The principles of availability of information about the state and environmental protection were regulated in the Convention in Aarhus and the Directive no. 2003/4/WE of the European Parliament and of the Council on public access to environmental information and repealing Council Directive 90/313/EEC and in the Polish legislation in the Law of 2008 on environmental information, public participation in environment protection and on environmental impact assessments. The authors of the paper showed the legal status in the range of the availability principles of information about the environmental state and protection aspect in related to the public participation in the protection of environment.
This article is a voice of approval of the decision of the Supreme Administrative Court of 3 January 2012, Ref. Act: I OSK 2157/11. The ruling refers to the scope of public information that is available to the interested party. The court pointed out that public information could be invoices for services performed by private entities on behalf of public administrations. This ruling is part of anti-corruption strategies, based on transparency of the public life, and also supports the well-established case law, which treats public information very broadly. This results in an increase in the potential of the proactive investigation focused on cooperation with the community in the fight against corruption.
The paper refers to providing information about the dangers connected with crisis management. Crisis management is the activity of public administration authorities, which constitutes an element of managing the national security management system and essentially consists of: preventing crisis situations, preparing to take control over them by way of planned activities, responding in case of emergencies, removing their effects and reconstructing resources and critical infrastructure. In the first part, the stages of public administration authorities’ proceedings in crisis management are presented. This part also discusses the regulations incorporating the ways to devolve information in emergencies contained in crisis management plans. The second part of the work applies to the evolution of factual activities as legal forms of public administration activities with reference to operations consisting in informing society in case of emergencies occurring.
The Ombudsman’s Office of public bodies constitutes a strategic and democratic space for communication between the citizen and this Government Institution, aiming at strengthening the mechanisms of social participation. It is essential for its consolidation that the citizen has a space to request information, register suggestions, praise, complaints and denunciations, obtaining an agile and resolute response to his manifestation. For that, it is necessary to improve an Ombudsman with the concept of participative management and democratization of information, which provides an effective service, capable of seeking the solution of the manifestations. In addition, these manifestations must be organized in management reports aimed at informing and subsidizing the managers of public agencies, serving as an instrument for positive changes in the course of the Audits. This article aims to implement proactive actions in order to foster Social Control, through the participation of society and encouraging the exercise of citizenship. In order to carry out this investigation, it was necessary to apply the dogmatic method, as the hermeneutics of the normative texts recommends, but also the need for doctrine and transversality was necessary, since it is an interdisciplinary theme with a high political and sociological content, everything basked by a tradition of egalitarian rationalist thinking and based on international human rights hermeneutics. In conclusion, we identified that the Ombudsman’s Office aims to improve the exercise of Social Control and be another effective tool for institutional management and transformation. Its main task is to promote a dialogue between the public institution and society. For this to happen, citizen participation is essential, representing a strong allied body for the realization of significant changes in Public Administration, which fundamentally cares for the public interest.
An IT project consisting in implementing a management support information system is characterised by information asymmetry between the supplier and the client. The presented research results are part of the author’s broader research pointing to imperfections in the access to information amongst the providers and buyers of IT projects. The scope of this article is to present the methods of avoiding information asymmetry as part of an IT project implementation. The research results may be interesting for researchers specialising in the subject matter of IT project implementation and for practitioners completing IT projects.
