Copyright is a field of legal science which requires constant amendments to adjust it to the pace of development of modern technologies. One of the problems that has not been precisely regulated by the branch of intellectual property rights is the issue of legality of multimedia file downloading from the Internet. Across the world the position of legal professionals is divided on the issue of admissibility of both downloading and uploading. Free downloading of music or films has led to losses of millions and millions of dollars among the producers of these works on CD/DVD medi. Corporations decided to take care of their business by intensifying the fight against Internet piracy through a series of free educational programs to shame participants in this phenomenon as well as by lobbying for appropriate laws. As a result, within the last years this matter has been reviewed and developed in certain legislative acts (e.g., French law HADOPI, international agreement ACTA) dedicated to fighting Internet piracy. And they raise the questions which should be answered basing on the contemporary legal situation in our digitising world. What are the legal consequences for unauthorised placement of a copyright file on the Internet? Is file downloading always a case of Internet piracy? What features distinguish a crime having been committed? The author presents a full legal analysis of file distribution and downloading on the Internet basing on the Polish law and a comparison to legal regulations and judicature of the EU and other countries.

Zjawisko piractwa internetowego niesie oczywiste i negatywne skutki ekonomiczne. Jest przykładem stosowania wyrafinowanych sposobów naruszania prawa własności intelektualnej, a równocześnie pośrednim świadectwem jego nieskuteczności. Przynosi straty finansowe w branżach związanych z twórcami, w sektorach: muzycznym, wydawniczym, w branży tv i filmowej. Szacowanie owych strat (zwłaszcza detalicznych) budzi szereg wątpliwości, co autor wykazuje na wybranych przykładach. Wielu użytkowników sieci wspomaga piratów stając się częścią ich intratnego przemysłu. Ściganie podmiotów bezprawnie rozpowszechniających i przechowujących utwory bywa niezwykle skomplikowane ze względu na trudności w ich identyfikacji oraz związane z tym problemy jurysdykcyjne. Pojawiające się i przyswajane w internecie technologie cyfrowe, nie czekają na prawnicze skodyfikowanie ich efektów i objęcie władaniem trybunałów. Prawo autorskie wyrastające z doświadczeń epoki analogowej, pozostaje na przedpolach zakończonych już elektronicznych i cyfrowych batalii, próbując ułożyć normy i zasady przystawalne do tego, co wolno, ale głównie do tego, co już było.

Internet piracy undoubtedly has serious consequences for the economy. It is the example of sophisticated methods of violating intellectual property rights. It causes financial losses in music, publishing and media sectors and film industry. Accurate assessment of the losses is difficult. A lot of web users support pirates, thus becoming a part of their profitable business. Prosecution of the subjects illegally distributing and storing pieces is sometimes extremely complicated. It is so due to difficulties in identifying perpetrators and jurisdictional problems. Digital technologies which occur on the internet are easily adopted before any adequate laws are introduced, and the existing copyright laws stem from the experience of the era of analog technology. Current lawmakers try to create norms and rules which would befit the constantly changing digital reality and they are still one step behind.
