The article presents the issue of the obligation to prevent the crime of genocide in reference o legal regulations and practice. The legal framework to analyse genocide is the Convention on the Prevention and Punishment of the Crime of Genocide. The document imposes very specific responsibilities on the contracting parties – to prevent and punish the crime of genocide. However, the regulations lack precision and clarity. For instance, it has not been clarified what “preventing genocide” entails. No measures, methods or actions have been enumerated that could serve as means to prevent genocide. The unclear and unprecise regulations leave the parties a lot of space for interpretation, in a way legitimizing “not taking action”. The signatories shy away from the obligation to prevent the crime or intervene only if their particular interest is at stake. The events in Rwanda, Bosnia or Darfur are the shameful exemplifications of this fact.

Научная цель статьи – ответить на следующий исследовательский вопрос: совершила ли Китайская Народная Республика геноцид уйгуров в свете Конвенции о предупреждении преступления геноцида и наказании за него от 9 декабря 1948 года? Авторы в своей работе: (1) характеризуют уйгурский народ, (2) описывают понятие геноцида и акт его совершения, (3) анализируют примеры, дающие право на признание действий Китая геноцидом, (4) пытаются показать реакцию основных международных акторов на ситуацию в Синьцзяне. Тезис статьи утверждает, что КНР совершила геноцид против уйгурского народа путем: (1) убийства членов этой группы; (2) причинения серьезного телесного и психологического вреда членам группы; (3) совершения преднамеренных действий, направленных на физическое уничтожение всей или части этой общины; (4) введения мер по предотвращению рождения в группе; (5) насильственного разлучения детей с родителями. В результате в статье представлены действия китайцев, которые отвечают признакам преступления геноцида, и дан глубокий правовой анализ Конвенции о геноциде. В статье проводится политико-правовой анализ, основанный на доступных источниках и правовых актах.

The scientific aim of the article is to answer the following research question: did the People’s Republic of China commit the genocide in the Uighurs in the light of the Convention on the Prevention and Punishment of the Crime of Genocide of December 9, 1948? The authors in their work: (1) characterize the Uyghur people, (2) describe the concept of genocide and the act of committing this act, (3) analyze examples qualifying for the recognition of Chinese actions as genocide (4) try to show the reaction of the main international actors to the situation in Xinjiang. The thesis of the article claims that the PRC committed genocide against the Uighur people by: (1) killing members of this group; (2) causing serious bodily and psychological harm to members of the group; (3) performing deliberate actions aimed at physical destruction of all or part of this community; (4) imposing measures to prevent birth in a group; (5) forcible separation of children from parents. The resulting article is a presentation of Chinese activities that fulfill the features of the crime of genocide and provide an in-depth legal analysis of the Genocide Convention. The article conducts a political analysis based on available source material.
