In the public debate, the additional annual pecuniary benefit for pensioners operates under the term "thirteenth pension". The purpose of the article is to assess the legal nature of this benefit and to answer the question whether it constitutes the implementation of the constitutional right to social security expressed in Article 67 of the Constitution. For this purpose, the author discusses the provisions of the Act of 9 January 2020 on additional annual pecuniary benefit for pensioners, assessing them through the characteristic features of traditional methods implementing the idea of social security. The analysis leads to the conclusion that the additional annual pecuniary benefit is an instrument of social security, to some extent falling within the scope regulated in Article 67 of the Constitution.

W debacie publicznej dodatkowe roczne świadczenie pieniężne dla emerytów i rencistów funkcjonuje pod pojęciem „trzynastej emerytury”. Celem artykułu jest ocena charakteru prawnego tego świadczenia i odpowiedź na pytanie, czy świadczenie to stanowi realizację konstytucyjnego prawa do zabezpieczenia społecznego wyrażonego w art. 67 Konstytucji. Podejmując próbę odpowiedzi na to pytanie autorka omawia przepisy ustawy z 9 stycznia 2020 r. o dodatkowym rocznym świadczeniu pieniężnym dla emerytów i rencistów, dokonując ich oceny przez pryzmat cech charakterystycznych dla tradycyjnych metod realizacji idei zabezpieczenia społecznego. Przeprowadzona analiza prowadzi do wniosku, że dodatkowe roczne świadczenie pieniężne jest instrumentem zaopatrzenia społecznego, w pewnym stopniu wpisującym się w zakres unormowany w art. 67 Konstytucji.
