The function of case law inevitably correlates with its practical application. It is vital to define the concept of applicable case law. The thorough process of case law application inherently involves from a more complex perspective the process of publication of case law. The subsequent legal issues, such as availability or accessibility of the texts of case law as well as the system of the editing of court decisions, shall be transparently raised and described. A transparent process in publishing court decisions would make a major contribution to the function of the case law used within the process of application of the practical law. It is necessary in practice to distinguish, in the process of legal argumentation, the original texts of judicial decisions and the edited texts or abstracts. Similarly, we need to distinguish the process of merely disclosing the texts of the decisions and the special process of selective editing within the publication system. A tendency to apply specially modified decisions and abstracts of judicial opinions in current legal argumentation looms robust. The phenomenon of abstracts, artificially created from court decisions, can be perceived as a quite practical. On the other hand, it is crucial to emphasize the considerable level of subjectivity in the mode of their creation. Automatic blanket disclosure of the texts of court decisions via public (electronic) access should be an elementary practice administered by public authorities. It would strengthen the confidence in the decision-making process of justice and the rule of law in general.
The purpose of the paper is to discuss the usefulness of application of various philosophical conceptions of vagueness to the problem of vagueness in law. Although it cannot be expected that any philosophical conception may solve the practical problems of interpretation and application of vague terms in legal texts, the philosophy of language may help lawyers to better understand their problems. The paper describes main philosophical conceptions of vagueness and in particular metaphysical, epistemic, semantic, and pragmatic theories. It is argued that the pragmatic conception of vagueness has the best explanatory force with respect to the problem of vagueness in law. The application of this conception, however, must be based on acceptance of internalistic theory of meaning and on the assumption that the purpose of legal interpretation is to reveal the intention of the legislator. Both assumptions are controversial.
The article shows the importance of the language of judicial interpretation as one of the types of legal interpretation. The basic features of the language of judicial interpretation prompted the author’s definition.
In the judicial practice of the Constitutional Tribunal, the review of constitutionality of general clauses involves several problems caused both by an insuffi ciently-defi ned character of those phrases and by an-extra-legal reference contained therein. The extent of review covers the entire provision of law including a general clause, which makes it possible to assess the clause in the legal environment in which it is situated. Indirectly, the review embraces the standards and values to which the clause refers. The Tribunal reviews not only the quality of general clauses, expressed by indefi niteness of terms used by the lawmaker, but also the predictability of the line of assessment taken in the course of their application. Another important factors in an assessment of their constitutionality are: the status (within the system of government) of an entity authorized to assign a specifi content to the general clause and the contestability of decisions of that entity in the course of proceedings.
The publication is an attempt to present general clause as an universal construction that overcome the traditional division of legal system into branches of law not only because of its presence in every branch of law but also because of some characteristics associated with the purpose and effect of its introduction to the legal system. Detailed views of doctrine and legal practice shows similarities resulting from the axiological connotation of general clauses, their role in the processes of law application and influence of judicial practices on the understanding of these clauses. Presence of general clauses in legal system effect positively on the flexibility of law application processes and at the same time also entails difficulties associated with the need to maintain a proper balance between said flexibility and certainty and uniformity of application of the law.

