Prawo pomocy publicznej określa zasady udziału państwa w działalności przedsię-biorców. Kwestie te uregulowane są w art. 107- 109 TFUE. Celem takim może być przykładowo: rozwój małych i średnich przedsiębiorstw, zmniejszanie różnic gospodarczych między regionami kraju, równoważenie rynku w tzw. wrażliwych sektorach gospodarki (podatnych na wahania koniunktury), restrukturyzacja takich sektorów np. przemysł hutniczy, a także skierowana do przedsiębiorstw znajdujących się w trudnej sytuacji finansowej. Przeprowadzenie reformy ogólnego rozporządzenia w sprawie wyłączeń grupowych może sprawić, że poprzez rozszerzenie zakresu roz-porządzenia o nowe środki i podniesienie progów powodujących obowiązek zgłoszenia w przypadkach indywidualnych, osiągnięty zostanie cel przeglądu zasad pomocy państwa, jakim jest uproszczenie. Trwają prace służb Komisji nad niektórymi kwestiami; zostanie zaprezentowanych kilka wariantów, które będą też przedmiotem pierwszych konsultacji publicznych z państwami członkowski mających na celu poznanie opinii zainteresowanych stron.

The law of public help clearly defines the rules of governmental participation in businessmen’s activities. These issues are regulated by art. 107-109 TFUE and they might include the development of small and medium firms, reducing economic differences between regions, equalizing the market in the so called sensitive sectors of economy (those subjected to economic fluctuations), restructuring such sectors as steel industry and help for businesses in a difficult financial situation. The reform of the general regulation concerning block exemptions can cause that the transparency of rules regarding governmental help will be achieved. The works of a special Board are in progress; a few options will be presented which will then be consulted with other member states in order to know the opinions of all sides.

Artykuł dotyczy stosowania wyłączeń grupowych i wyłączenia indywidualnego do systemów dystrybucji selektywnej. Autor analizuje warunki skorzystania z polskiego i europejskiego ogólnego wyłączenia grupowego dla porozumień wertykalnych oraz możliwość łączenia dystrybucji selektywnej z najpopularniejszymi ograniczeniami dodatkowymi. Autor przedstawia także metodologię stosowaną w orzecznictwie europejskim przy stosowaniu indywidualnego wyłączenia do dystrybucji selektywnej i bada relacje przesłanek wyłączenia indywidualnego do ogólnych przesłanek zakazu porozumień ograniczających konkurencję.

The article studies the application of block exemptions and individual exemption to selective distribution systems. The author examines the conditions of applying Polish and European general block exemption and the possibility of combining selective distribution with common additional restrictions. Also, the article describes the methodology used by the European courts to individually exempt selective distribution systems and examines the relation of the prerequisites of individual exemption and the Metro doctrine.
