The rise of the network society has substantially changed the structure of human experience in all important fields of life and culture. In his ground-breaking trilogy entitled The Rise of the Network Society, Manuel Castells has created a theoretical framework for understanding this new reality we live in. The article attempts to regard contemporary art as one of the global flows, which is a term coined by Castells to describe the network reality. As far as art is concerned, conclusions drawn from this analysis are unappealing.

Der Artikel befasst sich mit dem Problem des geistigen Eigentums und der Urheberrechte im Zeitalter der Entwicklung der digitalen Technologien und des Internets. Es werden die Unterschiede zwischen dem Besitz der materiellen Güter und dem intellektuellen Eigentum genannt. Es entsteht die Frage, ob man im letzten Fall überhaupt vom Eigentumsrecht sprechen kann. Es wird darauf hingewiesen, dass das Herunterladen und Kopieren aus dem Internet etwas anderes als Diebstahl ist. Es wird auch der überholte und übermäßig restriktive Charakter des heute geltenden Urheberrechtssystems betont. Es wird zum Schluss festgestellt, dass eine Diskussion über die grundsätzliche Frage, was „geistiges Eigentum“ bedeutet, unentbehrlich sei. Darüber hinaus sei auch eine tiefgründige Reform des bestehenden Urheberrechtssystems erforderlich, um sie an die sich rasch entwickelnden digitalen Technologien anzupassen.

This paper discusses the problem of intellectual property and copyright in the times of the development of digital-age technologies. The article points out the differences between possessing material goods and intellectual property. The question arises if the latter can be called “a property” at all. Subsequently, the author explains why copying and downloading content from the Internet cannot be simply defined as stealing. The author also points out that obtaining and holding copyright has recently become too restrictive and obsolete. As a conclusion, the need for thorough public debate concerning the very fundamental problem - the defintion of “intellectual property” is highlighted. Other long-term recommendations include in-depth reforms of the present copyright system so that it is more fine-tuned to the reality dominated by the rapidly developing digital technologies.

Artykuł podejmuje problem własności intelektualnej i praw autorskich w dobie rozwoju technologii cyfrowych i Internetu. Wskazane zostają różnice pomiędzy posiadaniem dóbr materialnych a własnością intelektualną. Powstaje pytanie, czy w tym ostatnim przypadku w ogóle można mówić o prawie własności. Wskazuje się również, że pobieranie treści z Internetu i kopiowanie jest czymś innym niż kradzież. Podkreślona zostaje również przestarzałość i nadmierna restrykcyjność panującego obecnie systemu praw autorskich. Ostatecznie należy stwierdzić, że potrzebna jest dyskusja nad fundamentalną kwestią – czym jest tzw. „własność intelektualna”. W dalszej kolejności niezbędna jest również głęboka reforma istniejącego systemu praw autorskich, zmierzająca do jego przystosowania do szybko rozwijających się technologii cyfrowych.
