The purpose of the article is, first of all, to evaluate the rules concerning an agricultural activity run by social cooperatives and, secondly, to identify legal issues associated with setting up and running an activity by these entities, and to make an attempt to solve these problems. The first part of the article focuses on setting up a cooperative and on its members, especially people with disabilities, farmers and household members with the status of the unemployed. It presents some selected court decisions. Then, the paper discusses the issue of running an agricultural activity by social cooperatives. It raises the question of land contributions and tries to determine whether social cooperatives running an agricultural activity can be regarded as agricultural production cooperatives. This classification is important in terms of exercising the right of preemption in the event of sales of a land contribution or leased agricultural lands. Then, the paper focuses on the issue of de minimis aid and de minimis aid in agriculture. In conclusion, the author puts forward de lege ferenda proposals concerning preemption right in respect of a social cooperative. She also calls for the introduction of other legal instruments supporting the entity in question, e.g. greater opportunities to enlarge farms by the acquisition or lease of lands from the Agricultural Property Agency.
The aim of this article is to define the concept of agricultural activity, as a condition for direct payments. This requires a relationship of this concept to the definition of an active farmer. The draft regulation art. 4 of the proposal for a regulation of the European Parliament and the Council establishing rules for direct payments to farmer under support schemes within the framework of the Common Agricultural Policy, which is a new definition of agricultural activity, indicates the need to refer to this basic definition for agricultural law. In the classical formulations, agricultural activity is recognized as a sphere of business, with an indication of the economic, professional aspect of the production activities of the farmer. New regulations concerning the rules and procedures for the granting of EU fund, relating to the possession of agricultural land, raise the need to re- examine this issue, takin into account the conditions that combine possession of agricultural land with the performance of agricultural activities. This trend reflects the changes in the rules of the Common Agricultural Policy and is based on the assumption that the protection is not due to the mere fact of possessing of agricultural land, but also due to other fulfilled by agricultural producers functions: production, environmental and social. The presented approach requires analysis of the definition of agricultural activity on the basis of public law, private law and agricultural law. To determine the activity of which revenues are recognized as income from agricultural activities should furthermore benefit from the experience of European countries, Italy and France, which have regulations of this issues. They indicate the types of activities associated with agricultural activities and give them special preferences. In conclusion, it should be noted that the new rules for the granting of payments, which exclude from the system farmers receiving a certain income from non-agricultural activities are in conflict with the objectives of the Common Agricultural Policy, which prefer the diversity of activities in the farms. Diversification of agricultural activities, as appropriate for the needs of sustainable rural development, is also an important axis of the structural support financed by the European Agricultural Fund for Rural Development.
Multifunctionality of agricultural activity is pointed out, by many years, in the doctrine of agricultural law. There is no doubt, however, that the farmer at any time was, is and will be, primarily a producer of food. Food is in fact a specific type of product, necessary for human existence and conduct of agricultural activities is necessary to the manufacture of food. Aim of article is to clarify concepts of “farmer” and “ food business operator”, which are key issues, in the agricultural and food law. The analysis made in the article allows to identify of borders between these two concepts and to specify relationship between them. Author concludes that the majority of farmers are also food business operators. This means that farmers, irrespective of the size and profile of their activities farming, are required to comply with all requirements of food law, appropriate to the stage of primary food production. Taking into account a wide range of the regulation of food law, it must be underlined, that the legal situation of farmers is shaped to a large extent, by the requirements of food law.
Group of agricultural producers in the EU legislation is the preferred form of running an agricultural activity. The European Union in order to encourage individual farmers to cooperate within a group of agricultural producers introduced a number of incentive instruments, including a system of direct financial assistance to the group. Financial support from the European Union financial resources groups of agricultural producers receive from May 01st, 2004. Currently, the procedure and conditions for financial assistance granted to groups under the Common Agricultural Policy for the years 2014-2020 were largely modified. The above mentioned changes become effective from August 19th, 2016 and are strictly connected with the entry into force of the Regulation of the Minister of Agriculture and Rural Development dated August 02nd, 2016 On Detailed Conditions and Procedure for Granting Payment and Reimbursement of Financial Aid under the Action: „Setting up Producer Groups and Producer Organizations”. Under the new rules, financial assistance from the European Union may only receive a group of agricultural producers consisting solely of individuals. The legislator therefore limits the number of potential beneficiaries of aid excluding legal persons and organizational units without legal personality and with legal capacity. Moreover, financial aid would not be granted to a group of agricultural producers which had already received financial assistance from the EU budget funds. In addition, the legislator in the new Regulation introduced a number of criteria on which basis depends the order of granting financial aid. The analysis of the above criteria leads to the conclusion that the financial assistance is directed to the agricultural producer groups operating in the form of a cooperative, including at least 10 members, at the area with high agrarian fragmentation.
The paper constitutes an analysis from the point of view of the opportunity of legal system for agricultural entrepreneurship. The term “agricultural entrepreneurship” should be interpreted narrowly than “agribusiness”, which is understand as an industry engaged in the producing operations of a farm, the manufacture and distribution of farm equipment and supplies, and the processing, storage, and distribution of farm commodities.
The subject of this paper is to attempt to assess the legal regulation relating to the conservation of the resources, formations and elements of the nature in the agricultural activity carried out in the areas covered by one of the forms of the nature conservation. The analysis of the Nature Conservation Act of 2004 demonstrates that the legislature put in place a few limitations of the agricultural activity, related to the use of resources and elements of nature in the valuable areas due to the natural values. The scope of the prohibitions and restrictions laid down in the specific form of nature conservation depends on its objectives and functions. The subject of the analysis was the legal term “rational agriculture” with respect to the intended sustainable use of the natural resources. In the present Act, one claimed lack of specific instruments introducing requirement or even encouraging the making, in areas covered by conservation area, including agricultural activities, which helps to maintain high nature value. Ordering the terminology and adapting it to modern concepts of environmental protection, regulation of forest management, it would be time to replace the term “rational agriculture” to “sustainable agriculture”, referring to the modern concept of sustainable socio–economic development, the needs of environmental protection. It should be more precisely defined in relation to the term of the existing legal standards for environmental protection in agricultural activities, such as cross–compliance requirements. Regardless of the adopted terminology the legal term rational or sustainable farming should be referenced to the cross compliance requirements.

