The research sought to discover the broader social and state-administrative environment into which the present mechanisms of legal enforcement and state operation fit. The starting point was the 'disorderliness' of the state and society, in the sense that the organs of the state, the institutions of society and much of the public do not operate in accordance with the transparent, stable system of norms accepted by consensus and laid down in legislation, as they have no incentive in the short term in maintaining the predictability of everyday life, the public nature of decision-making processes, and the stability of institutions. This remains true even though the unpredictability is damaging for society as a whole.

Law and Economics is one of the fastest-growing areas of the applied economics. It employs the standard microeconomic tools and concepts to explain the legal and political rules, the social conventions and norms, the firms and contracts, the government organisations, and other institutions. Economists started to enrich the legal science and the lawmaking processes. The law shall be regarded as one of the factors that have a capacity to influence the output.

The author presents the history of the idea of consumer protection and its impact on the contemporary European law. The discussed proposals of consumer protection have been described with particular empha¬sis on the financial market, especially the insurance sector. The paper mentions the problem of the lack of a consistent definition of a consumer in a variety of acts. The concept of consumer is examined in both eco¬nomic and legal terms, presenting the to-date achievements of science in this field.
