Celem niniejszej publikacji jest ukazanie wpływu technologii cyfrowej na regulacje prawne z zakresu prawa autorskiego oraz ocena cyfrowych pól eksploatacji pod kątem potencjalnych szans lub zagrożeń, jakie stwarzają dla twórców. Postępujący rozwój coraz to nowszych sposobów korzystania z utworów wymaga niewątpliwie analizy możliwości, jakie stwarzają one z punktu widzenia podmiotów autorsko uprawnionych, jak też samych użytkowników. Technologia tworząc niespotykane wcześniej warunki dla działalności twórczej, jest siłą sprawczą postępu. Z drugiej jednak strony ogromna dynamika zmian, które dokonują się w jej ramach, uniemożliwia zapewnienie stabilnej ochrony prawnej, sprowadzając liczne zjawiska do tzw. szarej strefy. Problemy te dały podstawę dla dokonania w niniejszej publikacji szczegółowej ich analizy w ramach procesu kształtowania się "cyfrowego" prawa autorskiego.

Revealing the influence of digital technology for legal regulations referring to copyright and evaluation of digital exploitation's fields in terms of potential opportunities and hazards that they created for the author is the aim of this publication. Progressive development of newer and newer ways of using works undoubtedly requires analysis of possibilities, that they generate from the perspective of authorized subjects as well as users themselves. Technology is a causative power of development, that makes unparalleled previously terms for creative activity. On the other hand enormous dynamics of changes, that arises within it, makes it impossible to constitute stable law protection, bringing numerous occurrences to the so called "grey zone". These problems laid the foundation to make in this publication a detailed analysis of them within the process of developing a "digital" copyright.