Publikacja jest próbą przedstawienia klauzuli generalnej jako uniwersalnej konstrukcji, która przełamuje tradycyjny podział systemu prawnego do gałęzi prawa, nie tylko ze względu na swoją obecność w każdym dziale prawa, ale także z powodu pewnych cech związanych z celem i efektem jej wprowadzenia do systemu prawnego. Szczegółowe poglądy doktryny i praktyki prawniczej wykazują podobieństwa wynikające z ontologicznej konotacji klauzul generalnych, ich roli w procesach stosowania prawa i wpływu praktyki sądowej na zrozumienie poszczególnych klauzul. Obecność klauzul generalnych w systemie prawa wpływa pozytywnie na elastyczność procesów stosowania prawa, ale jednocześnie wiąże się z koniecznością utrzymania właściwej równowagi między elastycznością a pewnością i jednolitością stosowania prawa.
The phenomenom of the provincial codes creates inevitably an essential part of the field of the publication law. The subject of publication of legal acts itself forms basic law standard which is supposed to be common knowledge in the day-to-day legal practice as well as the jurisprudence. The Moravian provincial code as an official collection of law monarchy was established after core constitutional changes in 1848. Provincial codes still form part of current legal system of the Czech state.
Tekst dotyczy problematyki formalizmu w stosowaniu prawa jako wieloaspektowego problemu badawczego. W niniejszym ujęciu najważniejszym punktem odniesienia jest etyka, w związku z czym autor pracy uznał za szczególnie doniosłe próbę odpowiedzi na pytanie – czy formalizm w stosowaniu prawa jest etyczny? Samo zagadnienie stosowania prawa ujęte zostało natomiast w dwóch koncepcjach – jako faktyczne przeżycia urzędników pełniących rolę organu administracji publicznej, jak i teoretycznego modelu tego zjawiska. Przy czym za dominującą uznano problematykę przeżyć podmiotów konstytuujących organ stosowania prawa. W tym też obszarze na przykładzie konkretnych regulacji prawnych z zakresu ochrony środowiska przedstawiono problematykę formalizmu i skutki, do których formalizm może prowadzić. Konkluzje pracy prowadzą do wniosku, że postawa formalistyczna opiera się na braku dbałości o tekst prawny, a zatem niestaranności w procesie odtwarzania woli nadawcy komunikatu prawnego. Działanie takie przedstawione jest jako nieetyczne, mogące powodować nieuzasadnione aksjologią danej regulacji prawnej negatywne skutki w życiu jednostki, będącej stroną postępowania.

This paper discusses formalism, a multi-faceted and problematic research topic when applied to law. The most important point of reference in the presented point of view is ethics. That is why the author emphasizes the importance of asking whether formalism is an ethical behaviour in the context of applying the law. The application of law is presented using the following two conceptions: as a behavior of officials, acting as public administration authorities, and as a theoretical model of this phenomenon. This paper is mostly about the first conception: the behaviour of officials and authorities. The problem of formalism and the effects it can lead to are discussed on the basis of specific laws and regulations concerning environmental protection. Research shows that formalism is based on lack of care for the integrity of the legal text and lack of officials’ consistency in recreating the intention of the lawmaker. This kind of activity is presented as unethical, as it may cause unjustified, negative effects in the life of the individual who is a party to the proceedings.
The article provides a philosophical and legal analysis of the category of equity in the jurisprudence of Polish courts. The author distinguishes two main ways of invoking equity by courts: 1) indirect − by applying a provision containing a general clause indicating equity or other values, and 2) direct − by voluntarily invoking equity under the discretionary power of a judge. The author presents examples from Polish jurisprudence showing why courts rely on equity on their own initiative. An appeal to equity may confirm the results of the performed interpretation, or it may oppose them. Courts use the argument of equity also when justifying partial decisions that are crucial for making a final decision, and even with less binding decisions, such as demands for a change in the law. At the end, conclusions are formulated regarding the understanding of equity a casu ad casum and the going beyond the framework outlined by the legislator in this respect. The author concludes that in many cases the court gives meaning to equity only at the stage of applying the law, during the process of interpreting and selecting arguments for the purposes of a judgment. Moreover, it is concluded that courts often refer to equity without explaining this concept or justifying its application. Therefore, one may be tempted to conclude that it is impossible to avoid even a small dose of subjectivism when invoking equity.

