Artykuł dotyczy zasady bezpośredniości i jej funkcjonowania w polskim postepowaniu karnym. Pomimo faktu, że przedmiotowa zasada nie została zdefiniowana w aktualnie obowiązującym kodeksie postepowania karnego z 1997 r., jej obowiązywanie w obecnym stanie prawnym jest bezdyskusyjne. Zasada bezpośredniości obejmuje trzy węższe dyrektywy, które pozostają ze sobą w ścisłej korelacji. Celem niniejszego artykułu jest ukazanie jej złożonego charakteru oraz prześledzenie ograniczeń, jakim ona podlega.

The article discusses the principle of immediacy and its function in the Polish criminal procedure. In spite of the fact that the principle in question was not defined in the Code of Criminal Procedure of 1997 that is currently in force, its validity in the current legal status is unquestionable. The principle of immediacy includes three narrower directives which are strictly correlated. The objective of the following article was to present the complex nature of this principle and conduct the analysis of limitations that the principle is subject to.

Der Artikel betrifft den Grundsatz der Unmittelbarkeit und dessen Funktion im polnischen Strafverfahren. Trotz des Umstandes, dass der gegenständliche Grundsatz der Unmittelbarkeit in der aktuell geltenden Strafprozessordnung von 1997 nicht definiert wurde, ist seine Geltung in der aktuellen Rechtslage unbestritten. Der Grundsatz der Unmittelbarkeit umfasst drei engere Richtlinien, die sich eng aneinander anlehnen. Dieser Artikel hat zum Ziel, seinen zusammengesetzten Charakter zu veranschaulichen, und die Einschränkungen, deren er unterliegt, zu verfolgen.
