Best Practices in Real Estate Cross-border Transactions

The article presents reflections on the best practices in real estate cross border transactions.Transactions on real estate markets have several aspects that make them highly complex, mostly due to their individual nature – each property is unique in terms of its location, structure and history. Cross-border transactions on the real estate market are becoming increasingly popular as the world becomes more globalized. The growing volume of this type of transaction presents a challenge for the modern real estate lawyer. It is impossible to create an exhaustive guide setting out all the hazards occurring in such transactions. This article addresses this difficult challenge by indicating the most important of them.It is essential and extremely helpful to enter into cooperation with a local counsel who will help us to explain the local specificity and who will take the legal differences into account. In addition, other helpful tools, such as a legal due diligence report or a title insurance Policy, should be carefully considered. One cannot forget about the importance of the local culture and customs, which may prove decisive at the crucial moment of the transaction. Finally, to be effective in working with cross-border clients, lawyers must have a good understanding of how people think and make decisions, and must possess good people skills. Respect for local customs and traditions, as well as understanding the local legal system while securing clients’ interests, is the key to a successful transaction.

The continuously growing importance of projects in the activities of the organization enforces the constant development of project management standards. Many institutions have extensive experience in the implementation of management tools. Very often, however, they are fragmentary, which means it is impossible to use them with full efficiency. Integration management is an area whose aim is to organize these fragmentary issues and their coordination. The author completed studies of nearly 400 organizations. The main purpose was to determine the approach to integration management in organizations and define the factors that can shape the intensity of the use of specific solutions. The research results helped to answer the research questions and formulate the most important areas for future research.

The aim of the paper is to explain the cooperation and processes realized within the industrial networks based on the principles of industrial symbiosis in Denmark, Russia and Slovakia. The identified examples can be characterized as best practices in the field of industrial symbiosis that influences importantly the development of regions, where they are localized. Industrial symbiosis as a voluntary cooperation of enterprises with the aim to optimize production costs and improve the environment could influence positively the development of areas where the companies are operating. The paper includes three examples of ‘best practices’ from Denmark, Russia and Slovakia. The examples refer the wide range of benefits that this kind of cooperation brings.

According to the OECD, the city of Malmö is ranked on the fourth position globally in patent applications per 10,000 inhabitants. Presenting this ranking list, Forbes magazine described Malmö as young and diverse. The two other largest Swedish cities, Stockholm and Gothenburg, also scored high – on the 8th and 12th places, respectively. Regarding the presented facts the main aim of the article is to describe both Polish and Swedish systems of supporting new business, crucial from the innovation-creation perspective. These two countries were chosen basing on the fact, that Sweden is one of the most innovative countries globally and it’s start-up supporting system could be an inspiring benchmark for Poland, which is a maternity country for the authoress. Both parts are based on the authoress’ observations as well as direct talks with entrepreneurs and start-up supporting organizations. As an added value of this comparison, the concluding part of the article presents a list of best practices and suggestions for Polish start-ups.

City logistics and mass sporting events logistics are modern concepts using good practices to achieve established aims. Both issues are connected by the set of common features, which allow using the best practices modifying the processes of city management or mass event management. The aim of this article is to analyze city logistics from the angle of best practices possibilities – solutions applied by the organization of mass sporting events. The object of the study represents a system of city logistics and logistics system of sporting events, while used research methods were: the analyzes of literature, critical analysis of documents prepared by companies responsibilities for the preparation of events and own observations. Common points and examples of good practices of city logistics presented in table 1 and 2 confirm a hypothesis about a correlation between concepts. Using solutions which are commonly innovative in city management can significantly contribute to the facilitation of goods, persons and information flows and to decrease the negative impact of human activity on natural environmet.

The article presents the educational aspects of the music education in everyday preschool activities. The main idea is to widely describe the role of the music activities dedicated to the youngest. Based on the literature, I tried to connect the theory with the examples of everyday teaching practice. Each part was supported with free and accessible sources of educational materials. The role of the catholic preschool teacher was stressed as well, which is crucial for the future of Polish music education.

Finland is at the top in different rankings concerning education. In March 2018 the author of the article had a chance to participate in "Benchmarking Finnish Education System" course in Helsinki and observe and analyze Finnish best practices. In the article, the author tries to describe what she discovered about the educational success of Finnish school and answered the question whether it is possible to apply these elements to Polish educational reality. Writing the article, the author used the materials distributed during the course, either by the organizer or his guests. While quoting statistics, the author mainly referred to online sources, as they are usually regularly updated. The conclusions drawn are the results of the author's observations, as well as the analysis of the reference sources. The author discovered that the critical factors in Finnish educational success are: student and teacher's autonomy, free access to education, equality, no dead ends, and tailor-made school curricula. In the final part of the article, the author writes about the weaknesses of the Finnish system. In conclusion, the author wonders whether it is possible to integrate Finnish best practices into Polish schools.

The article presents with thoughts on the ontological status of good practices, their criteria and the role they play in social policy. The authors describe good practices in three dimensions: as an action aiming at solving a particular problem; as an element of knowledge produced by the organisation; as communication produced by the organisation; The authors review definitions of good practices and their criteria on the basis of secondary sources. They propose to select general and specific criteria of good practices. Specific criteria of good practices are discussed using the example of actions towards social cohesion, taken within the framework of local and regional public policies towards the elderly people. Conceptualizing social cohesion is done with reference to the concept of society for all ages. The authors also propose their own scheme for describing good practices that is meant to ensure their dissemination. The article is concluded with thoughts on the role of good practices in social policy on the micro- and macro-scale.

