Funkcjonowanie władzy publicznej w demokratycznym państwie prawa zostało ściśle powiązane z jej kontrolą i odpowiedzialnością. Kontrola i odpowiedzialność władzy publicznej stanowią zasadniczy element demokratycznej organizacji władzy w nowoczesnym demokratycznym państwie prawnym, a zarazem są fundamentem współczesnej demokracji. Nie ma bowiem wolności tam, gdzie władza została wyłączona spod kontroli oraz odpowiedzialności za swoją działalność. Kontrola i odpowiedzialność władzy publicznej bowiem są zasadniczymi instytucjami gwarancji suwerennej władzy Narodu. Sygnalizowane powyżej zagadnienie ma również ważne znaczenie, tak teoretyczne, jak i praktyczne dla konstrukcji ustrojowej państwa demokratycznego.

Functioning of the official authority in the democratic law-governed state closely was connected with her control and the responsibility. The control and the responsibility of the official authority constitute the fundamental element of the democratic organization of the power in the modern democratic legal state, and at the same time they are a basis of the contemporary democracy. There don't have the freedom where the authority was excluded from the control and the responsibility for its activity. Because the control and the responsibility of the official authority are fundamental institutions of the guarantee of the sovereign power of the Nation. The signaled above issue has also important meaning, so theoretical, as well as practical for the political structure of the democracy.
