Der Artikel befasst sich mit dem Problem des geistigen Eigentums und der Urheberrechte im Zeitalter der Entwicklung der digitalen Technologien und des Internets. Es werden die Unterschiede zwischen dem Besitz der materiellen Güter und dem intellektuellen Eigentum genannt. Es entsteht die Frage, ob man im letzten Fall überhaupt vom Eigentumsrecht sprechen kann. Es wird darauf hingewiesen, dass das Herunterladen und Kopieren aus dem Internet etwas anderes als Diebstahl ist. Es wird auch der überholte und übermäßig restriktive Charakter des heute geltenden Urheberrechtssystems betont. Es wird zum Schluss festgestellt, dass eine Diskussion über die grundsätzliche Frage, was „geistiges Eigentum“ bedeutet, unentbehrlich sei. Darüber hinaus sei auch eine tiefgründige Reform des bestehenden Urheberrechtssystems erforderlich, um sie an die sich rasch entwickelnden digitalen Technologien anzupassen.

This paper discusses the problem of intellectual property and copyright in the times of the development of digital-age technologies. The article points out the differences between possessing material goods and intellectual property. The question arises if the latter can be called “a property” at all. Subsequently, the author explains why copying and downloading content from the Internet cannot be simply defined as stealing. The author also points out that obtaining and holding copyright has recently become too restrictive and obsolete. As a conclusion, the need for thorough public debate concerning the very fundamental problem - the defintion of “intellectual property” is highlighted. Other long-term recommendations include in-depth reforms of the present copyright system so that it is more fine-tuned to the reality dominated by the rapidly developing digital technologies.

Artykuł podejmuje problem własności intelektualnej i praw autorskich w dobie rozwoju technologii cyfrowych i Internetu. Wskazane zostają różnice pomiędzy posiadaniem dóbr materialnych a własnością intelektualną. Powstaje pytanie, czy w tym ostatnim przypadku w ogóle można mówić o prawie własności. Wskazuje się również, że pobieranie treści z Internetu i kopiowanie jest czymś innym niż kradzież. Podkreślona zostaje również przestarzałość i nadmierna restrykcyjność panującego obecnie systemu praw autorskich. Ostatecznie należy stwierdzić, że potrzebna jest dyskusja nad fundamentalną kwestią – czym jest tzw. „własność intelektualna”. W dalszej kolejności niezbędna jest również głęboka reforma istniejącego systemu praw autorskich, zmierzająca do jego przystosowania do szybko rozwijających się technologii cyfrowych.
Artykuł składa się z siedmiu części. W pierwszej są zarysowane spory nad prawem autorskim, jakie wywołała wprowadzona na przełomie 2011 i 2012 r. umowa ACTA. W drugiej części jest przedstawiony rozwój ochrony prawa autorskiego. W następnych dwóch fragmentach jest kolejno omówiona podstawowa argumentacja na rzecz prawa autorskiego oraz zarzuty, jakie wobec niego są podnoszone. Dalej, ukazana jest koncepcja prawa autorskiego w ujęciu Immanuela Kanta. W części przedostatniej przemyślenia Kanta zostają odniesione do argumentacji zarówno zwolenników, jak i przeciwników prawa autorskiego. I wreszcie przedstawione są wnioski, do jakich można dojść na podstawie prowadzonej analizy. Okazuje się – co najważniejsze w tym dociekaniu – że Kantowska wizja prawa autorskiego jest wciąż aktualna. Oznacza to, że w obliczu współczesnych sporów wokół prawa autorskiego warto powrócić do myśli Kanta, ponieważ to właśnie on wskazał podstawowe uprawnienia twórców, a także odróżnił dzieła, które są i nie są chronione przez prawo autorskie. Zdaniem Kanta tylko te dzieła, które stanowią przedłużenie osobowości autora, zasługują na ochronę przez prawo autorskie.

This article consists of seven parts. The first part describes the quarrel over copyright, which was introduced in 2011 and 2012 year by the agreement ACTA. The second part presents the development of copyright protection. The next two parts are in sequence and refer to the main arguments in favor of copyright and against copyright. Then the concept of copyright of Immanuel Kant is shown. The penultimate part of the rethinking of Kant based on the arguments of the supporters and the opponents of copyright. And finally, the conclusions are shown, which can be achieved on the basis of the analysis. The most important observation is that Kant’s vision of copyright is still timely. It means that in the face of today’s conflicts, we should return to the idea of Kant because he described the fundamental rights of authors. Kant also presented the works that are and are not protected by copyright. Only those works are protected by copyright according to Kant, which are the extension of the personality of the author.

Der Artikel besteht aus sieben Teilen. Der erste Teil beschreibt den Streit und das Urheberrecht, das im Jahr 2011 und 2012 in der Vereinbarung ACTA eingeführt wurde. Der zweite Teil stellt die Entwicklung des Urheberrechtsschutzes vor. In den nächsten zwei Teilen wurden anschließend die Hauptargumente zugunsten des Urheberrechts und die Behauptungen gegen das Urheberrecht charakterisiert. Dann wird das Konzept des Urheberrechts von Immanuel Kant gezeigt. In dem vorletzten Teil wurden die Gedanken der Anhänger und der Gegner des Urheberrechts bezüglich der Argumente von Kant vorgestellt. Die wichtigste Beobachtung ist, dass die Vision des Urheberrechts von Kant noch aktuell ist. Das bedeutet, dass wir angesichts der heutigen Konflikte um das Urheberrechtsgesetz zu den Ideen von Kant zurückkehren sollten. Kant unterscheidet auch die Arbeiten, die urheberrechtlich sind. Nur diese Werke durch das Urheberrecht geschützt werden sollen, die die Persönlichkeit des Autors entwickeln.
