Opracowanie przedstawia zagadnienia związane z ubezpieczeniem chorobowym w polskim systemie ubezpieczeń społecznych. Omawiane kwestie skupiają się na charakterystyce zasady solidarności oraz nadużyć w prawie do świadczeń z ubezpieczenia chorobowego. Na podstawie orzeczeń sądowych zostały przedstawione przykłady najczęściej występujących nieprawidłowości w prawie do świadczeń. Przedstawiono również możliwości, jakimi dysponuje Zakład Ubezpieczeń Społecznych, aby przeciwdziałać nadużyciom. Najważniejsze kwestie dotyczą próby określenia, czym jest nadużycie w kontekście nabywania prawa do świadczeń z ubezpieczenia chorobowego. Ponadto wskazuje się, że nieuczciwe działania części świadczeniobiorców i płatników składek stoją w sprzeczności z zasadą solidarności społecznej, która jest jedną z podstawowych wartości dla ubezpieczeń społecznych.

The study presents issues related to sickness insurance within the Polish social insurance system. The discussed issues focus on the characteristics of the principle of solidarity and abuse of the right to sickness benefits. Based on court decisions, examples of the most frequent irregularities in the right to benefits have been presented. It also presents the possibilities available to the Polish Social Insurance Institution (ZUS) in order to counteract abuses. The most important issues relate to attempts to determine what abuse is in the context of acquiring the right to sickness benefits. Moreover, it is pointed out that the unfair actions of some beneficiaries and contribution payers are in contradiction with the principle of social solidarity, which is one of the basic values for social insurance.
