Przepis art. 88 ust. 1 Konstytucji RP stanowi: „Warunkiem wejścia w życie ustaw, rozporzą-dzeń oraz aktów prawa miejscowego jest ich ogłoszenie”. Zasada ta ma istotne znaczenie dla ochrony praw obywateli i jest jedną z podstawowych idei demokratycznego państwa praw-nego. Ogłoszenie nie jest przy tym tylko technicznym obowiązkiem, ale także ważną prze-słanką obowiązywania prawa. Autor analizuje procedury związane z wejściem w życie ustaw, rozporządzeń oraz aktów prawa miejscowego. Szczególny nacisk został położny na wejście w życie umów międzynarodowych i aktów normatywnych Unii Europejskiej.

The art. 88.1 of the Constitution of the Republic of Poland states: “The condition prece-dent for the coming into force of statutes, regulations and enactments of local law shall be the promulgation thereof ”. This rule have an important meaning to protection of citi-zens’ rights and is one of the fundamental idea of a democratic state of law. Promulgation is not only a technical duty, but has important element of the binding of normative acts. The author analyses different procedures dealing with promulgation of statutes, regula-tions and enactments of local law. He especially concentrates on promulgations of rati-fied international agreements and promulgation of the European Union’s normative acts.
