Celem artykułu jest przedstawienie problematyki związanej z wywozem za granicę zabytków i muzealiów niestanowiących zabytków w kontekście ochrony zbiorów muzealnych oraz realizacji ustawowych zadań muzeów. Analizie poddano przepisy ustawy o ochronie zabytków i opiece nad zabytkami oraz ustawy o muzeach, a także aktów wykonawczych do wskazanych ustaw. Ponadto uwzględniono poglądy przedstawicieli nauki prawa ochrony dziedzictwa kultury i wybrane orzecznictwo sądowe. Omówienia obowiązujących przepisów prawnych dokonano z jednoczesnym odwołaniem się do misji muzealnej realizowanej przez muzea. W szczególności wskazano na znaczenie pozwoleń na czasowy wywóz zabytków i muzealiów dla ochrony zbiorów muzealnych.

The purpose of the article is to present the problems associated with the transfer of artefacts and musealia abroad which do not constitute artefacts in the context of the protection of museum collections, and the realisation of statutory tasks of museums. An analysis was conducted upon the regulations of the law on the protection of artefacts and the caring for artefacts and the law on museums, as well as implementing acts to the acts of law which are indicated. Moreover, one took into consideration the opinions of the representatives of the science of the law of the protection of cultural heritage and selected judicial decisions. The presentation of the binding legal regulations was conducted with the simultaneous reference to the museum mission realised by the museums. In particular, one indicated the significance of the permissions for the temporary transfer of artefacts and musealia for the protection of museum collections.
