Austro-Węgry wobec utworzenia Tymczasowej Rady Stanu w listopadzie 1916 roku

After the Act of 5th November 1916, the fi rst attempt at building the Polish state before the end of World War I and decisions of the peace congress was creation of the Provisional Council of State. However, what led to creation of this institution? A query conducted in Austrian State Archive in Vienna has led to discovery of new materials, documenting the position of Austrian authorities with respect to these issues, and certain controversies in relation with the German ally. Before the fi nal version of the decree on establishment of Provisional Council of State, announced on 6th December 1916, there was a number of preparatory stages, namely a decree by the Governor of Warsaw gen. Hans Beseler of 12th December 1916 on establishment of Council of State and Sejm in the Kingdom of Poland, Austro-Hungarian draft decree on the Council of State in the Kingdom of Poland, adopted in Lublin on 23rd November after deliberations chaired by Governor General Karl Kuk, and fi nally, joint Austro-Hungaro-German decree on establishment of the Provisional Council of State, approved by both governors on 26th November 1916 in Warsaw.

Po wydaniu aktu 5 listopada 1916 r. pierwszą próbą budowy państwa polskiego przed zakończeniem I wojny światowej i przed decyzjami kongresu pokojowego było powołanie Tymczasowej Rady Stanu. Jak jednak doszło do utworzenia tej instytucji? Kwerenda przeprowadzona w Austriackim Archiwum Państwowym w Wiedniu ujawniła nowe materiały dokumentujące stosunek władz austriackich do omawianej problematyki i kontrowersje zachodzące z niemieckim sojusznikiem. Do przyjęcia ostatecznej wersji rozporządzenia o powołaniu Rady Stanu z 6 XII 1916 r. prowadziły kolejne etapy przygotowań w postaci rozporządzenia gubernatora warszawskiego gen. Hansa Beselera z 12 XI 1916 r. o utworzeniu Rady Stanu i Sejmu w Królestwie Polskim, austro-węgierskiego projektu rozporządzenia o Radzie Stanu w Królestwie Polskim przyjętego w Lublinie 23 listopada po obradach pod przewodnictwem gubernatora generalnego Karla Kuka, i wreszcie wspólnego austro-węgiersko–niemieckiego rozporządzenia o powołaniu Tymczasowej Rady Stanu, zaaprobowanego przez obu gubernatorów 26 listopada 1916 r. w Warszawie.
