The article comprises the overview of the essential legal, administrative and financial means that the EU has at its disposal in case of rapid influx of immigrants, as well as a selection of major obstacles to the use of these tools, based on observation of the activities of the EU and its member states taken up to deal with the aforementioned situation which took place in 2015. Using the abovementioned observation and an analysis of relevant documents, it is argued that the refugee crisis of 2015 has revealed the necessity of a profound institutionalisation of the European immigration policy as the most effective way to overcome difficulties in response to such situations. The analysis leads also to the conclusion that the EU is caught in a dilemma of either suspending the Dublin system in crisis situations or creating a new system of intensive support for border member states. Artykuł zawiera przegląd najistotniejszych prawnych, administracyjno-technicznych i finansowych środków, jakimi dysponuje Unia Europejska na wypadek gwałtownego zwiększenia się napływu imigrantów, a także diagnozę dotyczącą najważniejszych przeszkód w korzystaniu z tych narzędzi, opartą na podstawie obserwacji działań UE i jej państw członkowskich, podejmowanych w związku z wystąpieniem wspomnianej sytuacji w 2015 r. Korzystając z tego przeglądu i analizy odnośnych dokumentów, autor dowodzi, że kryzys migracyjny z 2015 r. ujawnił potrzebę głębokiej instytucjonalizacji wspólnej polityki imigracyjnej UE. Dokonana przez niego analiza prowadzi również do wniosku, że Unia Europejska stoi przed dylematem między zawieszaniem mechanizmu dublińskiego w momentach gwałtownego napływu uchodźców a stworzeniem systemu efektywnego wsparcia dla państw znajdujących się na granicach zewnętrznych UE.

In view of the recent reform of the area of freedom, security and justice in the European Union as it is codifed in the Treaty of Lisbon, passed on 13 December 2007, this paper analyzes the changes put forward by the new legislation. Beginning with the system of the Treaty regulations, it goes on to provide a general outline of the changes in the six policies within this area: visas, asylum, immigration, judicial cooperation in civil matters, judicial cooperation in criminal matters and police cooperation.

The Amsterdam Treaty has established the Area of Freedom, Security and Justice (AFSJ). Since then, it is an example of a policy-making area creating its way quickly and comprehensively. However, in this paper the main dilemma is to what extent the Schengen development has modified the framework of AFSJ and how it adapts in this policy while being an example of enhanced cooperation and differentiated integration model. Developments in this area are part of a realisation that European states need to act together to better face new challenges to peace and internal security, while ensuring respect for democracy and human rights. It is important to add, that cooperation in the Area of Freedom Security and Justice has been driven by forces different from that seen in other policy areas.

Current legislative activity of the European Union performed under Title V, Chapter 4 of the Treaty on the Functioning of the European Union: “Judicial cooperation in criminal matters” is part of a wider process of internationalisation of criminal law. It shows a paradigm shift of this branch of law, which until now has, fi rst and foremost, been a product of national legal systems. The article discusses selected issues concerning the regulation of criminal prosecution under European Union law. Due to the fact that the present shape of this regulation is the result of a long process of numerous legislative activities as well as various non-legislative forms of international cooperation, the article is not limited to the discussion of the current state of the criminal prosecution in the EU, but takes into account the historical emergence of various institutions, both before and after the establishment of the European Union. Its fi rst part presents the historical development of instruments designed to cope with crime, which the European Community and then the European Union had at their disposal. This part has two objectives: to describe the diffi culties encountered when the fi rst attempts to coordinate the fi ght against crime at the European level were undertaken and to show the signifi cance of the progress that has been made in this area in recent years. After that, selected issues concerning the harmonisation of rules governing the procedural rights of suspects and defendants in criminal proceedings are discussed. The issue of minimum standards relating to penalties is also raised. The concluding part of the article assesses, whether the path of internationalization of criminal law chosen by the Member States in the post-Lisbon reality is justifi ed.

Ensuring internal security is one of the core objectives of European integration in the context of the establishment of an area of freedom, security and justice of the European Union (E.U.). The aim of the internal security policy of the E.U. is to support Member States with regard to the maintenance of law and order and the safeguarding of internal security. In the last 20 years in the area of internal security of the E.U. many important initiatives, political agendas and legal instruments at the E.U. level have arisen. This article aims to show the development of the internal security policy of the E.U., its most important guidelines and the challenges in the coming years.

Zapewnienie bezpieczeństwa wewnętrznego jest jednym z podstawowych celów integracji europejskiej w kontekście tworzenia na terytorium Unii Europejskiej przestrzeni wolności, bezpieczeństwa i sprawiedliwości. Celem polityki bezpieczeństwa wewnętrznego UE jest wspieranie państw członkowskich w zakresie utrzymania porządku publicznego i ochrony bezpieczeństwa wewnętrznego. W ostatnich 20 latach w obszarze bezpieczeństwa wewnętrznego UE odnotowano duże zmiany, zrodziło się wiele inicjatyw, programów politycznych oraz instrumentów prawnych na szczeblu Unii. Celem artykułu jest ukazanie rozwoju polityki bezpieczeństwa wewnętrznego UE, jej najważniejszych założeń i wyzwań na nadchodzące lata.