Przedmiotem artykułu jest filozoficzno-prawna analiza kategorii słuszności w orzecznictwie polskich sądów. Autorka wyróżnia dwa główne sposoby powoływania się na słuszność przez sądy: 1) pośredni – przez zastosowanie przepisu zawierającego klauzulę generalną wskazującą na słuszność lub na inne wartości oraz 2) bezpośredni – wskutek dobrowolnego powołania się na słuszność w ramach dyskrecjonalnej władzy sędziego. Autorka przedstawia przykłady z orzecznictwa polskiego pokazujące, w jakim celu sądy powołują się na słuszność z własnej inicjatywy. Odwołanie do słuszności może zarówno potwierdzać rezultaty przeprowadzonej wykładni, jak i się im sprzeciwiać. Sądy wykorzystują argument ze słuszności także w uzasadnieniu cząstkowych decyzji kluczowych dla podjęcia ostatecznego rozstrzygnięcia, a nawet przy mniej wiążących ustaleniach (jak np. postulatach za zmianą prawa). W zakończeniu sformułowane są wnioski dotyczące rozumienia słuszności a casu ad casum oraz wykraczaniu w tym względzie praktyki orzeczniczej poza ramy nakreślone przez ustawodawcę. Autorka formułuje wniosek, że w wielu przypadkach sąd nadaje znaczenie słuszności dopiero na etapie stosowania prawa, podczas procesu interpretacji i dobierania argumentów na potrzeby orzeczenia. Ponadto wyprowadza konkluzję, że sądy często odwołują się do słuszności z pominięciem wyjaśnienia tego pojęcia czy uzasadnienia jego zastosowania. W związku z tym, można pokusić się o refleksję, że niemożliwe jest uniknięcie choć niewielkiej dozy subiektywizmu przy odwołaniu się do słuszności.
W artykule zestawiono i porównano w sposób syntetyczny kontekst terminu „prawda” w kilku najważniejszych tekstach prawa stanowionego, a mianowicie w kodeksie cywilnym, karnym oraz kodeksie postępowania administracyjnego. Opracowanie z założenia ma na celu analizę terminu „prawda” oraz zweryfikowanie hipotezy zakładającej, że nie możliwe jest zrekonstruowanie uniwersalnej definicji legalnej prawdy. W opracowaniu skupiono się przede wszystkim na tym, co pod pojęciem analizowanego terminu rozumiał prawodawca. Z analizy pojęcia „prawda” wysnuto konkluzję, że nie da się stworzyć jednolitej, uniwersalnej definicji legalnej prawdy i nie ma takiej potrzeby dla praktyki prawa.

The paper is not a philosophical digression about the place and importance of truth in the law; rather, it tries to build a synthetic summary and comparison of contexts of the term „truth” in several major texts of statutory law – namely the civil code, criminal code and the code of administrative conduct. The paper analyses the term „truth”. An analysis of the concept of „truth” verifies the hypothesis that it is not possible to reconstruct a universal legal definition of truth ‒ and indeed there is no need for one in the practice of law.
The application of law is typically associated with the resolution of legal cases by courts and other public authorities, which are empowered by law to authoritatively hear and decide disputes and legal matters of various kinds. From a methodological point of view, the application of law is most often associated either with a logical-deductive procedure in the form of subsumption or with the application of rational argumentation in the form of the proportionality test. My intention will be to delineate not only the nature and differences of these two procedures, but also to examine the common features that can be attributed to them under certain conditions.

Aplikace práva je typicky spojována s řešením právních případů ze strany soudů a jiných orgánů veřejné moci, které jsou zákonem zmocněny k autoritativnímu projednávání a rozhodování sporů a právních věcí různého druhu. Z metodologického hlediska je poté aplikace práva nejčastěji spojována buďto s logicko-deduktivním postupem v podobě subsumpce, nebo s uplatňováním racionální argumentace v podobě testu proporcionality. Mým záměrem bude vymezit nejen podstatu a odlišnosti obou těchto postupů, ale také zkoumat společné znaky, které jim mohou být za určitých podmínek připisovány.
On 3 April 2018, a new law on the Supreme Court went into force, introducing a new institution — an extraordinary complaint. According to the intention of its authors, the construction of extraordinary complaint emphasises the need for the courts to respect constitutional principles and constitutionally protected freedoms, as well as human and civil rights. Not referring here to the aims, needs and anticipated effects of the functioning of this instrument in the legal system of Poland — taking into account the shape of the extraordinary complaint adopted by the legislator — it should be regarded as complementing the constitutional complaint (at least in the field of civil and criminal law) and an instrument to increase the effectiveness of protection of constitutional freedoms and individual rights. It is necessary to wait for the assessment of the introduction of this measure into the Polish legal system. At the same time, one cannot lose sight of fears and doubts raised against this instrument in the course of legislative procedure. However, if the extraordinary complaint supplements the constitutional complaint in those areas where the latter — due to its legal or practical limitations — is not effective, introduction of the same or similar institution into administrative proceedings shall be considered.
In the Article I attempted to discuss and describe petitio principii in the sphere of formulating and proposing arguments in the actual practice of law. First, I discussed a basic – from a historical perspective and also its frequency of usage – conception of petitio principii. Then, received in such way data (i. e. ratio propria of the name 'petitio principii'; in other words the name by means of we describe some fallacy in demonstration) were brought face to face with a conception of an argument, namely with the information on its function and structure. This operation provided a form of petitio principii that – in regards to general and abstractive character – can be used in any discussion. The final stage of the considerations concentrated on specification of such general and abstractive conception of petitio principii by introducing essential aspects of a persuasion existing in legal practice.

