Podstawowym celem artykułu jest próba oceny roli klauzuli społecznej jako instrumentu rozwoju i wsparcia ekonomii społecznej. W artykule wykazano, że klauzule społeczne w zamówieniach publicznych mogą być ważnym i użytecznym narzędziem – odpowiednio wykorzystane stają się szansą dla wielu przedsiębiorstw społecznych. W celu dokonania oceny efektywności klauzul społecznych wykorzystano metodę analizy literatury przedmiotu oraz obowiązującego ustawodawstwa z zakresu zamówień publicznych – zwłaszcza istniejących rozwiązań prawnych dotyczących klauzul społecznych w obszarze ekonomii społecznej.

The primary objective of this paper is an attempt to evaluate the role of the social clause as a tool for development and support of social economy. The article shows that the social clauses can be extremely important and useful tool in public procurement – used appropriately they become an opportunity for many social enterprises. The method used in assessment of the effectiveness of the clauses is the analysis of literature and existing legislation in the field of public procurement – in particular the existing legal solutions regarding the use of social clauses in the area of social economy.
