Przygotowana likwidacja jest nowym mechanizmem prawnym wprowadzonym do postępowania upadłościowego, którego założeniem jest istotne przyśpieszenie likwidacji majątku dłużnika, który staje się masą upadłości. Ciężar poszukiwania nabywcy przesunięty jest na okres poprzedzający ogłoszenie upadłości i działania te podejmuje sam dłużnik. Rolą sądu jest weryfikacja rzetelności i opłacalności tego trybu w porównaniu z likwidacją przeprowadzaną na zasadach ogólnych. Autor podejmuje w tekście wybrane zagadnienia związane z wnioskiem dłużnika o zatwierdzenie warunków sprzedaży i stara się zidentyfikować potencjalne problemy w stosowaniu nowej regulacji w praktyce.

Pre-packaged administration is a newly introduced legal mechanism in insolvency proceedings, the aim of which is to substantially accelerate the liquidation of the debtor’s assets, which becomes a bankruptcy estate. It is the debtor himself who is seeking a buyer before commencement of insolvency proceedings. The role of the court is to verify the reliability and cost-effectiveness of this mode in comparison with the liquidation carried out on a general basis. The author takes the text selected issues related to the application of the debtor for the approval of the terms of sale and seeks to identify potential problems in the application of the new regulations in practice.