W rozważaniach zawartych w artykule podjąłem próbę określenia pojęcia petitio principii jako błędu swoistego dla sfery argumentacji prawniczej. Wpierw scharakteryzowałem jak – z perspekty-wy historycznej i zarazem w kontekście częstotliwości używania wyrażenia 'petitio principii' – przede wszystkim jest rozumiane petitio principii. Następnie dane te (czyli ratio propria nazwy 'petitio principii', za pomocą którego rzeczony termin służy do oznaczania pewnego rodzaju błędu w dowodzeniu) skonfrontowałem z pojęciem argumentu (tj. wypowiedzi argumentacyjnej), miano-wicie z informacjami o strukturze argumentu i jego funkcji. Otrzymaną w ten sposób koncepcję petitio principii, którą – ze względu na jej ogólny i abstrakcyjny charakter – odnieść równie dobrze można do każdej odmiany argumentacji, dookreśliłem poprzez zestawienie jej z istotowymi i zarazem swoistymi właściwościami przekonywania, jakie istnieją w praktyce prawniczej.
Article presents three analytical perspectives of the problem of closing legal argumentation against the background of the central interpretative assumptions of two leading Polish theories of interpretation, i.e. the clarificative and derivational concept. Author presents thesis that the ability of operative interpretation to regulate social relations is, inter alia, the resultant of conclusiveness of a given interpretative paradigm and the cultural context in which it is embedded. Regardless of the validation of the result of interpretation in the legal discourse, i.e. in the environment of professionals, it is possible that the directives of interpretation, which constitute a cultural artifact, are not fully compatible with the ideological and axiological assumptions of the legal and political culture of a given society, constituting a counter-productive element of that culture.

