Despite the fact that trusts are a product of common law, the existence of fiduciary institutions in several civil-law jurisdictions, the making of European trust law and the rules on trust funds in the Czech Draft Civil Code raise the question as to whether it is possible and suitable to introduce a similar fiduciary institution in Slovak law, as well. Having analyzed the rules on fiduciary institutions applicable in selected countries, the European academic projects in this field and the relevant provisions of the Czech Draft Civil Code, the author comes to the conclusion that it is possible, but not necessary to introduce a fiduciary institution in Slovak law and that it would be sufficient to adopt comprehensive rules on administration of property of another.
