The article summarises the activities undertaken by the Working Group on Fraud (WGoF) established in 2012 within the Council of Bureaux (CoB). The WGoF’s scope of interests include issues regarding the fight against Motor Third Party Liability (MTPL) fraud on cross-border level, on behalf of CoB members. The approach adopted by the WGoF is the response to the constantly increasing volume of this phenomenon. The initiated actions can be considered in the light of determinants needed to combat insurance fraud effectively. It should be also noted that applied approach has to be regularly revised due to the changing nature of fraud. Moreover, the article highlights the Polish insurance sector systemic initiatives especially the engagement of the Polish Insurance Guarantee Fund toward fraud fighting. Certain future challenges concerning the WGoF activities are also mentioned.

Autor artykułu podsumowuje działalność Grupy Roboczej do spraw Przestępczości, utworzonej w 2012 roku przy Radzie Biur. Zakres działalności Grupy Roboczej obejmuje zagadnienia związane z przeciwdziałaniem zjawisku przestępczości trangranicznej w odniesieniu do ubezpieczenia odpowiedzialności cywilnej posiadaczy pojazdów mechanicznych i w imieniu członków Rady Biur. Zastosowane przez Grupę Roboczą podejście jest odpowiedzią na rosnącą liczbę przestępstw ubezpieczeniowych w tym zakresie. Zainicjowane działania mogą być rozpatrywane w świetle determinantów skutecznej walki z przestępstwami ubezpieczeniowymi, tym niemniej należy zauważyć, że zastosowane podejście wymaga ciągłej weryfikacji ze względu zmienną naturę przestępczości. Autor podkreśla również rolę i systemowe zaangażowanie polskiego rynku ubezpieczeniowego, w tym w szczególności Ubezpieczeniowego Funduszu Gwarancyjnego w działania związane z przeciwdziałaniem zjawisku przestępczości. Ponadto opisuje wyzwania w zakresie dalszych działań Grupy Roboczej.
Celem opracowania jest analiza problemu nieubezpieczonych pojazdów/kierowców/posiadaczy w kontekście społecznym, jak również finansowym ze wskazaniem praktycznych skutków dla wszystkich uczestników zaangażowanych w funkcjonowanie rynku, zaś w szczególności poszkodowanych w takich wypadkach. Przedstawiono również możliwości przeciwdziałania zjawisku nieubezpieczonych pojazdów. Artykuł omawia praktykę ubezpieczeniową w tym zakresie realizowaną zarówno na płaszczyźnie narodowej, jak i międzynarodowej. Jedynym koordynatorem tych działań – na podstawie Rekomendacji nr 5 ONZ z 1949 r. oraz dyrektyw komunikacyjnych – jest Rada Biur Systemu Zielonej Karty zrzeszająca biura narodowe reprezentujące poszczególne rynki ubezpieczeniowe w Systemie Zielonej Karty, jak i poszczególne fundusze gwarancyjne, organy odszkodowawcze i ośrodki informacji ze wszystkich państw członkowskich. Jednym z istotnych zadań Rady Biur jest koordynowanie walki ze zjawiskiem pojazdów nieubezpieczonych, a co za tym idzie – ochrona interesów konsumentów, którzy są zazwyczaj ostatecznym płatnikiem.

The aim of this article is to investigate the problem of uninsured vehicles/drivers/owners in a social as well as financial context, and indicate its practical effects on all the market participants, especially on the victims of such accidents. All presented considerations reflect the insurance measures implemented at both national and international levels. The only coordinator of these activities, according to the UN Recommendation No. 5 adopted in 1949 and motor directives is the Council of Bureaux of the Green Card System associating both national bureaux representing the individual insurance markets in the Green Card System and particular guarantee funds, compensation bodies and information centres in all Member States. One of the essential tasks of the Council of Bureaux is the coordination of the fight against a phenomenon of uninsured vehicles, and consequently the protection of the interests of consumers, who are usually the ultimate payers.
