Advertising is closely related to the existence of the market, the essence of which is the exchange of goods and services. The law sometimes interferes with some areas leading to the reduction of the possibility of advertising a service or product. In many countries, including Poland, among others, advertising medical activity is prohibited. The purpose of this article is to present legislation and issues related to the advertising of health services (medical activity).

This article covers considerations on the e-mail marketing of financial products and services aimed at consumers. The research paper presents the practice of banks used by those institutions in the e-marketing; basic concepts such as information, offer, advertisement, communication or spam have been considered. The article addresses in particular relevant problems linked to sending advertising materials by e-mail, i.e specifying what types of messages a bank may send to its customers, whether a bank may send such messages to all its customers, whether a bank may send such messages only to its customers, what the consumers rights with respect to receiving unwanted and unsolicited commercial information are. The research paper took into consideration current judicature and views of legal writers.

The aim of this work is presenting main aspects of the problem of unfair and inadmissible advertising addressed to elders. The author presents the concept of advertising as well as the regulations concerning it in applicable provisions of Polish, European and international law, focusing mainly on characteristics of unfair and inadmissible advertising. Main part of work is the presentation of elders as a specific group of consumers who are particularly exposed to unlawful business practices. As an example of it the author points out the cases of unfair and inadmissible advertising which are the subject of proceedings before the Office for Competition and Consumer Protection. The author also presents the commonly used unlawful business practices directed against elders. The culmination of this work is an indication what steps can be taken by elders so as not to become a victim of unfair and inadmissible advertising.

Artykuł obejmuje rozważania dotyczące marketingu e-mailowego usług i produktów finansowych skierowanego do konsumentów. W opracowaniu zaprezentowano praktykę banków, która jest wykorzystywana przez te instytucje w e-marketingu, poddano też rozważaniom podstawowe pojęcia, takie jak informacja, oferta, reklama, komunikat czy spam. Artykuł porusza w szczególności istotne problemy wysyłania materiałów reklamowych pocztą elektroniczną, do których należą: określenie jakiego rodzaju wiadomości bank może wysyłać swoim klientom, czy bank może wysyłać wiadomości wszystkim swoim klientom, czy bank może wysyłać wiadomości wyłącznie do swoich klientów, jakie są prawa konsumentów w zakresie otrzymywanej niechcianej i niezamówionej informacji handlowej. W opracowaniu uwzględniono aktualne orzecznictwo oraz poglądy przedstawicieli doktryny prawa.
