From the viewpoint of equity gap, occurring in relation to small and medium-sized enterprises, the possibility of applying the de minimis rule gains more in importance. It allows the EU Member States for fast provision of grants to enterprises, especially to small and medium-sized enterprises, in a limited amount without notifying such aid to the European Commission and following the administrative procedures. The principle is based on the assumption that in the vast majority of cases a small amount of subsidies have no effect on trade and competition between the Member States and consequently does not form state aid within the meaning of art.107 par.1 TFEU. The subject of the article is an analysis of the rules of state aid admissibility on the basis of the implementing regulations, adopted by the European Commission in 2006 and 2013 on state aid provided under the de minimis rule. The thesis taken in the article is based on the statement that in Poland during the financial and economic crisis de minimis aid showed a growing tendency, thereby forming, in addition to provisional measures addressed to enterprises in difficulty, one of the most important factors ensuring financing from the perspective of equity gap occurring in relation to small and medium-sized enterprises.

Wyjaśniono pojęcie pomocy publicznej oraz przedstawiono typologię i przeznaczenie tej formy pomocy udzielonej przedsiębiorcom w 2006 r. Scharakteryzowano wartość pomocy publicznej udzielonej w Polsce w latach 2002-2006. Autorka zauważa wzrostową tendencję udziału pomocy publicznej udzielanej przedsiębiorstwo prywatnym w ogólnej wartości udzielanej pomocy.

Article presents both principles of granting public help as well as particular categories of regional subsidies in years 2004-2006. Presents rules that must be obeyed when granting public aid in year 2006. It presents obstacles of grants (the maximum intensity of help) for big companies, bonuses for small and medium enterprises and the principles of monitoring big investment projects. Show the conditions of granting aid are presented for both newly established small enterprises and the principles of reducing intensity of help for regions under rule 87, par.3 lit. a. Polityka gospodarcza wykorzystuje różne sposoby do realizacji swoich celów. Jednym z nich, choć kontrowersyjnym, jest pomoc publiczna. Kontrowersyjnym, ponieważ z jednej strony wykorzystuje środki budżetowe, z drugiej ma ujemny wpływ na konkurencję i w zasadzie w Unii Europejskiej (UE) jest zabroniona. Szczególnego znaczenia nabrała pomoc publiczna w okresie transformacji, ze względu na specyfikę dokonujących się przemian. Wejście Polski do UE wymusiło dostosowanie zasad jej udzielania do prawa wspólnotowego, gdzie preferuje się pomoc wspierającą działania, zgodnie z zasadami wolnej konkurencji, promującą aktywną politykę innowacyjną. Celem artykułu jest analiza przemian w strukturze pomocy publicznej w Polsce w latach 1998-2008. Podzielono je na dwa okresy: 1998-2003 oraz 2004-2008, ze względu na inne regulacje prawne obowiązujące w Polsce od maja 2004 r. na skutek akcesji do UE. (fragment tekstu)

State economic politicy uses different methods to realize specified purposes. A public aid is one of them, which, on the one hand, uses budget funds, on the other hand, negatively affects competition and is prohibited in European Union. The European Law imposes common aid purposes, so that they are transparent and do not violate competition principles. To the preferred purposes belong such purposes as Research & Development, environmental protection or trainings using active forms of assistance. (original abstract)

Relief granted to commercial interests by taxing authorities frequently, but not always, takes the form of state aid. The financial crisis has caused companies to count on support from local authorities in the form of, among others, preferential policies in granting credits in the area of tax law. The objective of the study is an analysis of permissible conditions under which local taxing authorities may grant tax credits.
