W państwach demokratycznych świadomość potrzeby zagwarantowania przedstawicielom obu płci równych praw i obowiązków jest silnie zakorzeniona. Zasada ta – o ile nie jest wy- łącznie deklaracją – może mieć praktyczny wymiar: konkretnych przedsięwzięć na rzecz równości, przynoszących określone rezultaty. Skuteczna ochrona praw człowieka wymaga bowiem gwarancji i ochrony przed dyskryminacją. Równość kobiet i mężczyzn de jure i de facto stanowi jeden z priorytetów w działalności ONZ, RE oraz UE. Artykuł jest próbą scharakteryzowania wybranych regulacji prawnych zasady równości płci oraz niedyskryminacji. Autorka skupiła się na aktach prawa międzynarodowego oraz europejskiego, jako że to one stanowią fundament współczesnej polityki równości płci. Pokrótce opisano też strategię gender mainstereaming, która jako nowe podejście horyzontalne stała się bazą dla dalszych regulacji równościowych m.in. w krajach całej Unii Europejskiej.

In democratic countries the awareness of the need to guarantee equal rights and responsibilities for representatives of both sexes is deep-rooted. This principle - as long as it is not only an empty declaration - can have a practical dimension: real projects for the sake of equality achieving specific goals. Effective protection of human rights requires certain guarantees and protection from discrimination. Equality of women and men de jure and de facto is one of the priorities of the United Nations, Council of Europe and the European Union. The article attempts to characterise selected law regulations regarding gender equality and non-discrimination. The author focuses on international and European law legal acts, since they are the foundations of modern equality policies. The paper brie3y describes also the gender mainstereaming strategy, which as a novel approach became a basis for further equality regulations in, among others, the whole European Union.