Artykuł zawiera rozważania na temat ontologicznego statusu dobrych praktyk, ich kryteriów oraz roli w polityce społecznej. Autorki charakteryzują dobre praktyki w trzech wymiarach: jako działanie służące rozwiązaniu jakiegoś problemu; jako element wiedzy wytwarzanej przez organizację; jako komunikat wytwarzany przez organizację. Na podstawie zastanych źródeł autorki dokonują przeglądu definicji dobrych praktyk i ich kryteriów. Proponują wyodrębnienie ogólnych i specyficznych kryteriów dobrych praktyk. Specyficzne kryteria dobrych praktyk omawiane są na przykładzie działań na rzecz spójności społecznej podejmowanych w ramach lokalnych i regionalnych polityk publicznych wobec ludzi starszych. Konceptualizacja spójności społecznej jest przeprowadzona poprzez odwołanie się do koncepcji społeczeństwa dla wszystkich grup wieku. Autorki przedstawiają także własną propozycję schematu opisu dobrych praktyk, który ma zapewnić ich upowszechnienie. Artykuł zamykają rozważania dotyczące roli dobrych praktyk w polityce społecznej – w mikro- i makroskali.

Miniona dekada to dla przedsiębiorstw czas dynamicznych zmian na światowych rynkach, rozwój globalnej konkurencji oraz poszukiwanie nowych dróg do osiągnięcia i  utrzymania przewagi konkurencyjnej. Zachodzące na zewnątrz firmy zmiany decydują o  jej przemianach wewnętrznych. W jakim kierunku podążało w  tym okresie zarządzanie zasobami ludzkimi? Celem artykułu jest analiza zmian zachodzących w  ostatnich latach w  praktyce ZZL firm funkcjonujących na polskim rynku oraz próba wskazania kierunków przyszłych przemian. W opracowaniu oparto się na danych dotyczących 5 inicjatyw z  zakresu ZZL: programu „Inwestor w  Kapitał Ludzki”, konkursu „Lider Zarządzania Zasobami Ludzkimi” oraz list najlepszych pracodawców, „Great Place to Work oraz Top Employers”.

Using weapon of mass destruction (WMD) and toxic industrial material (TIM) as a tool for crime and act of terror led to the creation of special Scientific Working Group on the Forensic Collect and Analysis of Chemical, Biological, Radiological, and Nuclear (CBRN) evidence. Investigating authorities must be well prepared to ensure that an investigation was properly investigated and offender responsible for committing this crime suffer for their actions, in accordance with the law. The main purpose of this article is to present methods collecting forensic evidence contaminated with CBRN agents.

Użycie broni masowego rażenia (BMR) oraz toksycznych środków przemysłowych (TŚP) jako narzędzi zbrodni i aktu terroru przyczyniło się do utworzenia specjalnych zespołów zajmujących się zbieraniem dowodów w atmosferze skażeń. Organy śledcze muszą być dobrze przygotowane i przedsięwziąć wszystkie niezbędne środki, by dochodzenie w sprawie zdarzenia z użyciem czynników CBRN (ang. chemical, biological, radiological, nuclear) było właściwie prowadzone, a osoby odpowiedzialne za popełnienie takiego przestępstwa poniosły odpowiedzialność za swoje czyny, zgodnie z obowiązującym prawem. Głównym celem tego artykułu jest przedstawienie sposobu pobierania materiałów skażonych czynnikami CBRN do celów dowodowych.

Within the development of management sciences, a great number of methods and tools for solving problems in the field of organization and management have been developed, which called good practices. The article presents an attempt to make a classificati on of good practices that can be used in actions undertaken by territorial units in crisis management. Authors identified key groups of good practice to support the risk management process, proposed their systematics and then assigned the various groups of practices to the detailed stages of the risk management process.

Na przestrzeni rozwoju nauk o zarządzaniu powstała ogromna liczba metod i narzędzi rozwiązywania problemów z dziedziny organizacji i zarządzania, nazywanych dobrymi praktykami. W artykule przedstawiono próbę systematyki dobrych praktyk, możliwych do wykorzystania w działaniach podejmowanych przez jednostki terytorialne w ramach zarządzania kryzysowego. Autorki zidentyfikowały kluczowe grupy dobrych praktyk wspomagających proces zarządzania ryzykiem, zaproponowały ich systematykę, a następnie przyporządkowały poszczególne grupy praktyk do szczegółowych etapów procesu zarządzania ryzykiem.

W artykule dokonano analizy dobrych praktyk Uniwersytetu Jagiellońskiego w Krakowie w zakresie zapewniania bezpieczeństwa i przeciwdziałania dyskryminacji studentów i doktorantów. Krótka analiza przepisów poprzedziła omówienie rozwiązań instytucjonalnych służących zgłaszaniu problemów w tej sferze, jak również wsparciu psychologicznemu członków społeczności akademickiej. Omówiono wyniki cyklicznych badań poczucia bezpieczeństwa szczególną uwagę zwracając na zjawisko dyskryminacji oraz wybrane przykłady działań edukacyjnych i promocyjnych podkreślając rolę udziału w międzynarodowej kampanii antyprzemocowej.

The article is concerned with an analysis of best practices undertaken by the Jagiellonian University in Kraków in terms of providing undergraduate students and PhD students with safety, security and anti-discrimination. A brief analysis of law and regulations preceded a discussion of the institutional arrangements for reporting such problems, as well as psychological support for members of the academic community. The results of the cyclic research project on sense of security with special attention to the phenomenon of discrimination were presented. The article contains examples of educational and promotional activities highlighting the role of participation in international anti-violence campaign.