W swoich rozważaniach autor podkreślił, jak duże znaczenie w zarządzaniu współczesną organizacją ma rzadka informacja i dostęp do niej, a także umiejętność dzielenia się nią z poszczególnymi grupami interesu. O ile posiadanie aktualnych informacji jest coraz łatwiejsze, o tyle coraz trudniej o informacje rzadkie, dające przewagę nad konkurencją. Wynika to z masowego charakteru mediów i coraz większego dostępu do tanich źródeł danych (np. Internet). Dla organizacji oznacza to trudności w budowaniu trwałej przewagi nad konkurentami, natomiast dla konsumenta jest to sytuacja korzystna, jako że pozwala na udział w grze rynkowej na równych zasadach. Większość autorów pochyla się nad kwestią dostępu do informacji ze strony klientów, a pomija się pracowników, którzy stanowią równie istotną grupę interesariuszy organizacji. Oczywiście są oni cennym źródłem danych o przedsiębiorstwie, jednak, powszechnie funkcjonujący w zarządzaniu paradygmat prowadzenia dialogu z personelem jako warunku sprawnego funkcjo-nowania, oznacza konieczność utrzymania relacji na zasadach partnerskich. Zawiera się w tym także umiejętność dzielenia się informacją. Przydatnym narzędziem prowadzenia takiego dialogu są badania opinii pracowników. Z jed-nej strony pozwalają na uzyskanie interesujących organizację danych. Z drugiej strony naturalne powinno być dzielenie się przez organizację uzyskanymi informacjami z pracownikami (sprzężenie zwrotne). Przekaz zwrotny powinien także informować o działaniach organizacji podjętych bądź planowanych do podjęcia w odpowiedzi na otrzymane dane. Powyższe kwestie są przedmiotem rozważań autora. W artykule dokonano poza tym usystematy-zowania wiedzy na temat badań opinii pracowników oraz warunków optymalizacji korzyści z nich.

In its deliberations the author stressed the importance of rare information and access to it in the managing of a modern organization. Very important is also the ability to share the information with the various interest groups. Having current information is getting easier. It is increasingly difficult to obtain rare information, that give a competitive advantage. This is due to the nature of mass media and the increasing access to cheap sources of data (eg. Internet). For organizations, this means difficulties in establishing a sustainable advantage over their competitors. For the consumer it is a win-win situa-tion, since it allows to participate in the market game on equal terms. Most authors deals with access to information from customers perspective and they ignore employees. Meanwhile, the employees are equally important group of stakeholders of the organi-zation. Of course they are a valuable source of information about the company, but it is necessary to maintain a relationship based on partnership. This is due to the paradigm in the management that dialogue with the staff is a condition for the smooth functioning of the organization. It also means the ability to share information. A useful tool for conducting such a dialogue is an employee opinion survey. On the one hand they make possible to obtain interesting data. On the other hand, it should be natural to share the information with employees (feedback). The return information should also inform about the actions taken or planned by the organization in response to the received data. These issues are considered by the author. The article besides systematize the knowledge about the employee opinion surveys and the conditions for maximizing the benefits of them.

This article presents selected legal regulations that form the principles of access to public information in the context of digital exclusion. The author believes that this paper is an attempt to provide answers to questions about the impact of law on the scope of digital exclusion and about how to counteract it. The paper addresses issues of the greatest importance to this particular legal matter, such as: forms of access to information, the impact of the development of e-government on the legal regulation of access to public information and solutions that provide for an objectively wide scope of access to information. The research allows for a diagnosis of the most important problems in the context of access to information and brings a basis for de lege ferenda conclusions. The prevailing research method applied in the paper is the analysis of the law in force.

W artykule zostały przedstawione wybrane regulacje prawne kształtujące zasady dostępu do informacji publicznej w kontekście problemu wykluczenia cyfrowego. W ocenie autora opracowanie to stanowi próbę odpowiedzi na pytania o wpływ prawa na rozmiar zjawiska wykluczenia cyfrowego oraz o sposoby przeciwdziałania temu. Artykuł uwzględnia najważniejsze dla tej problematyki zagadnienia, takie jak: sposoby dostępu do informacji, wpływ rozwoju e-administracji na prawną regulację dostępu do informacji publicznej oraz rozwiązania, które służą obiektywnie szerokiemu zakresowi dostępu do informacji. Przeprowadzone badania pozwoliły na zdiagnozowanie najpoważniejszych problemów występujących w obszarze dostępu do informacji i stanowiły asumpt do przyjęcia wniosków o charakterze de lege ferenda. W pracy posłużono się przede wszystkim metodą dogmatyczno-prawną.