W części pierwszej skoncentrowano się na przedstawieniu tła historycznego kształtowania się oferty ubezpieczeń dla rolnictwa w Polsce oraz scharakteryzowano ryzyko związane z realizacją działalności rolniczej. W drugiej części artykuł prezentuje przegląd zakresu ochrony ubezpieczeniowej ryzyk właściwych dla działalności rolniczej, z uwzględnieniem ubezpieczeń obowiązkowych i dobrowolnych. Możliwy do zrealizowania zakres ochrony ubezpieczeniowej przedstawiono na przykładzie trzech wybranych zakładów ubezpieczeń. Celem artykułu jest poznanie ogólnego zakresu ochrony ubezpieczeniowej, którym objęta jest ludność zajmująca się rolnictwem, oraz jego historycznych uwarunkowań, w kontekście ryzyk związanych z prowadzeniem działalności rolniczej.

Nel XXI° secolo, i cambiamenti climatici avvenuti a larga scala hanno iniziato a influenzare quasi tutti gli aspetti della vita umana e dell’ambiente circostante. Essi hanno avuto un impatto specie sull’attività agricola. Per cui, nell’articolo si intende inquadrare, sia su scala globale sia locale, i cambiamenti in questione proprio sull’attività indicata (sull’esempio dell’Argentina). Le conoscenze scientifiche, tecniche e tecnologiche sono alla base del diritto pubblico internazionale in materia di clima, implementato, poi, negli ordinamenti giuridici nazionali, costituendo sia la ius novum che la ius fieri. La legislazione in oggetto prevede di applicare norme giuridiche specifiche che regolano lo status del c.d. agroclima. Esse si riferiscono all’ambiente, le risorse naturali rinnovabili, gli eventi naturali e il loro impatto sull’attività agricola, il substrato ecologico e la componente tecnica. A parere dell’autrice, l’applicazione di norme internazionali in materia di diritto del clima nell’ambito dell’ordinamento giuridico argentino potrebbe contribuire a migliorare lo sviluppo rurale sostenibile nel Paese e a mantenere gli agro-ecosistemi, attualmente in funzione. A tal fine, in Argentina, bisognerebbe adottare il disegno, già proposto, di legge sui cambiamenti agro-climatici.

There is a bidirectional relationship between the transverse and transdisciplinary phenomenon and the agricultural activity (technical fact) as they affect each other. Scientific, technical and technological knowledge constitute the basis of international public climate law that is made effective through national climate law, and can be conformed to a national agroclimatic law, authentic “ius novum,” “in fieri,” with specific norms of incidence in the agroclimate, referred to as: environment, renewable natural resources, natural phenomena and the agrarian activity of ecological substrate and regulated technical component. The implementation of international solutions could contribute to the sustainable development of the rural world and the resilience of agroecosystems and is recommended be adopted in the law on agroclimatic change proposed for Argentina.