Artykuł przedstawia trzy perspektywy analityczne problemu zamknięcia argumentacji prawniczej na tle centralnych założeń interpretacyjnych dwóch wiodących polskich teorii wykładni, tj. koncepcji klaryfikacyjnej oraz derywacyjnej. Autor prezentuje tezę, że zdolność wykładni operatywnej do regulacji stosunków społecznych jest m.in. wypadkową konkluzywności danego paradygmatu wykładni oraz kontekstu kulturowego, w jakim został osadzony. Niezależnie od uprawomocnienia wyniku interpretacji w dyskursie prawniczym, tj. w środowisku profesjonalistów, możliwa jest sytuacja, gdy dyrektywy wykładni, które stanowią artefakt kulturowy, nie są w pełni kompatybilne z ideologicznymi oraz aksjologicznymi założeniami kultury prawnej i politycznej danego społeczeństwa, stanowiąc niejako kontrproduktywny element tejże kultury.
It is not an easy task to resolve intertemporal problems. This publication is an attempt to create a theory of solving such concerns, accompanying any changes in legal system, as quickly and correctly. as possible. The author focuses on regulations belonging to the contract law. The starting point of this article was an analysis of transitional provisions contained in amendments to Civil Code and in the introductory regulations of the Civil Code. This procedure leads up to a method of managing intertemporal conflicts between undergone significant changes of the legal system which is used by the legislature itself. Considerations begin with an introduction to the issues of the private intertemporal law by a brief characterization of intertemporal law basic rules approved by literature and jurisdiction. Then, the basic principles of the intertemporal law on the basis of the introductory regulations of the Civil Code have been discussed. At the end of this publication a theory of resolving intertemporal conflicts based on law of contract, which corresponds to the nature of obligations has been indicated.
The notion and theories on legal transplants and – more broadly – legal transplantation have been an object of interest in comparative law in the world since the 70s., especially in the framework of research on mixed legal systems. The theories of legal transplants remain rather unknown to the Polish researchers. And yet they may constitute a useful tool of analysis of contemporary transformations of legal systems, stemming from globalization. The article is aimed at acquainting Polish readers with theories on mixed legal systems and legal transplants and explaining briefly in what way legal transplants contribute to the hybridization of legal systems in the world.
A lawyer’s conversation with a client is discourse of special character including elements of a legal discourse. One of the parties in this discourse (client) speaks about facts and the other party (lawyer) provides information about law. The content, form as well as effectiveness of the legal argumentation which a lawyer presents in such a situation depends on a number of factors in terms of both the subject matter and the person concerned. This argumentation is characterised by lack of formalisation, however, it has certain limitations of legal, pragmatic and ethical nature. It precedes and to some extent prepares the argumentation which will be presented in the process of law application.
Autor podejmuje temat blisko związany z aksjologią prawa karnego, ukazując w zarysie historycznym próby ustawowego ograniczenia orzekania przez sądy kar pozbawienia wolności z warunkowym zawieszeniem wykonania. Tego rodzaju proces ma już ugruntowaną praktykę w polskim prawie karnym, stąd spoj- rzenie na obecne modyfikacje kodeksu karnego zuwzględnieniem wcześniejszych instrumentów służących minimalizowaniu probacji znacząco poszerza ocenę zasadności i skuteczności zmian. W konkluzji postawiono prognozę, że oczekiwana przez ustawodawcę reakcja w zakresie zmiany rodzajów orzekanych sankcji mimo wszystko może jednak nie nastąpić.

The author takes the issue closely related to the axiology of penal code, showing a historic outline of all the statutory attempts taken to limit the execution of imprisonment penalty in a conditional mode. The process of limiting the practice is well established in Polish penalty system, thus looking at modern mod-ifications of the penal process in relation to the previous regulations significantly increases the evaluation of the need and effectiveness of introducing the changes. In the conclusion a prognosis has been made that the reaction expected by the legislator in terms of the change of sentences may not occur.
Celem artykułu jest próba wykazania, że przyczyną kryzysu inkluzywnego rozwoju społeczeństwa obywatelskiego w Polsce jest to, że w ramach tych samych przepisów mogą zapadać odmienne decyzje przesądzające o nierówności wobec prawa i prowadzące do naruszenia standardów i praw człowieka, utrudnienia udziału w życiu społecznym, gospodarczym. W naukach prawnych niemal nie podejmuje się problematyki wypracowania kryteriów rozstrzygania wątpliwości dotyczących treści prawa, a nie są one przedmiotem regulacji prawnej i mogą powstać jako prawo tylko spontanicznie. W odniesieniu do spontanicznego powstawania prawa praktycznie nie są realizowane badania naukowe, co utrudnia ustalenie, jakie dokładnie obowiązują reguły, zasady, wskazówki wykładni i stosowania prawa. Nie są więc w ten sposób gwarantowane podstawowe warunki rozwoju inkluzywnego. Wyjaśnienie tego problemu jest swoistą nowością z punktu widzenia przyczyn kryzysu danego rozwoju i przyczyn kryzysu systemu prawnego. W artykule wykorzystano metodę analizy lingwistycznej i ekonomicznej analizy prawa.

