Artykuł przedstawia najistotniejsze prawne następstwa rozszerzenia strefy Schengen na podstawie zasad poamsterdamskich, które można określić jako trójetapową akcesję do strefy Schengen. Zostały one zdefiniowane w Protokole Schengen i rozszerzone w traktatach akcesyjnych oraz prawie pochodnym UE. Obszarem badawczym są reguły dotyczące włączania nowych państw do obszaru Schengen oraz prawne konsekwencje tego procesu. Stanowią one kluczową reformę strefy Schengen i wyznaczają nowy kierunek rozwoju „obszaru bez granic”. W artykule postawiono hipotezę główną i dwie hipotezy cząstkowe. Hipoteza główna zakłada, że zasady poamsterdamskie stały się najważniejszą reformą acquis Schengen, wyznaczając prawną konieczność oraz nowe prawne następstwa rozszerzenia strefy Schengen. Konsekwentnie można postawić dwie hipotezy cząstkowe, że opracowanie zasad poamsterdamskich przyspieszyło rozwój strefy Schengen, a tym samym wzmocniło „obszar bez granic”. Druga z hipotez cząstkowych wskazuje, że obszar ten należy rozpatrywać dwuaspektowo, jako obszar prawa i obszar terytorialny, które poprzez realizację zasad poamsterdamskich ulegają stopniowemu ujednolicaniu. Przy zastosowaniu metodologii badań prawnych dokonano analizy prawa pierwotnego UE oraz unijnego prawa pochodnego w zakresie dorobku Schengen inkorporowanego do prawa UE na mocy Traktatu amsterdamskiego (TA).
This article takes up in the form of an interdisciplinary legal and political analysis the issue of the incorporation of the Schengen acquis into European Union law and the national legal systems of the EU member states in the light of the concept of a hybrid system of territorial governance. Accordingly, the Schengen acquis stimulated the process of intersecting the interests of internal security and the protection of Member States’ borders with the supranational ideological imperative with regard to the principle of free movement of persons. The argument developed in this article is that the incorporation of the Schengen acquis into EU law consolidated hybridity of the legal and institutional construction of the EU after the Amsterdam Treaty as a result of the contradiction between the logic of political bargain at the intergovernmental level and the vertical spillover generated at the supranational level in the institutional and decision-making dimensions. The conclusions point to the emergence, as a result of “schengenisation”, of the area of freedom, security and justice in the EU, in which the principle of free movement of people brought about diversification of the states’ adaptation mechanisms in relation to the ideologically determined project of transformation of the system of management of the territory and borders within the European Union. Niniejszy artykuł podejmuje w formie interdyscyplinarnej analizy prawno-politologicznej problematykę włączenia acquis Schengen do prawa Unii Europejskiej oraz prawa krajowego państw członkowskich UE w świetle koncepcji hybrydowego reżimu zarządzania granicami i terytorium. Zgodnie z nią, acquis Schengen stymulowało proces krzyżowania interesów bezpieczeństwa wewnętrznego i ochrony granic państw członkowskich z ponadnarodowym imperatywem ideologicznym w odniesieniu do zasady swobodnego przepływu osób. Hipotezą badawczą w tym artykule jest założenie, że inkorporacja acquis Schengen do prawa UE ugruntowała hybrydowość prawno-instytucjonalnej konstrukcji UE po wejściu w życie traktatu amsterdamskiego wskutek sprzeczności logiki przetargu politycznego na poziomie międzyrządowym i wertykalnego spill-over wygenerowanego na poziomie ponadnarodowym w wymiarze instytucjonalnym i polityczno-decyzyjnym. Wnioski wskazują na ukonstytuowanie w wyniku „schengenizacji” przestrzeni wolności, bezpieczeństwa i sprawiedliwości UE, w której zasada swobodnego przepływu osób skutkowała zróżnicowaniem mechanizmów adaptacyjnych państw w odniesieniu do zdeterminowanego ideologicznie projektu transformacji systemu zarządzania terytorium i granicami w Unii Europejskiej.