Istnieje związek między transdyscyplinarnym zjawiskiem a działalnością rolniczą jako faktem technicznym, ponieważ wzajemnie one na siebie oddziałują. Wiedza naukowa, techniczna i technologiczna stanowi podstawę międzynarodowego publicznego prawa klimatycznego, które jest wprowadzane w życie przez krajowe prawo klimatyczne i może być zgodne z krajowym prawem agroklimatycznym, autentycznym „ius novum”, „in fieri”, z określonymi normami dotyczącymi agroklimatu, czyli: środowiska, odnawialnych zasobów naturalnych, zjawisk przyrodniczych i działalności rolniczej o podłożu ekologicznym i technicznym. Wdrożenie rozwiązań międzynarodowych mogłoby przyczynić się do zrównoważonego rozwoju świata wiejskiego i odporności agroekosystemów i jest ujęte w ustawie o zmianach agroklimatycznych proponowanych dla Argentyny.
To implement an efficient policy of the development of rural areas it is necessary to measure and evaluate processes occurring on farms. The paper is an attempt at evaluating the advancement (intensity) of the disagrarization process from a production and economic perspective at a sub-regional (local) level. Constructing a synthetic disagrarization rate, three variables were employed explaining: a percentage rate of households with an owner of a farm that do not earn income from agricultural activities, the share of land being in a poor agricultural condition in the area of arable land on farms and the livestock stocking density. Calculations made confirmed greater advancement of the phenomenon of disagrarization on the areas characterized by fragmented agrarian structure. The following sub-regions are characterised by the highest intensity of production and economic disagrarization: the Częstochowa, Sosnowiec, Kielce, Oświęcim, Bielsko-Biała and Rzeszów sub-regions.

Do prowadzenia skutecznej polityki rozwoju obszarów wiejskich niezbędne są pomiar i ocena procesów zachodzących w gospodarstwach rolnych. W opracowaniu przedstawiono próbę oceny zaawansowania (natężenia) procesu dezagraryzacji w ujęciu produkcyjno-ekonomicznym na poziomie subregionalnym (lokalnym). W konstrukcji syntetycznego wskaźnika dezagraryzacji wykorzystano trzy zmienne objaśniające: odsetek gospodarstw domowych z właścicielem gospodarstwa rolnego, które nie czerpią dochodów z działalności rolniczej, udział gruntów w złej kulturze rolnej w powierzchni użytków rolnych w gospodarstwach oraz obsadę zwierząt. Przeprowadzone obliczenia potwierdziły większe zaawansowanie zjawiska dezagraryzacji na obszarach o rozdrobnionej strukturze agrarnej. Do jednostek o największym natężeniu dezagraryzacji produkcyjno-ekonomicznej należą podregiony: częstochowski, sosnowiecki, kielecki, oświęcimski, bielski oraz rzeszowski.
The article makes an attempt to determine whether the legal regulations provide a perpetual lessee with, first of all, stable conditions to hold agricultural lands and to run a business activity on these lands and, second of all, whether the regulations make it easier for perpetual lessees to acquire the right to own the lands they possess. The first part of the article concentrates on the legal nature of perpetual usufruct as well as the rights and financial obligations of a perpetual lessee. Then, the paper focuses on the transformation of perpetual usufruct into the right of ownership and the expiry of perpetual usufruct. Next, the article analyses the issue of a perpetual lessee as an agricultural producer. At the end, the Author states that perpetual lessee possesses a wide range of rights and can freely run an agricultural activity on agricultural lands. The legislator has acknowledged perpetual usufruct, along with the most popular forms of holding lands such as ownership and lease, to be a stable element of rural relations. Thus, a perpetual lessee can be granted the European funds, agricultural tax reliefs and insurance in KRUS.