The paper is a report on the research I carried out in 2021 among the d/Deaf. As part of the studies, 15 individual in-depth interviews were conducted. I also analyzed the statements of d/Deaf taking part in on-line debate entitled “Barriers of hard of hearing persons during the pandemic”. The subjects of my interests were the persons’ functioning problems which: appeared in COVID-19 pandemic, became more visible during that time, or which took on a new dimension during the pandemic. In this paper, I focused on the issues such as access to information for the d/Deaf, and especially the role of the media in this process. The persons I studied in my research, especially at the beginning of the pandemics, experienced the deterioration of life quality, also in terms of information access, which in the face of various types of threats is particularly desirable. On the other hand, the pandemic situation, according to some of the persons I studied, contributed to the availability increase of media coverage for deaf and hard of hearing persons, which, in my opinion, will positively influence the process of their integration in society.

Tekst jest relacją z badań, które autorka zrealizowała w 2021 roku wśród g/Głuchych. W ich ramach przeprowadzono 15 wywiadów pogłębionych. Analizie poddano także wypowiedzi g/Głuchych uczestniczących w debacie on-line. Autorkę interesowały problemy ich funkcjonowania, które pojawiły się w trakcie pandemii COVID-19, lub które w tym czasie stały się bardziej widoczne czy też nabrały nowego wymiaru. W artykule skoncentrowano się na kwestiach dostępu g/Głuchych do informacji i roli mediów w tym procesie. Badane przez autorkę osoby doświadczały, zwłaszcza na początku pandemii, pogorszenia jakości życia, także w aspekcie dostępu do informacji, który w obliczu różnego rodzaju zagrożeń jest szczególnie pożądany. Z drugiej strony pandemiczna sytuacja w opinii części badanych przyczyniła się do zwiększenia dostępności przekazów medialnych dla osób nie(do)słyszących, co zdaniem autorki pozytywnie wpłynie na proces ich integracji w społeczeństwie.
Autorzy artykułu dokonują przeglądu i systematyzacji działań Rady Europy w zapewnianiu jednego z kluczowych czynników demokracji liberalnej – wolności słowa, która jest warunkiem realizacji szeregu innych praw i wolności. Autorzy kategoryzują podstawowe dokumenty, zarówno te, które już stały się klasyką, jak i te przyjęte niedawno, w których zjawisko to uległo utrwaleniu prawnemu. W artykule zbadano, w jaki sposób wpływa ono na kształtowanie i rozwój prawa człowieka do informacji w Europie. Zwraca się uwagę na fakt, że wraz z pojawieniem się nowych sposobów rozpowszechniania informacji, w tym przede wszystkim wobec potencjału internetu, oraz gromadzeniem informacji i wysiłkami społeczeństw Europejskiej na rzecz ochrony tego podstawowego w demokracji prawa, jego dalsze wzmacnianie pozostaje istotną kwestią. Rada Europy utraciła kontrolę nad przestrzeganiem prawa człowieka do informacji, a informacje są wykorzystywane w destrukcyjnych celach, co stanowi zagrożenie dla jednej z fundamentalnych wartości, na podstawie których funkcjonuje dziś społeczeństwo europejskie zwiększając ryzyko przywrócenia autorytaryzmu. Autorytaryzmem zagrożone są przede wszystkim nowe demokracje Europy Wschodniej. Światowa pandemia COVID-19 i światowa recesja gospodarcza, w wyniku której obywatele chętniej wybierają autorytarnych przywódców, może być przyczyną wprowadzenia autorytaryzmu.

In the article, the authors review and systematize the activities of the Council of Europe in ensuring one of the key factors of liberal democracy – freedom of expression, which is a prerequisite for the implementation of a number of other rights and freedoms. The authors categorize the basic documents, both those that have already become classics and those adopted recently, where this phenomenon has found legal consolidation. It studies the way in which it affects the formation and development of the human right to information in Europe. Attention is drawn to the fact that, with the emergence of new ways of disseminating information, including the potential of the internet first and foremost, the accumulation of information and the European community’s efforts to protect this fundamental democratic right, its further strengthening remains urgent. The Council of Europe has lost control over the observance of the human right to information, and information is used with destructive intent, which poses a danger to one of the fundamental values on the basis of which European society operates today, and raises the risk of the restoration of authoritarianism. First and foremost, there is a threat of authoritarianism in the new democracies of Eastern Europe. The global COVID-19 pandemic and the recession of the world economy, which encourages citizens to choose authoritarian leaders, may be the trigger for slipping into authoritarianism.
