Opracowanie podejmuje ocenę polityki prawa wobec zjawisk bezrobocia w Polsce. Zwraca uwagę na główne zagrożenia pracobiorców wynikające z dominującej pozycji pracodawców, którzy dążą do utrzymywania wynagrodzeń na możliwie niskim poziomie. Dotyczy to angażowania pracy w formach zatrudnienia niepracowniczego na podstawie umów cywilnoprawnych pozwalających na wyzysk (umowy wyzysku). Zdaniem autora polityka prawa powinna obejmować wszelką pracę, a nie tylko tę, która jest świadczona w ramach stosunku pracy. W krytycznej analizie dotychczasowych regulacji prawnych w tej dziedzinie autor zwraca uwagę na rozbieżności praktyki z konstytucyjnymi zasadami społecznej gospodarki rynkowej i wymogiem urzeczywistniania zasad sprawiedliwości społecznej. Artykuł sygnalizuje zagrożenia gospodarcze i społeczne wynikające z ułomności polityki prawa zatrudnienia i wskazuje na konieczne zmiany legislacyjne.

The study undertakes the opinion of the politics of the law in the face of the phenomena of unemployment in Poland. Pays the attention to workers the main threats results from predominant employers position which they aim to providing for rewards on the possibly low level. This concerns engagement of the work in the forms of the other type of employment on the basis of civil law contract allowing to exploitation ( the contract of exploitation). Sentence of Author, the politician of the law should include every work and not only this which he is testified within the relation of the employment. In the critical analysis of hitherto existing legal regulations in this field, the Author pays the attention to the divergence of the practice with the constitutional principles of the social market economy and the requirement of realizing the principles of the social justice. The article signals economic and social threats resulting from the infirmity of the politics the right employment and shows on necessary legislative changes.