Celem artykułu była próba ustalenia, czy regulacje prawne zapewniają użytkownikom wieczystym stabilne warunki władania gruntami rolnymi oraz prowadzenia na nich działalności rolniczej, a także, czy ułatwiają tym podmiotom nabycie własności posiadanych gruntów. W pierwszej kolejności rozważania skupiały się na charakterze prawnym użytkowania wieczystego oraz uprawnieniach i obowiązkach finansowych użytkownika wieczystego. Następnie podjęto tematykę przekształcania użytkowania wieczystego we własność oraz wygaśnięcia użytkowania wieczystego. Kolejna część artykułu odnosiła się do zagadnienia użytkownik wieczysty jako producent rolny. W podsumowaniu stwierdzono, że rozważania wykazały, iż użytkownik wieczysty ma szeroki zakres uprawnień i może on swobodnie prowadzić działalność rolniczą na gruntach rolnych. Ustawodawca uznał bowiem, że użytkowanie wieczyste, obok najpopularniejszych form władania gruntami rolnymi, jak własność i dzierżawa, wpisało się trwale w stosunki wiejskie i dlatego użytkownik wieczysty może korzystać ze środków unijnych, ulg w podatku rolnym czy ubezpieczenia w KRUS.
System ubezpieczenia społecznego rolników od początku został ukształtowany jako system szczególny i odrębny w stosunku do powszechnego ubezpieczenia społecznego. Zasadę tę utrzymuje także obecnie obowiązująca ustawa o systemie ubezpieczeń społecznych, która w art. 5 stanowi, iż ubezpieczenie społeczne rolników, jeżeli nie podlegają oni ubezpieczeniu na podstawie jej przepisów, regulują odrębne przepisy. Podmiotowy zasięg ubezpieczenia społecznego rolników (zwanego dalej ubezpieczeniem rolniczym) zależy od zakresu pojęć: rolnika, działalności rolniczej oraz gospodarstwa rolnego. Ubezpieczeniem rolniczym jest objęty także małżonek rolnika (z wyjątkami) oraz domownicy, czyli osoby bliskie rolnikowi (niekoniecznie spokrewnione), które stale pracują w gospodarstwie rolnym, lecz nie są związane z rolnikiem stosunkiem pracy. W opracowaniu powołano orzeczenia sądowe precyzujące poszczególne elementy wskazanych pojęć. Ubezpieczeniu rolniczemu obowiązkowo (w odniesieniu do obu jego rodzajów) podlega rolnik oraz jego domownik, którego gospodarstwo rolne obejmuje obszar użytków rolnych powyżej 1 ha przeliczeniowego lub dział specjalny, jeżeli osoby te nie podlegają innemu ubezpieczeniu społecznemu lub nie mają ustalonego prawa do emerytury, renty albo do świadczeń z ubezpieczeń społecznych. Ustawa dopuszcza jednak możliwość objęcia takim ubezpieczeniem (na wniosek) w pełnym zakresie także rolnika posiadającego użytki rolne poniżej tego progu pod warunkiem, że działalność rolnicza stanowi stałe źródło jego utrzymania, co budzi zastrzeżenia. Zasady podlegania rolników ubezpieczeniu społecznemu wymagają nadal dyskusji, co wynika przede wszystkim z potrzeby zmniejszenia bardzo dużej obecnie dotacji z budżetu państwa na rzecz rolniczego funduszu emerytalno-rentowego. W opracowaniu przedstawiono zgłaszane w związku z tym propozycje dotyczące zakresu podmiotowego omawianego systemu oraz wysokości i konstrukcji składek na to ubezpieczenie.

The farmers’ social insurance system was formed at the very beginning to be a special and separate system in relation to universal social insurance. This principle is also maintained by the current Act on the social insurance system, which in art. 5 provides that farmers’ social security, if they are not insured under its provisions, shall be governed by separate provisions. The subject range of farmers’ social insurance (hereinafter referred to as agricultural insurance) depends on the scope of the terms: farmer, agricultural activity and farm. Farmer’s insurance is also covered by the farmer’s spouse (with some exceptions) and household members, i.e., persons close to the farmer (but not necessarily related), who are permanently employed on the farm, but who are not related to the farmer’s employment relationship. The judicial decisions specifying particular elements of the terms indicated are set out in the paper. Agricultural insurance is compulsory (for both types of insurance) subject to a farmer and his / her household where the farm in question covers more than 1 ha of agricultural land or special division if they are not subject to other social insurance or have no established right to a pension or other benefi ts from the social insurance system. However, the Act allows for the possibility, under the proposal, to cover such insurance on a full scale basis also for a farmer holding agricultural land below this threshold, provided that the agricultural activity is a permanent source of subsistence, and this raises objections. The principle of subjecting farmers to social insurance still needs to be discussed, which is mainly due to the need to reduce the current sizeable state subsidy to the agricultural pension fund. The proposals presented in this regard are related to the scope of the subject matter for the discussed system and the amount and construction of the premiums for this insurance.
The article analyzes the impact of plant production on the protection of biosphere resources. Agriculture significantly affects the quality of resources and natural environment assets and shapes their character. The quality of environmental resources determines the size and directions of agricultural production, and agriculture changes ecosystems, shapes the landscape, affects the quality and quantity of natural resources. European integration has influenced the relationship between agriculture and the environment in many directions. EU legislation and the formulation of development strategies and economic programs contribute to the greening of agricultural land use and the protection of biosphere resources. The assessment of these activities is definitely positive due to the creation of conditions for conflict-free coexistence of the protective function and the agricultural function.