Artykuł omawia utrudnianie dostępu do informacji publicznej przez Kancelarię Sejmu (list poparcia kandydatów do Krajowej Rady Sądownictwa) mimo jej zasadniczego znaczenia dla oceny konstytucyjności Rady. Wątpliwości wyrażone przez TSUE w wyroku z dnia 19 listopada 2019 roku (w połączonych sprawach C-585/18, C-624/18 i C-625/18), podzielone przez Sąd Najwyższy w uchwale BSA I-4110-1/20 z 23 stycznia 2020 roku, można sprowadzić do wymogu weryfikacji całego procesu powoływania członków, ze szczególnym uwzględnieniem inspekcji papierowych dokumentów posiadanych przez Kancelarię Sejmu. Bezwnioskowe udostępnienie tych list nastąpiło w lutym 2020 roku, w sytuacji, w której status Rady został już rozstrzygnięty w uchwale Sądu Najwyższego. Pomimo solidnych podstaw konstytucyjnych dla dostępu do tego rodzaju informacji (art. 54, 61 Konstytucji RP) praktyczny problem z egzekwowaniem Konstytucji RP tkwi w mało skutecznej regulacji ustawowej, jak na ironię osłabionej przez władzę sądowniczą, pierwszą ofiarę kultury tajności, oraz dużą niechęć uczestników życia politycznego (w tym opozycji) do zwiększenia poziomu przejrzystości w parlamentarno-gabinetowym systemie rządów. Artykuł dowodzi, że kwestia zakresu i efektywności ustawowego reżimu dostępu do informacji nie może być zakładnikiem politycznego kompromisu, ilekroć informacja ma kluczowe znaczenie dla zachowania porządku konstytucyjnego.

The article concerns the obstruction of access to public records (affidavits of support for candidates to the Polish National Council of The Judiciary) by the Chancellery of the Sejm, despite its fundamental importance for assessment of the Council’s constitutionality. The concerns expressed by the European Court of Justice on November 19th, 2019 in joint cases A.K. & Others (C-585/18, C-624/18 and C-625/18) followed by Polish Supreme Court resolution BSA I-4110-1/20 of January 23rd, 2020 may boil down to the need of verifying the entire appointment process through the inspection of paper records held by the Sejm. The proactive disclosure of the crucial records by the Sejm in February 2020 took almost two years when the legal dispute regarding the Council’s status had already been resolved by a Supreme Court resolution. Despite strong and clear constitutional provisions for access to such information (art. 54, 61 of the Constitution of Poland), the practical problem lies in the relatively inefficient freedom of information law weakened, ironically by the first victim of such a culture of secrecy, the judiciary itself, and the extreme reluctance of all political actors (including the opposition) in a parliamentary system of government to improve transparency. The article proves that there shall be no compromise over the scope and efficiency of the FOIA law if the records are of fundamental importance for the preservation of constitutional order.
Celem niniejszego artykułu jest zbadanie, czy nowelizacja ustawy o dostępie do informacji publicznej z 7 listopada 2014 r., uznająca wprost treści wyroków sądowych za informacje publiczne, wpisuje się w dotychczasową linię orzeczniczą oraz poglądy doktryny. Jednocześnie artykuł stanowi zaproszenie do dyskusji, w jakich okolicznościach oraz w jakiej formie dopuszczalna jest odmowa udostępnienia wyroku sądowego, zwłaszcza przez wzgląd na ochronę prywatności osób fizycznych lub w przypadku żądania informacji przetworzonej. Wspomniane rozważania są prowadzone przy zastosowaniu metody dogmatyczno-prawnej i opisowej. Kluczowym założeniem artykułu jest stwierdzenie, że treści wyroków sądowych stanowią prostą (nieprzetworzoną) informację publiczną. Dostęp do informacji publicznej nie jest jednak prawem absolutnym, ergo podlega ograniczeniom, spośród których Autorka szczególną uwagę poświęca ochronie prywatności. Wreszcie, trzeba zauważyć, że w pewnych przypadkach nawet anonimizacja treści orzeczenia lub odmowa jego udostępnienia może w istocie czynić ochronę prywatności jedynie iluzoryczną. Pożądane jest zatem doprecyzowanie przez ustawodawcę lub orzecznictwo procedury udostępniania treści wyroków sądów.

