The Apostolic Penitentiary constitutes a relatively little-known dicastery of the Roman Curia, however, with a very rich and long history. From the rich and very distant history of the institution, also in the context of the Year of the Faith (2012-2013) announced by the Pope Benedict XVI, we should quote the fact that with the development of the penitential practices in the Church the necessity of taking the relevant measures in order to help the pilgrims who – coming to the Eternal City – tried to receive absolution of their sins as well as they tried to obtain exemption from the sanctions reserved only to the Pope’s disposal as well was perceived. The subject of the works of the Apostolic Penitentiary is settling the special issues (sui generis) that concern the forum internum, that is the matter of conscience and moral problems of particular worshippers (both the clergy as well as the lay faithful) that are at the foundation of the specific and frequently hard-to-solve problems of the human nature directed to the Penitentiary. The Apostolic Penitentiary, in general, settles everything that affects the matter of conscience. Therefore, apart from granting grace, remission of sins, dispensing, exchanging and decreasing censures, canonical sanctions, it analyses and settles all the matters of conscience that have been presented to it; in this last example, first of all, by providing the answers for particular doubts of moral and legal nature that are depicted by confessors or interested people. In these very wide competences the Apostolic Penitentiary solves solely single and specific problems, whereas settlement of the issues of sub specie universalitatis falls within the competences of the Congregation for the Doctrine of the Faith. Additionally, the subject of works of the Apostolic Penitentiary is granting indulgences.

Since the Second Vatican Council, consecutive Bishops of Rome have been undertaking a reform of the Roman Curia. In 1967, Pope Paul VI carried out such a reform based on the Regimini Ecclesiae universae Apostolic Constitution. In 1983, a year after the post-council Canon Law was promulgated Pope John Paul II carried out a similar reform by announcing the Pastor bonus Apostolic Constitution in 1988. Also, Pope Francis followed his steps. He reformed the Holy See’s administrative apparatus by introducing the Praedicate Evangelium Apostolic Constitution on the Roman Curia and its service for the Church. The constitution has been in force since June 5, 2022. The pre amble of the latest Apostolic Constitution as well as the formulated rules and criteria of service in the Roman Curia show an evangelic spirit of the reform that all the Curia units, including the justice institutions, ought to be imbued. Independent from each other, the Apostolic Penitentiary, the Supreme Tribunal of the Apostolic Signature and the Tribunal of the Roman Rota have remained the Roman Curia’s ordinary justice institutions. The document includes clarifications of the theological, formal and legal nature that improve work of the institution of Curia and direct them towards  “providing assistance for the successor of St. Peter in holding his highest pastoral office for good and in service of the Universal Church and particular churches.”

Od zakończenia soboru watykańskiego II kolejni biskupi rzymscy podejmowali się reformyKurii Rzymskiej. W 1967 roku uczynił to Paweł VI na mocy konstytucji apostolskiej Regimini Ecclesiae universae. W 1983 roku po promulgowaniu posoborowego kodeksu  prawa kanonicznego podobnej reformy dokonał Jan Paweł II, ogłaszając w roku 1988 konstytucję apostolską Pastor bonus. W ślad za nimi poszedł również papież Franciszek, który zreformował aparat administracyjny Stolicy Apostolskiej na mocy konstytucji apostolskiej o Kurii Rzymskiej i jej służbie Kościołowi Praedicate Evangelium, która obowiązuje od 5 czerwca 2022 roku. Preambuła najnowszej konstytucji apostolskiej, jak i sformułowane zasady i kryteria służby w Kurii Rzymskiej ukazują ewangelicznego ducha reformy, którym winny być przepojone wszelkie jednostki kurialne, w tym instytucje sprawiedliwości. Zwyczajnymi instytucjami sprawiedliwości Kurii Rzymskiej są nadal: Penitencjaria Apostolska, Najwyższy Trybunał Sygnatury Apostolskiej i Trybunał Roty Rzymskiej, wzajemnie od siebie niezależne. Dokument zawiera doprecyzowania natury teologicznej i formalnoprawnej usprawniające prace kurialnych instytucji i ukierunkowujące je na „wspomaganie następcy Piotra w sprawowaniu jego najwyższego urzędu pasterskiego dla dobra i w służbie Kościoła powszechnego i Kościołów partykularnych”.

This contribution seeks to present the modus operandi of the Apostolic Penitentiary, the Tribunal of the Roman Curia that is responsible for everything relating to the internal forum and the granting of indulgences. To do this, reference is made first of all to the notion of the internal forum so as to then illustrate the responsibilities attributed to the Apostolic Penitentiary by the recent apostolic constitution Praedicate Evangelium of Pope Francis. Attention is then paid in particular to the delicts reserved to the Holy See and the way a confessor should behave towards a penitent who has incurred excommunication. Lastly, a reference is also made to the other responsibilities of the Apostolic Penitentiary relating to dispensation from irregularities and the granting of other graces, with references to the works indicated in the bibliography provided for further reading.

Il contributo intende presentare il modus operandi della Penitenzieria Apostolica, il Tribunale della Curia Romana competente su tutto quanto riguarda il foro interno e la concessione delle indulgenze. Per fare ciò, si richiamerà anzitutto la nozione di foro interno, per illustrare poi le competenze attribuite alla Penitenzieria dalla recente costituzione apostolica Praedicate Evangelium di Papa Francesco. Ci si soffermerà, in particolare, sui sei delitti riservati alla Santa Sede e sul modo di comportarsi del confessore di fronte a un penitente che è incorso nella scomunica. Infine, si farà un cenno anche alle altre competenze della Penitenzieria riguardo la dispensa dalle irregolarità e alla concessione di altre grazie, rimandando alle opere indicate nella bibliografia per ulteriori approfondimenti.

W niniejszym opracowaniu Autor przedstawia modus operandi Penitencjarii Apostolskiej, Trybunału Kurii Rzymskiej, mającego kompetencje we wszystkim tym, co dotyczy forum wewnętrznego i udzielania odpustów, jako wyrazu miłosierdzia Bożego. W tym celu, po krótkim scharakteryzowaniu pojęcia forum wewnętrznego, tzn. ukrytego obszaru osobistych, duchowych relacji między Miłosiernym Bogiem a wiernym, penitentem, przedstawione zostały kompetencje Penitencjarii Apostolskiej w świetle opublikowanej w ostatnim czasie konstytucji apostolskiej Praedicate Evangelium papieża Franciszka, i następnie koncentruje się szczególnie na sześciu przestępstwach zarezerwowanych Stolicy Apostolskiej oraz na tym, jak powinien się zachować spowiednik wobec penitenta, który zaciągnął karę ekskomuniki latae sententiae. Po omówieniu sposobu postępowania Penitencjarii Apostolskiej w zakresie zwalniania z kar kościelnych, stosowna uwaga została poświęcona udzielaniu dyspens od nieprawidłowości i innych łask, odsyłając, w razie potrzeby pogłębienia wiedzy na ten temat, do publikacji podanych w załączonej do tekstu bibliografii.