Artykuł zawiera analizę wpływu produkcji roślinnej na ochronę zasobów biosfery. Rolnictwo w istotny sposób wpływa na jakość zasobów i walorów środowiska przyrodniczego oraz kształtuje ich charakter. Jakość zasobów środowiskowych determinuje wielkość i kierunki produkcji rolniczej, a gospodarka rolna zmienia ekosystemy, kształtuje krajobraz, wpływa na jakość i ilość zasobów naturalnych. Integracja europejska wielokierunkowo wpłynęła na relację rolnictwo – środowisko. Legislacja unijna oraz konstruowanie strategii rozwojowych i programów gospodarczych przyczyniają się do ekologizacji użytkowania gruntów rolnych i ochrony zasobów biosfery. Ocena tych działań jest zdecydowanie pozytywna ze względu na tworzenie warunków do bezkonfliktowego współistnienia funkcji ochronnej i funkcji rolniczej.
Al giorno d’oggi lo sviluppo sostenibile costituisce un argomento d’interesse in numerose sedi scientifiche, governative, sociali, con le discussioni coerenti con temi che riguardano tutti i livelli e tutti i tipi di pressione ambientale. Per questo motivo, degne di nota sono le attività intraprese dall’UNESCO per creare una piattaforma specifica per la cooperazione sostenibile, vale a dire le riserve di biosfera, le quali sono un eccezionale esempio del principio di sviluppo sostenibile messo in pratica.

Sustainable development and problems related to it are currently the subject of interest of numerous scientific, governmental and social bodies, and the discussion that is going on concerns all levels and types of environmental pressures. Therefore, the activities undertaken by UNESCO that aim at creating a platform for sustainable interaction in the form of biosphere reserves should be considered as worthy of presentation here. They constitute an exceptional manifestation of the implementation of the sustainable development principle in practice.

Problematyka zrównoważonego rozwoju jest obecnie przedmiotem zainteresowania licznych gremiów naukowych, rządowych, społecznych, a dyskusja merytoryczna dotyczy wszystkich poziomów i rodzajów presji środowiskowej. Z tego względu warto przedstawić działania podejmowane przez UNESCO w zakresie tworzenia specyficznej platformy zrównoważonego współdziałania, jaką są rezerwaty biosfery. Stanowią one wyjątkowy przejaw realizacji w praktyce zasady zrównoważonego rozwoju.
The purpose of this article is to determine the legal conditions for setting up and running an activity by farmers’ cooperatives and an attempt at establishing which of the legal regulations may encourage agricultural producers to organize such entities, and which impose barriers. The author starts by indicating the characteristic features of farmers’ cooperatives against other cooperative entities, which result from the new Act of 4 October 2018. Next, the procedure required to set up a farmers’ cooperative is presented. Special attention has been given to the cooperative’s statute, its bodies, and to the issues of shares and contributions. Subsequently, the author tried to establish whether the functioning cooperatives, including cooperative groups of agricultural producers and organizations of agricultural producers (also of fruit and vegetables), which meet the criteria laid down in the Act of 4 October 2018, will be able to qualify as farmers’ cooperatives. The author’s considerations also address the issue of financial incentives, which are meant to encourage farmers to set up cooperatives (preferential real estate tax and corporate income tax rates), within the aspect of de minimis aid and de minimis aid in agriculture. In the summary, the author states, among others, that the passing and entering into effect of the Act of 4 October 2018 on farmers’ cooperatives must be evaluated positively. Attempts to pass new provisions regarding cooperatives, both in general and in relation to chosen industries, such as farmers, have been made a number of times in the past years. At the same time, in its current shape, the Act of 4 October 2018 cannot contribute to a large-scale interest in the cooperative movement in rural areas, nor to the setting up of farmers’ cooperatives. For the above reasons, the author proposes that some changes be introduced to the new legal act.