The purpose of this article is to examine, whether the amendment to the law on access to public information, dated on November 7 th , 2014, directly recognizing the content of judgments for public information, is in accordance with the existing line of case law and views of doctrine. At the same time the article is an invitation to discussion under what circumstances and in what form a refusal to provide the court judgment is allowed, especially for the sake of protection of privacy of individuals or in the case of requ- est for processed information. This research is conducted with the use of legal dogmatic and descriptive method. The key assumption of this article is to state that the content of judgments is an ex- ample of simple (unprocessed) public information. Access to public information is not an absolute right, ergo it is subject to restrictions, among which the Author devotes spe- cial attention to the protection of privacy. Finally, it should be noted that in some cases, even anonymization of content of the judgment or refusal to make it available may in fact make the protection of privacy only illusory. It is therefore desirable to clarify by the legislator or case law the procedure for access to content of court judgments.
The Constitution of the Republic of Poland and Act of 6 September 2001 on access to public information ensures the right to information about the activities of public authority organs as well as subjects performing public tasks. Political parties are obligated by the Act to provide information about their funding. Furthermore, according to the Supreme Administrative Court of Poland there is no doubt that a political party fulfils a public role (case no. I OSK 513/13), which results in an obligation to disclose information on their activity and finances to the public. The case law of administrative courts brings many additional rules: the definition of an official document of the Code of Civil Procedure does not apply under the Act; the sphere of public information contains all kinds of data on party finances, including paid invoices and contracts of civil law, as well as information and documents about how to determine the amount of membership fees. Parties are also obligated to disclose resolutions of the Management Board and other documents produced by the party organs, unless these documents are of a general organizational nature and they do not provide any additional information. Political parties do not however, have such obligation regarding information and documents relating to the meetings of their leaders, as well as other information on the methods and means of action of the party.

Konstytucja Rzeczypospolitej Polskiej oraz Ustawa z 6 września 2001 r. o dostępie do informacji publicznej gwarantują prawo dostępu do informacji dotyczącej działalności organów władzy publicznej oraz podmiotów wykonujących zadania publiczne. Partie polityczne są zobowiązane ustawą do udostępniania informacji dotyczących ich finansowania. Co więcej, jak orzekł Naczelny Sąd Administracyjny, nie ma wątpliwości, że każda partia polityczna spełnia funkcje publiczne (OSK 513/13). Rezultatem tego stanowiska jest zobowiązanie partii do udostępniania informacji dotyczących ich aktywności oraz finansów. Judykatura uzupełnia regulacje ustawowe o wiele dodatkowych reguł, m. in. definicja dokumentu urzędowego z Kodeksu Postępowania Cywilnego nie ma zastosowania na gruncie omawianej ustawy; sfera informacji publicznych obejmuje wszelkiego rodzaju dane dotyczących wydatkowania przez partię środków finansowych, w tym opłaconych przez nią faktur i zawartych umów cywilnoprawnych jak również informacje dotyczące sposobu ustalania wysokości składek członkowskich oraz dokumentów, na podstawie których ta składka jest ustalana. Partie są także zobowiązane do ujawniania uchwał zarządu oraz innych dokumentów wytworzonych przez struktury partyjne, chyba, że mają one charakter ogólny i nie zawierają żadnych dodatkowych informacji. Nie posiadają natomiast takiego statusu informacje i dokumenty dotyczące spotkania liderów partii politycznych, jak również inne informacje o metodach i środkach działania danej partii.