This article discusses legal and organizational dimensions of the Schengen area. The author points out that the Schengen area concerns economic, social and political processes in Europe. The purpose of the article is to discuss the legal, multi-faceted basis for the functioning of the Schengen acquis. It also covers the institutional framework for the implementation of Schengen tasks, including the role of the executive agencies Frontex and EASO, as well as the tasks that accompany the operations of SIS II, VIS and EUROSUR systems. The final section is devoted to one of the key issues of the functioning of the Schengen area, namely the provisions on the protection of personal data.
Przedmiot artykułu stanowią uwarunkowania prawne definicji granic wewnętrznych i zewnętrznych w Unii Europejskiej i strefie Schengen oraz przełożenie ich na poszczególne rodzaje granic, z uwzględnieniem tych, na których sytuacja ulega zmianom w wyniku specyficznych uwarunkowań prawnych państwa oraz kryzysu migracyjnego. Artykuł wyjaśnia podstawy prawne granic wewnętrznych i zewnętrznych strefy Schengen i UE, rozpoczynając od ich kształtowania się aż do aktualnego statusu w krótkim odniesieniu do ich etymologii prawnej. Celem artykułu jest również określenie granic „obszaru bez granic”, zwłaszcza w kontekście zróżnicowanej sytuacji na granicach wewnętrznych i zewnętrznych. Artykuł obejmuje wyłącznie uwarunkowania normatywne, bez szerszych odniesień do aspektu terytorialnego, ze względu na rozległość tematu oraz ograniczenia tekstowe. Należy postawić tezę, że w wymiarze normatywnym granice UE i strefy Schengen ulegają ujednoliceniu, pomimo różnic w wymiarze terytorialnym. Przepisy unijnego kodeksu zasad regulujących przepływ osób przez granice podkreślają, że wspólne środki w zakresie przekraczania przez osoby granic wewnętrznych oraz kontroli na granicach zewnętrznych powinny odzwierciedlać acquis Schengen włączony w ramy prawne i instytucjonalne UE.

Legal conditions for the definition of internal and external borders in the European Union and Schengen area are regulated by the provisions of the Schengen Border Code, which is a specific constitution of the Schengen area, being also an integral part of the European Union law. The explanation of the legal basis of the internal and external borders of the Schengen and EU zones requires reaching to their legal etymology, starting from their formation up to their current status in a short reference to the migration crisis. The aim of the article is also to define the boundaries of the „area without borders”, especially in the context of the diverse situation at internal and external borders. The spread of the European Union and the Schengen zone will be determined by means of legal indicators, the most important of which is the free movement of persons and the Area of freedom, security and justice. Full explanation of legal conditions of the borders involves referring to their crossing rules. To this end, it is necessary to distinguish the subjective and objective aspect of crossing internal and external borders based on EU law acts, in particular the amended in 2016 and 2017 provisions of the Schengen Border Code, which is a specific constitution of the Schengen area, which is also an integral part of European Union law. It should be argued that, in the legal dimension, the borders of the EU and the Schengen area are being unified, despite differences in the territorial dimension. Confirmation, already at the beginning, can be found in the revised SBC regulations, according to which a common policy of crossing external borders is a means of creating an area where people can move freely on the basis of treaty provisions. The provisions of the EU Code on the rules governing the movement of persons across borders emphasize that joint measures on crossing internal borders by persons and controls at external borders should reflect the Schengen acquis incorporated into the legal and institutional framework of the EU.
The article presents the most important legal consequences of the enlargement of the Schengen area based on the post-Amsterdam principles, which can be described as the three-stage accession to the Schengen area. They are defined in the Schengen Protocol and extended in the accession treaties and in EU secondary law. The research area is the rules on the integration of new member states into the Schengen area and the legal consequences of this process. They are crucial reform of the Schengen area and set a new direction for the development of the „area without borders”. The article presents the main hypothesis and two partial hypotheses. The main hypothesis is that the post-Amsterdam principles have become the most important reform of the Schengen acquis, setting out the legal necessity and the new legal implications of the enlargement of the Schengen area. Two partial hypotheses can be made that the development of the post-Amsterdam principles has accelerated the development of the Schengen area and thus strengthened the principles of EU law as the „area without borders”. The second sub-hypothesis indicates that this area should be considered in two aspects: as a legal area and as a territorial area, which are gradually becoming unified through the implementation of the post-Amsterdam principles. The methodology for legal research has been used to analyse the primary EU law of the Schengen acquis as incorporated into EU law by the Amsterdam Treaty (AT).
