Niniejszy artykuł poświęcono niezwykle ważnej problematyce, a mianowicie naturze prawnej bankowego tytułu egzekucyjnego. Analizie poddano zarówno znamiona czynności procesowej, jak i czynności materialnoprawnej. W efekcie poczynionych rozważań uznano, że nie jest możliwe zakwalifikowanie bankowego tytułu egzekucyjnego do żadnej z kategorii znanych prawu cywilnemu, czy też prawu procesowemu cywilnemu. Rozważania na temat natury bankowego tytułu egzekucyjnego doprowadziły do konkluzji, że wystawienie tego tytułu egzekucyjnego jest czynnością służącą zaspokojeniu roszczeń wierzyciela, jakim jest bank.

This article refers to a very important issue, namely the legal nature of a bank enforcement title. The analysis concerns both the characteristics of legal act process as well as the substantive act. As a result of these considerations, the author assumes that it is impossible to qualify the bank enforcement title to any of the categories known to the civil law or procedural civil law. The considerations about the nature of bank enforcement title lead to the conclusion that the issue of bank enforcement title is an act serving to satisfy of the claims of the creditor, which is a bank.
