized market requires flexible access to factors of production. Therefore, firms need to use labour resources as the production dynamically changes over time. The traditional model of employment (fixed term contract, full time employment, etc.), does not meet the requirements of market demands. The article discusses the consequences of the processes associated with increasing openness and competitiveness of economies. The results confirm heterogenization of employment contract.

In his Address to the Roman Rota of 2013, almost precisely on the 30th anniversary of the promulgation of the canon law of the Catholic Church, Pope Benedict XVI firmly presented a speech concerning “an irrevocable covenant between a man and a woman”, inspired by the celebration of the Year of Faith and a peculiar commentary to the De matrimonio chapter of Canon 1055. The author of the hereby article follows the track of Benedict XVI. Within the notion of “covenant” he not only identifies the key to the contemporary doctrine of marriage, but also points out the role of the keystone in the “program” consolidation of two aspects of matrimonium canonicum: natural and supernatural. On the one hand, the internal truth of the covenant act of marital love, thus the totality of the personal gift, as well as its immanently implied irrevocability, constitute the point of reference for the material frames of the consortium totius vitae. On the other hand, what seems most inspiring is the papal statement regarding the common linguistic roots the Latin terms fides and foedus have.

Celem pracy jest identyfikacja głównych kosztów transakcyjnych na rynku zamówień publicznych. Koszty transakcyjne dla zamawiającego wynikają głównie z: wszczęcia i przeprowadzenia postępowania o udzielenie zamówienia publicznego, określenia warunków i zawarcia umowy, monitorowania, mierzenia, zachowań oportunistycznych, egzekwowania zapisów umowy, renegocjacji umów i dochodzenia swoich praw oraz rozliczenia i pośrednictwa finansowego. Dla wykonawcy koszty transakcyjne wiążą się z: przygotowaniem i złożeniem oferty, zawarciem umowy, uwiarygodnieniem, informacją, mierzeniem, dostosowaniem systemu organizacyjnego, realizacją umów z pracownikami, stratą rezydualną, egzekwowaniem zapisów umowy oraz rozliczeniami i pośrednictwem finansowym. Ważną rolę w procesie zmniejszania kosztów transakcyjnych powinno odgrywać państwo, np. poprzez zwiększenie sprawności aparatu sądowniczego i rozwój arbitrażu.

The purpose of the work is to identify the main transaction costs on the public procurement market. Transaction costs for the ordering party result mainly from: initiation and conduct of public procurement proceedings, determination of conditions and conclusion of the contract, monitoring, measuring, opportunistic behavior, enforcement of contract provisions, renegotiation of contracts and enforcement of their rights, as well as settlement and financial intermediation. For the contractor, the transaction costs relate to: preparation and submission of the offer, conclusion of the contract, credibility, information, measurement, adjustment of the organizational system, performance of contracts with employees, residual loss, enforcement of the contract, billing and financial intermediation. An important role in the process of reducing transaction costs should be played by the public sector, for example by increasing the efficiency of the judicial apparatus and the development of arbitration.

W artykule dokonano identyfikacji i syntezy podejść badawczych, wykorzystujących, pojęcie kontraktu w teorii ekonomii, jako narzędzia wyjaśniania oraz rozumienia wyborów społeczno-ekonomicznych. W szczególności omówiono trzy zasadnicze podejścia badawcze wypracowane przez: nową ekonomię instytucjonalną, ekonomiczną analizę prawa i teorię gier. Przyjęto, że uznanie kontraktu za obiekt obserwacji naukowej w ekonomii jest heurystycznie płodne, zaś interpretacja kontraktu w kontekście analizy ponoszonych kosztów transakcyjnych może stanowić uniwersalną miarą oceny efektywności instytucji.

In the hereby article the identification and synthesis of research approaches that use the “contract” concept in the economic theory has been done. The contract concept has also been used as a tool for clarifying and understanding the socio-economic choices. The three essential research approaches have been discussed in particular: the neo-institutional, economic analysis of law and game theory one. It has been assumed that identifying the contract as a scientific observation object is heuristically fertile, and interpretation of the contract in the transaction cost analysis context can be a universal measure for institution effectiveness.
