The article examines analogia legis, the application of a legal rule to the facts of a similar but not by law regulated case. It starts with a discussion of the concept of analogia legis, followed by a look at conditions that enable the use of this type of reasoning and an examination of legal loopholes in order to determine the similarity between the facts not covered by normalisation and an actual state regulated by the law. The circumstances that would preclude the application of analogia legis are identified. Finally, other ways of drawing inferences from the rules of law beyond analogia legis are outlined.
Sztuczna inteligencja rozwija się dynamicznie i jest coraz bardziej obecna w dyskursie publicznym, stąd powszechniejsze stają się pytania o jej potencjalne zastosowanie w dziedzinie prawa. Celem artykułu jest rozważenie, czy AI jest w stanie usprawnić proces stosowania prawa, a mianowicie ustalanie hipotez struktury głębokiej nauki prawa. Przy tym za problem badawczy uznano kwestię możliwości operacyjnych AI, a więc tego, czy sztuczna inteligencja jest w stanie adekwatnie odtwarzać założenie o racjonalnym prawodawcy. Aby rozważyć powyższe zagadnienie, w pierwszej kolejności przeanalizowano dyskusję na temat definicji sztucznej inteligencji oraz metodologiczne kwestie nauki prawa. Wreszcie w kwestii założenia o racjonalnym prawodawcy odtworzono warunki związane z tym konstruktem i zastanowiono się, czy mógłby powstać system adaptujący to założenie.

Artificial intelligence is developing rapidly and is increasingly present in public discourse, hence ques-tions about its potential application in the legal field are becoming more common. The aim of this thesis is to consider whether AI can improve the process of applying the law, namely establishing a hypothesis for the deep structure of legal science. The research problem is to establish AI’s operational capabilities – if AI can adequately reproduce assumption of a rational legislator. In order to consider this, the discussion on the AI definition and methodological issues of legal science were examined. Finally, the conditions of assumption of a rational legisla-tor were reconstructed and it was considered whether a system adapting this assumption could be developed.
Artykuł dostrzega sposób postępowania Trybunału Konstytucyjnego polegający na zastąpieniu własnego procesu interpretacji badanych przepisów poprzez przyjęcie wykładni innego sądu. Celem tekstu jest więc opracowanie teoretyczne analizowanych orzeczeń. W tekście wykorzystane zostały koncepcje wypracowane w Poznańskiej Szkole Teorii Prawa, tj. rozróżnienie na przepis i normę prawną, jak również rozróżnienie na wykładnię w sensie pragmatycznym oraz apragmatycznym. Rolę metateorii służącej do analizy postępowania Trybunału pełni także pragmatyzm analityczny Roberta B. Brandoma. Pragmatyzm analityczny pozwala na stwierdzenie, że działania Trybunału wskazują (1) co należy zrobić (w ramach praktyki prawnej), aby słownictwo aktów normatywnych coś znaczyło (PS-wystarczalność) i (2) jakie słownictwo jest wystarczające do scharakteryzowania tych praktyk (SP-wystarczalność). Praktyka stosowania prawa daje się opisać przy wykorzystaniu koncepcji TOTE (akronim angielskiego wyrażenia Test-Operation-Test-Exit). Cykle tej aktywności mają otwarte zakończenia (ang. open-ended). Tym samym, w swojej dalszej praktyce, Trybunał może wskazać kolejne umiejętności/praktyki wystarczające do tego, aby słownictwo aktów normatywnych coś znaczyło.

The article examines the way in which the Polish Constitutional Tribunal operates, which involves replacing its own process of interpreting the provisions under review by accepting the interpretation of another court. The objective of the article is to provide a theoretical account of the Polish Constitutional Tribunal’s conduct to the readers. Therefore, the concepts developed at the Poznan School of Theory of Law are used, namely the distinction between a provision of the law and a legal norm, as well as a distinction between pragmatic and nonpragmatic interpretation. The role of the metatheory used to analyse the Tribunal’s conduct is also played by Robert B. Brandom’s analytic pragmatism. Analytic pragmatism allows the conclusion to be drawn that, through its activity, the Tribunal indicates 1) what an agent must do (within the legal practice) for the vocabulary of normative acts to mean something (PV-sufficiency), and 2) what vocabulary is sufficient to define those practices (VP-sufficiency). The practice of applying the law can be described with the use of the TOTE concept (Test-Operation-Test-Exit). In this case TOTE cycles are open-ended. Therefore, in its further practice, the Tribunal might indicate further practices-or-abilities which are sufficient for the vocabulary of normative acts to mean something.
