It concerns an important issue in times of the Second Polish Republic, namely how the new Act on Copyright relates to copyrights that expired under previous regulations. Therefore, the author discusses the extension of the period of protection of those rights in relation to rights that did not have such protection.

Artykuł jest kolejnym przykładem zainteresowania prof. Maurycego Allerhanda zagadnieniami etnologicznymi, a w tym wypadku prawem zwyczajowym i zwyczajem u Żydów i wpływem tego na praktykę prawną, w tym na postępowania sądowe. Ten krótki a nieznany szerzej tekst oparty jest na praktyce Autora. Co ciekawe, powstał mniej więcej w tym okresie, kiedy uczonemu rodziła się córka Maria Anna (w 1896 r.), a nieco ponad rok później syn Joachim Herman (w 1897 r.).

The article is another presentation of the scholarly interests of Professor Maurycy Allerhand in the field of ethnology, and in this particular case of customary law and custom among the Jews, and its influence on legal practice, including court proceedings. This short and widely unknown text is based on Allerhand’s practice. Interestingly, it was created more or less at the time when the scientist’s daughter Maria Anna (1896), and a little over a year later, his son Joachim Herman (1897) were born.

This time Professor Maurycy Allerhand reflects on the relationship between the law of religious denominations and state law, pointing to essential elements of coexistence and the mutual impact of both legal orders, in particular in the area of civil law. He also notices that there are spheres of regulation which are left beyond the state legislator’s activity. Some of his reflections have a historical value, but many of them remain relevant also today. The article features only a slightly modernized spelling.

Maurycy Allerhand snuje refleksje na temat relacji między prawem poszczególnych religii i związków wyznaniowych a prawem państwowym, wskazując przy tym na istotne elementy współistnienia i wpływania na siebie dwóch porządków prawnych, szczególnie w obszarze prawa cywilnego. Zauważa też, że istnieją sfery regulacji, w które ustawodawca państwowy nie wkracza. Niektóre z refleksji mają walor historyczny, ale znaczna część pozostaje aktualna współcześnie. W artykule jedynie minimalnie uwspółcześniono ortografię.

Reprint of the lecture delivered by Professor Allerhand in the name of the Commission of Codification of the Republic of Poland, Faculty of Law of the Jan Kazimierz University in Lwów and the Bar association during the Congress of Legal Apprentices in 1929. In the article, he raised issues related to the path to the barrister’s profession, education of lawyers and professional ethics. The paper was previously published in 1929 in “Młoda Palestra”, a magazine of legal apprentices from the post-Austrian district.

In 1932, the Regulation of the President of Poland – the Criminal Code was issued. This led to numerous comments as well as voices of concern about the content of the uniform criminal law in Poland and its impact on the legal system. One of them was a short article by Prof. Maurycy Allerhand published in “The Voice of Law”. This paper deals with consequences of the decriminalization of adultery and other provisions of the Criminal Code on marriage and inheritance law. Moreover, it discusses an introduction of multiple types of offences instead of one (fraud – oszukańcza kryda) and reflects on an impact of this change on civil law and civil procedure. Only minimal spelling corrections are introduced.

W 1932 r. wydane zostało rozporządzenie Prezydenta RP Kodeks karny. Spowodowało to liczne komentarze, z obawami co do treści jednolitego prawa karnego, jak i wpływu jego na system prawny. Jednym z takich głosów był krótki artykuł prof. Maurycego Allerhanda opublikowany na łamach „Głosu Prawa”. Artykuł traktuje o skutkach dekryminalizacji cudzołóstwa ale też wpływ innych postanowień Kodeksu karnego na kwestię prawa małżeńskiego i spadkowego. Opisano też wprowadzenie wielu typów przestępstw w miejsce jednego (oszukańcza kryda) i wpływ tego na prawo i postępowanie cywilne.

In the 1920s, intensive works were conducted on subsequent draft codes unifying the court law in Poland. Professor Maurycy Allerhand played a particularly significant role in the work on the draft code of civil procedure. The reprinted article – originally published in ‘The Voice of Law’ from 1927 – is an example of reflections about significant problems of civil procedure that were confronted in the work of the Codification Commission of the Republic of Poland. The issue of resumption of proceedings is still an important issue in legal sciences. The study also proves an outstanding codification and legislative imagination of Maurycy Allerhand. Only a minimal interference with the spelling was made.

W latach dwudziestych XX w. trwały intensywne prace nad kolejnymi projektami kodeksów ujednolicających prawo sądowe w Polsce. Profesor Maurycy Allerhand szczególnie istotny udział miał w pracach nad projektem kodeksu postępowania cywilnego. Przedrukowany poniżej artykuł – zamieszczony pierwotnie w „Głosie Prawa” z 1927 r. – jest przykładem rozważań o istotnych problemach postępowania cywilnego, z jakimi mierzono się w pracach Komisji Kodyfikacyjnej RP. Zagadnienie wznowienia postępowania do dzisiaj stanowi istotny przedmiot rozważań w nauce prawa. Opracowanie dowodzi także, jak wybitnym zmysłem kodyfikacyjnym i legislacyjnym cechował się Maurycy Allerhand. Dokonano jedynie minimalnej ingerencji w ortografię.

This valuable study by Maurycy Allerhand was published in the Commemorative Volume to celebrate the 50th anniversary of judicial career of the President of the Court of Appeal in Lwów, Adolf Czerwiński. Also published as an offprint, the study is an important contribution of Allerhand’s on the issue of conflict of laws. Revisions of the original text are limited to changes of spelling.

Poniższe opracowanie pióra Maurycego Allerhanda zostało opublikowane w Księdze Pamiątkowej ku uczeniu 50-letniego jubileuszu pracy sędziowskiej Prezesa Lwowskiego Sądu Apelacyjnego Adolfa Czerwińskiego. Ukazało się też w osobnej nadbitce. Jest ważnym głosem uczonego w kwestii prawa kolizyjnego a ciągle mało dostępnym, chociaż w literaturze obecnym. Dokonano tylko minimalnych zmian w ortografii.
