A game, just like social interaction, implies a specific set of rules that all participants must obey. However, the setting of strict rules and their implementation can destroy the fun of playing, because a game is also frivolous and relaxed fun. Similarly, when it comes to social interaction. It also needs a particular space where every move is not predetermined. I want to argue that the contemporary crisis of social interaction comes among other things from the fact that as 'postmodern machines' we have lost in our everyday social communication what characterizes a 'good game' - frivolity and freedom.

The subject-matter of the paper is particular set of questions, linked to the concept of social aiming of private law, and also the following question, which is the capacity of the private law to absorb legal regulation of the social model. The paper is focused mainly on the development and actual situation of the social models of the member countries of European Union and on the development, actual situation and future tendencies of European social model as regulatory system. Last but not least, the contribution is aimed also at the characterization of the principles and regulatory rules, used by the private law concept, esp. at their ability to support the implementation of the social model(s) into the legal regulation.

Paper argues the need to define the state as a dynamic historically conditioned phenomenon and identifies the key milestones of its qualitative changes. In the light of its inconsistent development paper justifies long-term trend of modernization as an adaptation which responds to historical changes, so that there is a positive shift of civilization. Essential feature of the state modernization is its increasing and innovating commitment in the economy and society.
