Binding legal regulation in the subject of compensation for grounds plots separated out for public roads on the grounds of 98 sect. 1 of the Law on Land Management and Real Estate Expropriation (Dz. U. i.e. Dz. U. from 2010 No. 102, item 651 with later changes.) provokes many doubts in a process of applying law. Interpretation of legal acts, literature on the subject and first of all jurisdiction of administrative courts leads to a statement that in a current legal status, it is difficult to talk about pro-tection of interests of previous owners (perpetual usufructuaries).
