Korzyści płynące z systemu własności prywatnej są zwykle oparte na argumentach o jego efektywności ekonomicznej oraz ze względu na właściwą alokację zasobów w gospodarce. James Buchanan argumentuje jednak, że własność prywatna przyczynia się przede wszystkim do ochrony wolności jednostek. Korzyści z sytemu własności prywatnej będą możliwe do osiągnięcia tylko wtedy, kiedy państwo zapewni stabilną strukturę prawa i odpowiedni stopień ochrony własności jednostek. Według Jamesa Buchanana powinno to nastąpić w umowie przedkonstytucyjnej znacznie ograniczającej zakres władzy państwowej. Głównym celem artykułu jest ukazanie poglądów Jamesa M. Buchanana na system własności prywatnej i jego znaczenia dla wolności jednostki, a także prezentacja jego postulatów natury normatywnej, dotyczących zaprojektowania ram konstytucyjnych wzmacniających system własności prywatnej jednostek

The benefits of the system of private property are usually based on arguments about its economic efficiency and due to proper allocation of resources in the economy. James Buchanan argues, however, that private property is the primary contributor to protect freedom of individuals. These benefits will be achievable only if the state is to provide a stable structure of law and an adequate level of protection of individuals’ private property. According to James Buchanan, this should be done in the “prior to-constitutional contract” significantly restricting the scope of state power. The main objective of the paper is to present the views of James M. Buchanan on the system of private property and its importance for liberty of an individual, as well as the presentation of his normative nature recommendations concerning the design of constitutional framework strengthening the system of private property of individuals.
