Konstytucja Rzeczypospolitej Polskiej z dnia 2 kwietnia 1997 r. stanowi wyznacznik wolności prasy i wypowiedzi, które są zagwarantowane przede wszystkim przez art. 14 i 54 Konstytucji. Wolność prasy jest gwarantem realizacji wolności wypowiedzi, czyli wyrażania swoich poglądów, a także pozyskiwania i rozpowszechniania informacji. Ponadto dodatkową gwarancję wskazanych wartości zapewnia treść art. 8 Konstytucji RP, który stanowi, iż przepisy ustawy zasadniczej są stosowane bezpośrednio, co daje możliwość zainteresowanym poszukiwania ewentualnej ochrony bez pośrednictwa norm ustawowych. Ochronie prawnej zgodnie z przepisami Konstytucji RP podlegają tylko te zachowania jednostki, które nie naruszają wolności i praw innych osób. Oczywiście regulacja ta nie ma charakteru bezwzględnego, ponieważ prawodawca dopuszcza możliwość wprowadzenia ograniczeń praw i wolności gwarantowanych konstytucyjnie, jednak nie mogą one naruszać ich istoty (art. 31 ust. 3 Konstytucji RP). Podstawy uzasadniające wprowadzenie ograniczeń we wskazanym zakresie wyznaczone są również regulacjami prawa międzynarodowego, które zostały ratyfikowane przez RP.

Freedom of the press is the guarantor of the implementation of freedom of speech, or of expressing their views, as well as the acquisition and dissemination of information. Furthermore, an additional guarantee of the indicated value provides the text of Article 8 of the Constitution, which states that the provisions of the Constitution are directly applicable, which gives you interested, the search for possible protection without the mediation of statutory norms. Legal protection under the provisions of the Constitution applies only to individual behavior that does not violate the rights and freedoms of others. Of course, this regulation is not absolute, because the legislature allows the possibility of introducing restrictions on the rights and freedoms guaranteed by the Constitution, but they can not violate their nature (Article 31. 3 of the Constitution). Grounds justifying restrictions in the indicated range are also designated regulations of international law that have been ratified by the RP.

The social market economy principle is a new principle in Polish constitutionalism, determining the economic system of the Republic of Poland. Its role is primarily to point out a set of values defining a limit for the legislature regarding its undoubtedly broad autonomy in the selection of detailed solutions to construct the economic state order. As a rule of constitutional interpretation, it also provides guidelines for the interpretation of further, specific provisions of the Basic Law. The specificity of the discussed principle lies in its multi-stage construction, consisting in establishing a general social market economy principle, then filling it out with the detailed contents by further constitutional principles, especially the principle of freedom of economic activities and the protection of property.

Zasada społecznej gospodarki rynkowej jest nową w polskim konstytucjonalizmie zasadą, determinującą ustrój gospodarczy RP. Jej rola polega przede wszystkim na wskazaniu zespołu wartości określających granicę dla niewątpliwie szerokiej swobody ustawodawcy zwykłego w zakresie wyboru szczegółowych rozwiązań konstruujących porządek gospodarczy państwa. Jako zasada konstytucyjna stanowi także wytyczną interpretacyjną do wykładni dalszych, szczegółowych przepisów ustawy zasadniczej. Specyfika omawianej zasady opiera się natomiast na jej wielostopniowej konstrukcji, polegającej na ustanowieniu ogólnej zasady społecznej gospodarki rynkowej, a następnie wypełnieniu jej treścią przez kolejne szczegółowe zasady konstytucyjne, a zwłaszcza zasadę wolności działalności gospodarczej oraz zasadę ochrony własności.
