According to the act Law on proceedings before administrative courts amended in 2017, mediation proceedings shall be conducted by a mediator appointed by the parties or by the court. Mediation proceedings are not open and a mediator should stay impartial in conducting mediation. A mediator is entitled to receive remuneration and reimbursement of costs related to the mediation and shall draft a protocol from mediation proceedings.

Zgodnie z ustawą Prawo o postępowaniu przed sądami administracyjnymi znowelizowaną w 2017 r., postępowanie mediacyjne prowadzi mediator wybrany przez strony lub sąd. Postępowanie mediacyjne nie jest jawne, zaś mediator powinien zachować bezstronność przy prowadzeniu mediacji. Mediator ma prawo do wynagrodzenia i zwrotu wydatków związanych z przeprowadzeniem mediacji oraz powinien sporządzić protokół z przebiegu postępowania mediacyjnego.
