Niniejsze opracowanie podejmuje w pierwszej kolejności próbę odpowiedzi na pytanie, na ile założenia i cele wprowadzonej w 2017 roku reformy funkcjonowania i finansowania lecznictwa szpitalnego w Polsce sprzyjają realizacji konstytucyjnego prawa dostępu do świadczeń opieki zdrowotnej finansowanej ze środków publicznych. Ponaddwuletnie działanie tak zwanej sieci szpitali skłania do oceny, na ile adekwatne okazały się instrumenty zastosowane przez ustawodawcę w kontekście zdiagnozowanych problemów w ochronie zdrowia i założonych celów ustawodawcy z punktu widzenia jego racjonalności. Dotychczasowe doświadczenia podmiotów leczniczych, a także ogłoszony w połowie 2019 roku raport Najwyższej Izby Kontroli o funkcjonowaniu nowego systemu zabezpieczenia świadczeń opieki zdrowotnej uzasadniają negatywne oceny jego efektów i postulaty dokonania koniecznych zmian.

This study attempts to answer the question to what extent the assumptions and objectives of the reform of functioning and financing of hospital treatment, introduced in 2017, support the constitutional right to access publicly-funded healthcare services. Over two years of operation, hospital networks induced to assess to what extent the instruments used by the legislator in the context of diagnosed problems in health care and the assumed goals of the legislator from the point of view of its rationality proved to be adequate. The experience of medical entities to date, as well as the report of the Supreme Audit Office announced in mid-2019 the functioning of the new healthcare services security system justify negative assessments of its effects and demands for necessary changes.