This article is trying to show that the cause of the crisis of inclusive development of civil society in Poland is that there are different decisions being rendered based on the same regulations, which prejudge inequality before the law, lead to violation of human rights and standards, and impede participation in social and economic life. In legal sciences, the issue of elaborating criteria for resolving doubts about the content of the law is almost never undertaken, and they are not subject to legal regulation and can only be established spontaneously as a law. With regard to the spontaneous creation of law, scientific research is practically not carried out, which makes it difficult to determine exactly what rules, principles, guidelines for interpretation and application of law apply. Because of the foregoing, the basic conditions for inclusive development are not guaranteed. The explanation of this problem is a novelty from the point of view of the causes of the crisis of a given development and causes of the crisis of the legal system. The article uses the method of linguistic analysis and economic analysis of law.
Przestrzeganie prawa to bardziej kwestia internalizacji norm moralnych, religijnych i obyczajowych, zgodnych z normami prawnymi, niż zasługa obowiązywania tych ostatnich. Podobnie było również w historii, z tym że dostęp do prawa stanowionego był bardzo ograniczony. Znikomy wpływ aktywności legislacyjnej organów władzy na zachowanie obywateli prowokuje do pytania o sens ogromnej pracy legislacyjnej, której efekty pozostają poza zakresem percepcji adresatów norm prawnych. Istnieje pilna potrzeba uwzględniania potencjalnej skuteczności prawa w procesie stanowienia prawa. Kardynalnym błędem prawodawcy jest złudzenie możliwości zmiany każdej dziedziny życia przez uchwalenie kolejnej ustawy lub jej nowelizację.W rzeczywistości oddziaływanie norm prawnych jest skromniejsze, niż wydaje się to prawodawcy. Prawda ta bardzo trudno przebija się do świadomości osób piastujących najważniejsze funkcje w państwie i w niewielkim stopniu wpływa na racjonalizację procesu tworzenia prawa, które powinno być traktowane jako element stabilizacji życia społecznego, a nie jego permanentnej zmiany. Wiara we wszechmoc prawa nie ma podstaw. Konieczne jest pogodzenie się z prawdą, iż skuteczność prawa jest ograniczona. Naturalne bariery efektywności prawa oraz dążenie człowieka do maksymalizacji zysku, przyjemności, szczęścia, powodują nadprodukcję przepisów prawnych, które nie zawsze pozwalają na osiągnięcie oczekiwanych przez prawodawców rezultatów.

Observance of the law depends more on internalization of moral and religious norms consistent with legal norms than it is a merit of binding force of the law. There is an urgent necessity to take into account the potential law efectiveness in the law making process. The legislator's glaring error is the illusion of a possibility of changing each life sphere by passage next act or its amendment. In reality the law influence is more inconspicuous than it seems to the legislator. It is necessary to reconcile that law efectiveness is limited. The natural barriers of law efectiveness and human anxiety to maximization of profit, pleasure and happiness cause the overproduction of legal rules, which not always let to achieve the legislator's expected results.
The paper analyses the institutional epistemology of the process of application of law in Poland. The concept of institutional epistemology is understood as a set of features, epistemic aims, values, and practices, which are intrinsic to the institutional structures. Two aspects of such an institutional epistemology are covered: the positivistic model of cognition and the concept of truth embedded in the judicial practices and legal norms. The philosophical and historical origins of these features are outlined. It is argued that they should be considered relics of previous socio-political system and obsolete philosophies of science, and, in consequence, they do not meet the standards of the constitutional principle of the democratic rule-of-law state (Polish demokratyczne państwo prawne). Evolution towards more deliberative forms of institutional epistemology is advocated.

Artykuł analizuje epistemologię instytucjonalną procesu stosowania prawa w Polsce. Jest ona rozumiana jako zestaw cech, celów poznawczych, wartości, praktyk wpisanych w strukturę instytucjonalną. Analizowane są dwie podstawowe cechy tej epistemologii: pozytywistyczny model poznania oraz koncepcja prawdy. W artykule wskazuję jak te cechy zostały ukształtowane i dlaczego współcześnie należy uznać je za ograniczające. Argumentuję, że legitymacja procesów decyzyjnych opierających się na tych założeniach jest z punktu widzenia zasady demokratycznego państwa prawnego niezadowalająca, i dlatego cechy te powinny ewoluować w kierunku deliberatywnym.
