This work is aimed at determining whether we can regard Francisco Suárez as representative of the social-contracting theories developing in the period from the 16th up until the 18th century. Suárez, who is in all probability better known for his metaphysical disputations, provides a truly sophisticated formulation concerning the origin of civil society and political power, where the concept of social consent holds a key role. Suarez’s concept of social consent is situated in the ontological framework and is closely associated with the term nature. Suárez consequently understands the state as a natural and moral organization.

The first half of the twentieth century brought the world two global conflicts and genocide on an unprecedented scale. It was a time in which both political reflection and political and legal practice was dominated by various forms of militarism, totalitarianism and authoritarianism, often tinged with nationalism and even racism. The appearance on the intellectual and political scene of such currents as bolshevism, fascism and Nazism left an ominous indelible mark on the chronicles of Europe and the rest of the world. To understand how state-perpetrated crimes could have been committed on such a scale at a time when the cognitive and social optimism characteristic of positivism was still thriving, it is necessary to look to the history of political ideas…

Joseph Vialatoux is the main figure in social Catholicism in France in the first half of the twentieth century. During the Nazi occupation he examined the nature of Pétain’s government in Vichy and the legitimacy of resistance of General de Gaulle. Apart from a detailed analysis of the Vichy’s power, which Vialatoux reveals as a totalitarian regime, he deals with general philosophical reflections on political power. It may be surprising for some that here the author uses the scholastic model, which can already be found in works more than three hundred years earlier in the political thinking of Francisco Suárez. This theoretical analysis then helps the author defend the ideas of the legitimacy of the resistance of General de Gaulle, in which Vialatoux sees a representative of the national consciousness and defending the general welfare of the French nation.
