Artykuł dotyczy problematyki określania, które z ruchomości będących w posiadaniu dłużnika i stanowiących jego własność, wchodzą w skład masy upadłości, w przypadku upadłości konsumenckiej. Ponadto podjęto w nim próbę wskazania jak daleko powinny sięgać czynności syndyka zmierzające do ustalenia, czy istnieją ruchomości, które nie pozostają w posiadaniu takiego dłużnika, a powinny znaleźć się w spisie inwentarza. Analiza powyższych zagadnień została przeprowadzona przy uwzględnieniu dyrektywy sprawnego, szybkiego i efektywnego prowadzenia postępowania oraz celu upadłości konsumenckiej, którym jest umożliwienie umorzenia zobowiązań upadłego niewykonanych w postępowaniu upadłościowym, a dopiero jeśli jest to możliwe – zaspokojenie roszczeń wierzycieli w jak najwyższym stopniu.

The article deals with the problems of determining which movables, possessed by the debtor and being his property, are included into his bankruptcy estate in case of a consumer’s bankruptcy. Moreover, the paper attempts to point out how far the actions of an accountant in bankruptcy should reach, intending to establish if there are any movables which he does not possess and which should be included in the inventory. The analysis of the above issues has been made taking into account the directives of skillful, quick and effective conducting of the proceedings and reaching the consumer’s bankruptcy objective which is enabling to remit the bankrupt’s commitments unperformed in the bankruptcy proceedings and then, if possible, to satisfy creditors’ claims at the highest degree.
