The purpose of the article is to analyze the role that — according to the jurisprudence of the Federal Constitutional Court — is played in the German legal system by the European Convention for the Protection of Human Rights and Fundamental Freedoms and the case law of the European Court of Human Rights under the Convention, relating particularly to the issue of rights competition between the Convention and national rights catalogues. First, the characteristics of the Convention are examined. Then, the author points to the basic elements of the constitutional law concerning the force of international law in the Federal Republic of Germany, and from this perspective he analyzes the role of the Convention within the meaning of the Strasbourg case-law, focused particularly on the judgments of the Federal Constitutional Court in the cases of Görgülü and Sicherungsverwahrung. Further analysis is carried out on the actual signifi cance of the Convention in the German legal system.

Niniejszy artykuł stanowi analizę ewolucji podejścia Unii Europejskiej do kwestii ochrony praw podstawowych. Opracowanie skupia się na aktach prawa pierwotnego stojących najwyżej w hierarchii unijnych źródeł prawa. W tym zakresie przeanalizowano pod tym kątem traktaty założycielskie jak i traktaty rewizyjne a także Kartę Praw Podstawowych. Z uwagi na złożoność zagadnienia i ograniczenia objętościowe niniejszej publikacji skonkretyzowano się na kwestiach dotyczących modyfikacji treści Traktatów. Na podstawie dokonanych rozważań zakreślono proces kształtowania się wielopoziomowego systemu ochrony praw człowieka w Unii Europejskiej a także aktualny stan prawny, który stanowi niewątpliwie istotny wkład w uregulowaniu tego aspektu.

This paper analyzes how the approach of the European Union to the protection of fundamental rights evolved. It focuses on primary legislation, which ranks highest in the hierarchy of EU sources of law. For this purpose, the author examines the Founding Treaties, the Reform Treaties, and the Charter of Fundamental Rights. The paper focuses on modifying the Treaties due to the complexity of the subject matter. The considerations discussed in this paper set the ground for the outline of the formation of a multi-level system of human rights protection in the European Union, as well as for the presentation of the current state of the law, which undoubtedly constitutes an important contribution to the regulation of the issue discussed.

Women’s rights, otherwise known as the human rights of women, are the rights and freedoms enjoyed by women and contained especially in international law systems , also in European law. The human rights of women are clearly defined, and international judicial authorities ensure their compliance. The European Court of Human Rights is the most important institution that protects women’s rights. This institution considers complaints made by citizens of the countries which are parties to the European Convention for the Protection of Human Rights and Fundamental Freedoms , thus creating a system of Strasbourg case-law. The human rights of women are interpreted and understood differently depending on different regions of Europe, the historical developments in the area and the traditions associated with the position of women in the wider society. The most frequently raised issues are the right to bodily integrity and autonomy, the right to respect for private and family life, prohibition of discrimination, and freedom of thought, conscience and religion.

Права женщин, иначе говоря, права человека-женщины, это права и свободы которыми пользуются женщины, в частности те, что предусмотрены в международных правовых системах, в том числе в системе европейского права. Права женщин четко сформулированы, а соответствующие международные судебные органы контролируют их соблюдение. Важнейшим институтом, функция которого проявляется в контроле над соблюдением этих прав, является Европейский Суд по правам человека. Именно он рассматривает жалобы, которые вносят граждане стран-сторон правового акта и выдает заключение на основе Европейской Конвенции о Защите Прав Человека и Основных Свобод, создавая тем самым систему прецедентного права в Страсбурге. Права женщин, учитывая защитную деятельность Трибунала, по-разному интерпретируются и понимаются в зависимости от региона Европы, исторических факторов на данной территории, а также традиций связанных с положением женщин в широко понимаемой общественной жизни. Наиболее часто встречающимися вопросами, которые связанны с правами женщин являются в частности право на личную неприкосновенность и самостоятельность, право на уважение частной и семейной жизни, запрет дискриминации, а также свобода мысли, совести и религии.

The offense against religious feelings expressed in the text of Art. 196 of PC is strongly embedded in the constitutional liberties and freedoms and human rights of both the Council of Europe and the European Union. Freedom of conscience and religion, which originated in the wording of Art. 196 of PC remains in antinomy to other constitutional values protected by both international acts such as freedom of expression, freedom of artistic expression, the freedom to teach and freedom to enjoy cultural heritage. This requires balancing the content of these freedoms. At present stage there is yet no way to resolve the alleged doctrine of countertype of art.