Celem artykułu jest określenie prawnych uwarunkowań tworzenia i prowadzenia działalności przez spółdzielnie rolników oraz próba ustalenia, które z regulacji prawnych mogą zachęcać producentów rolnych do organizowania takich podmiotów albo stanowić bariery w tym zakresie. Rozważania rozpoczyna wskazanie cech charakterystycznych spółdzielni rolników na tle innych podmiotów spółdzielczych, a wynikających z nowej ustawy z dnia 4 października 2018 r. o spółdzielniach rolników. Następnie zaprezentowana została procedura zakładania spółdzielni rolników. Szczególna uwaga została zwrócona na statut, organy spółdzielni, zagadnienie udziałów i wkładów. W dalszej kolejności autorka stara się ustalić, czy działające spółdzielnie, w tym spółdzielcze grupy producentów rolnych, spółdzielcze organizacje producentów rolnych (także owoców i warzyw), spełniające wymagania wskazane w ustawie z 4 października 2018 r. będą mogły zostać uznane za spółdzielnie rolników. W ramach studium poruszone zostało także zagadnienie instrumentów finansowych mających zachęcić do zakładania spółdzielni rolników (preferencje w podatku od nieruchomości oraz podatku dochodowym od osób prawnych) w aspekcie pomocy de minimis oraz pomocy de minimis w rolnictwie. W podsumowaniu autorka stwierdziła m.in., że należy ocenić pozytywnie uchwalenie i wejście w życie ustawy z 4 października 2018 r. o spółdzielniach rolników. Od kilku lat podejmowane były bowiem próby uchwalenia nowych przepisów dotyczących spółdzielni zarówno w odniesieniu do zasad ogólnych, jak i wybranych branż, w tym spółdzielni rolników. Jednocześnie w obecnym kształcie ustawa o spółdzielniach rolników może nie przyczynić się do ożywionego zainteresowania ruchem spółdzielczym na obszarach wiejskich i tworzenia tych organizacji. Dlatego autorka proponuje rozważanie wprowadzenia kilku zmian do nowego aktu prawnego.
Life insurance is a voluntary and additional element of protection and financial security for the future of insured and financially dependent persons. This safeguard should be of particular importance in the agricultural sector, which is characterized by a high number of accidents at work causing loss of health and death. The decision to buy life insurance depends largely on the economic and social factors characterizing the farm. The purpose of the article is to identify and evaluate the factors determining the purchase of life insurance by persons conducting agricultural activity. Data was collected in the north-west region of Poland using a survey questionnaire. Identification of the factors affecting the purchase of life insurance was made by means of a two-dimensional relationship analysis and logit regression model. The basis of the model was a set of obtained independent variables, based on a survey conducted in 2018 among randomly selected farm owners or managers. The analysis showed that the decision to buy life insurance depended on the sex of the farm owner or manager, the number of people in the farmer’s household, and possession of production insurance. The presented research results indicate that the probability of buying life insurance decreased when the owner or manager of the farm was a man. On the other hand, when the number of people in the farmer’s household increased and agricultural production was insured, the probability of buying life insurance increased. Research results suggest that having life insurance is associated with high awareness of the threats arising from farming activities and is an expression of ensuring financial security for the farmer’s family members in the future.

