Celem opracowania jest identyfikacja zasadniczych problemów związanych ze stosowaniem przepisów prawa podatkowego w zakresie podatku VAT w związku z prowadzeniem przez uczelnie publiczne nieodpłatnej ustawowej działalności edukacyjnej oraz pozostałej działalności o charakterze gospodarczym, ze szczególnym uwzględnieniem kwestii odliczania podatku naliczonego. W artykule zastosowano metodę studiów literaturowych oraz analizę regulacji prawnych i orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej.

The purpose of the study is to identify the essential problems connected with the interpretation and applying of the VAT law in connection with of statutory educational activity by universities and other economic activities, with particular emphasis on the issue of deduction of input tax. The method used consists in literature studies and an analysis of legal provisions and case law by the Court of Justice of the European Union.