Ubezpieczenie na życie jest dobrowolnym i dodatkowym elementem ochrony i zabezpieczenia finansowej przyszłości ubezpieczonego oraz osób od niego zależnych finansowo. Zabezpieczenie to powinno mieć szczególne znaczenie w sektorze rolnym, który charakteryzuje się dużą liczbą wypadków przy pracy, powodujących utratę zdrowia, a nawet życia. Decyzja o zakupie ubezpieczenia na życie zależy od czynników ekonomicznych i społecznych charakteryzujących gospodarstwo rolne. Celem artykułu jest identyfikacja i ocena czynników determinujących zakup ubezpieczenia na życie przez osoby prowadzące działalność rolniczą. Dane zebrano w regionie północno-zachodniej Polski za pomocą kwestionariusza ankiety. Identyfikacji czynników wpływających na zakup ubezpieczenia na życie dokonano za pomocą analizy zależności w ujęciu dwuwymiarowym oraz modelu regresji logitowej. Podstawą modelu był zestaw uzyskanych zmiennych niezależnych, bazujący na badaniu przeprowadzonym w 2018 r. wśród wylosowanych właścicieli lub zarządców gospodarstwa rolnego. Analiza wykazała, że decyzja o zakupie ubezpieczenia na życie zależała od płci właściciela lub zarządzającego gospodarstwem rolnym, liczby osób w gospodarstwie domowym rolnika oraz posiadania ubezpieczenia produkcji. Wyniki wskazują, że prawdopodobieństwo zakupu ubezpieczenia na życie malało, gdy właścicielem lub zarządzającym gospodarstwem rolnym był mężczyzna. Z kolei gdy liczba osób w gospodarstwie domowym rolnika wzrastała oraz produkcja rolna była ubezpieczona, prawdopodobieństwo zakupu ubezpieczenia na życie wzrastało. Rezultaty badań sugerują, że posiadanie ubezpieczenia na życie wiąże się z dużą świadomością zagrożeń wynikających z prowadzenia działalności rolnej oraz jest wyrazem dbałości o zabezpieczenie finansowe członków rodziny rolnika w przyszłości.
Problematyka niniejszego artykułu dotyczy jednego z aspektów prawnych działalności muzeów na wolnym powietrzu, czyli prowadzenia przez nie działalności rolniczej. Specyfika tej grupy muzeów oraz ich charakter sprawiają, że na gruncie prawnym są one nie tylko muzeami w rozumieniu Ustawy z dnia 21 listopada 1996 r. o muzeach, lecz także gospodarstwami rolnymi, do których stosuje się przepisy szeroko rozumianego prawa rolnego. Co więcej, hodowane w muzeach zwierzęta wymagają stałej opieki weterynaryjnej, a za jej zapewnienie odpowiada dyrektor instytucji. Są to zagadnienia, które nie wynikają wprost z Ustawy o muzeach i między innymi z tego powodu stanowią liczne problemy praktyczne dla muzealników. Tekst wzbogacony został o – ujęte w tabele i diagram – wyniki przeprowadzonego przez autorkę badania ankietowego wśród polskich muzeów na wolnym powietrzu, którego celem było ukazanie problemów prawnych, z którymi borykają się muzealnicy w codziennej pracy w tych muzeach. Artykuł stanowi pionierskie opracowanie przedmiotowej problematyki, gdyż do tej pory nie była ona w polskiej literaturze analizowana.

The discussed issue relates to one of the legal aspects of the operations of open-air museums, namely them running agricultural activity. The specificity of this group of museums and their character make them not only museums in the understanding of the Act on Museums of 21 November 1996, but also farms to which regulations of broadly conceived agricultural law apply. What is more, the animals raised at museums require regular veterinary care, and its provision should be secured by the institutions’ directors. These are all questions that do not stem directly from the Act on Museums, hence, among others, numerous problems faced by museum curators. The paper is accompanied by tables and diagrams containing the results of a survey conducted by the Author among curators from open-air museums meant to display the legal challenges they have to face on a daily basis in their works. The paper constitutes a pioneer study of these problems, since they have not as yet been analysed in Polish literature.
L’articolo si propone di risolvere i problemi di interpretazione relativi al concetto di fondo agricolo, azienda agricola, attività agricola presenti nella legge sul regime agricolo nel contesto della pratica notarile. A seguito della sua entrata in vigore, e in particolare della revisione del 14 aprile 2016, si sono verificati problemi di interpretazione legati ai concetti menzionati, ai quali la pratica e la dottrina hanno cercato di ovviare. Le modifiche introdotte, basate sulla revisione del 26 aprile 2019, hanno dato, almeno in parte, una risposta ai dilemmi segnalati. Non vi è dubbio che le varie interpretazioni in circolazione non erano d’aiuto nelnormalizzare la compravendita in oggetto. Pertanto, le modifiche andrebbero valutate positivamente,anche se le controversie continuano a sorgere. Ne è un esempio l’impatto, esercitato dalla modifica della destinazione d’uso dei fondi agricoli a fini non agricoli, sull’obbligo di svolgere un’attività agricola per la durata di 5 anni.

The aim of the considerations is an attempt to solve problems related to the interpretation of the concepts of agricultural property, an agricultural holding and agricultural activity as defined in the Act on shaping the agricultural system experienced by notaries in their practice. After the entry of the Act into force, and especially after the amendment of 14 April 2016, there emerged interpretation problems related to the concept of agricultural property, an agricultural holding and agricultural activity, but the practice and doctrine strived to find interpretative solutions despite the difficulties. As a result, however, diverse interpretations of the concepts or terms in question did not serve the stability of the trading in agricultural property. The modifications introduced on the basis of the amendment of the Act of 26 April 2019 were to some extent a response to the dilemmas reported, and as such they must be assessed positively. At the same time, certain controversial issues remain, and example of which is the impact of a change from the designation of agricultural property for non-agricultural purposes into a 5-year obligation to operate an agricultural holding.

Celem rozważań jest próba rozwiązania problemów interpretacyjnych związanych z pojęciem nieruchomości rolnej, gospodarstwa rolnego, działalności rolniczej w ustawie o kształtowaniu ustroju rolnego (UKUR) przy dokonywaniu czynności notarialnych. Po wejściu w życie UKUR, a szczególnie nowelizacji z 14 kwietnia 2016 r., pojawiły się problemy interpretacyjne związane z pojęciem nieruchomości rolnej, gospodarstwa rolnego oraz działalności rolniczej, ale praktyka i doktryna starały się znaleźć rozwiązanie. Modyfikacje wprowadzone na podstawie nowelizacji UKUR z 26 kwietnia 2019 r. były w pewnym zakresie odpowiedzią na zgłaszane dylematy. Nie ulega wątpliwości, że zróżnicowane wykładnie wspomnianych pojęć nie służyły stabilizacji obrotu nieruchomościami rolnymi. Dlatego zmiany należy ocenić pozytywnie. Jednocześnie nadal występują kwestie dyskusyjne. Przykładem jest chociażby wpływ zmiany przeznaczenia nieruchomości rolnych na cele nierolnicze na 5-letni obowiązek prowadzenia gospodarstwa rolnego.

The paper addresses some issues related to the status of agricultural activity in the light of the ‘Business Constitution.’ It discusses the conditions that an individual needs to meet in order to become an entrepreneur in the context of the Entrepreneurs’ Law, and the scope, categories and nature of exemptions to the application of economic activity regulations. The concepts of agricultural activity provide a background for these considerations. Also, this paper makes an attempt to answer the question of whether, in the light of legal acts included in the ‘Business Constitution,’ an agricultural activity can be considered an economic activity and a farmer, who is a natural person, can be considered an entrepreneur. The above classification is related to the problem of applying the ‘Business Constitution’ to agricultural activities. The author concludes that the new legal regulation comprehensively governs matters related to the establishment and pursuit of an economic activity, and, through the legal instruments it implements, helps entrepreneurs to support the development of economic activity. The definition of entrepreneur provided for in the Entrepreneurs’ Law is of a more general and universal dimension. The author finds that in some cases, the legislator extended the definition of agricultural production activity with the sale of partially processed plant and animal products made by the farmer. The paper also addressed the classification of agricultural producers by production size and by the exemptions applicable to certain operators.

Artykuł obejmuje kwestie statusu rolniczej działalności gospodarczej w ujęciu ,,Konstytucji Biznesu”. Omawia przesłanki decydujące o uzyskaniu statusu przedsiębiorcy w świetle ustawy Prawo przedsiębiorców (Pr.przeds.), zakres oraz kategorie wyłączeń stosowania przepisów regulujących działalność gospodarczą, w tym także charakter takich wyłączeń. Tło rozważań stanowią formułowane koncepcje działalności rolniczej. Podejmuje on próbę udzielenia odpowiedzi na pytanie czy w świetle aktów prawnych zawartych w ,,Konstytucji Biznesu” działalność rolnicza może być traktowana jako działalność gospodarcza, a osoba fizyczna prowadząca gospodarstwo rolne jako przedsiębiorca. Z taką kwalifikacją łączy się kwestia stosowania ,,Konstytucji Biznesu” w działalności rolniczej. Autor stwierdza, że nowa regulacja prawna w sposób kompleksowy reguluje zagadnienia w zakresie podejmowania i prowadzenia działalności gospodarczej oraz służy przedsiębiorcom poprzez wprowadzone instrumenty prawne wsparcia rozwoju działalności gospodarczej. Definicja przedsiębiorcy zawarta w Pr.przeds. ma walor bardziej ogólny, uniwersalny. Stwierdza on, że w pewnych przypadkach ustawodawca rozszerza pojęcie działalności wytwórczej w rolnictwie na sprzedaż w pewnym stopniu przetworzonych produktów roślinnych i zwierzęcych, które uprzednio sam wytworzył. Dostrzega klasyfikację podmiotów prowadzących działalność wytwórczą w rolnictwie z uwagi na jej rozmiar oraz przedmiotowy charakter wyłączeń w zakresie takiej działalności.
