How does globalization affect the world? Terrorism in the XXI century is a global phenomenon, most frequently encountered in developed Western countries, although it is gaining in importance in developing countries. In order to prepare for this phenomenon and to take appropriate preventive measures, necessary for accurate identification, the following actions should be carried out: tracking, mapping, recognition, re-establishment of networks and even the apprehension of the perpetrator of a crime. Unfortunately, not only citizens and law enforcement authorities but also terrorist organisations can benefit from new technological inventions. According to the author, identifying, observing and disclosing persons crossing the border who are perpetrators of terrorist crimes is becoming an increasingly difficult task, as criminals can recruit new members in several countries and the recruiter does not even have to be in the same place as the new „candidate”. In future, the fight against terrorism will not be carried out primarily on the battlefields of crisis-stricken areas, but on the borders of protected areas, with the use of computer monitors and in cooperation of intelligence services with other countries. Adequate EU legislation is needed to restrict the free movement of persons committing terrorist offences. EU countries must guarantee the security of their citizens and fight terrorism effectively.
In this research paper the author considers the problematic aspects of interaction of bodies (units) of state border protection and customs of the State Customs Service of Ukraine during the detection of signs of violations of customs rules, as well as the indentifying property that has no owner or owner unknown at border crossings. entry-exit checkpoint, in the controlled border area. At the same time, the current state of legal regulation of this issue, the main legislative developments in this area, which took place in connection with the joint order of the Ministry of Finance and the Ministry of Internal Affairs of Ukraine number 849/828, foreign approaches to cooperation between customs and border units. Based on the study, it was concluded that the issues of cooperation between state border guards and customs of the State Customs Service of Ukraine are regulated by the updated Procedure number 849/828, approved by a joint order of the Ministry of Internal Affairs and the Ministry of Finance of Ukraine. a number of powers from the administrative-operational group to draw up reports on administrative offenses, to send an act of detection, and on the property of the owner, who is unknown or as has no owner - transfer of property to the relevant department of the State Customs Service of Ukraine, to other officials of state border guards, and also extended the validity of this document not only to cases of violations of customs rules, property whose owner has no owner or whose owner is unknown, detected at checkpoints across the state border of Ukraine, but also for similar cases detected at the checkpoint of entry-exit, in the controlled border area. At the same time, the mentioned Procedure number 849/828 does not solve a number of urgent issues of such interaction, such as: insufficiently effective coordination of work of state border guards and customs of the State Customs Service of Ukraine on ensuring unity of customs and border control, impossibility to send a representative protection of the state border (units of protection of the state border) and customs of the State Customs Service of Ukraine, carrying out separate control in cases when it is necessary to carry out joint control, lack of interest in such interaction, lack of a specific list of reasons when a joint inspection should be conducted, lack of sanctions for failure to conduct a joint inspection in case of detection of goods moving in violation of customs rules and border legislation without sufficient reasons. Therefore, a solution to these problems is proposed.
Swoboda przemieszczania się jest jednym z podstawowych osiągnięć oraz efektów procesu integracji europejskiej. Korzystanie z tej wolności stało się ważnym doświadczeniem milionów Europejczyków. Zjawiska kryzysowe, związane przede wszystkim z kryzysem migracyjnym ukazały problemy instytucjonalno-prawne oraz miały wpływ na opinię publiczną. Poczucie zagrożenia i trudności polityczne i organizacyjne doprowadziły do decyzji o przywróceniu kontroli na wewnętrznych granicach w wielu miejscach UE. Jak wynika z badań ogólnopolskich, także w naszym kraju jest akceptacja takich działań. Badania przeprowadzone na pograniczu polsko-niemieckim wskazują, że także mieszkańcy tych terenów popierają takie decyzje, jednak stopień akceptacji przywracania kontroli granicznych jest tu mniejszy niż w badaniach ogólnopolskich.

Freedom of movement is one of the basic achievements and effects of the European integration process. Benefiting from this freedom has become an important experience for millions of the Europeans. Crisis phenomena, mainly related to the migration breakdown, revealed institutional and legal problems and had an impact on public opinion. The sense of threat and political and organizational difficulties led to the decision to reinstate control on the internal borders in many places in the EU. As it appears from nationwide surveys, there is also acceptance in Poland of such activities. Research conducted on the Polish-German borderland indicates that also the inhabitants of these areas support such decisions, but the degree of acceptance of the restoration of border control is lower here than in national surveys.
Celem artykułu jest wskazanie zmian jakim na przestrzeni ostatnich kilku dekad poddawane są strategie kontroli granicznych w Europie, aplikowane przez państwa (indywidualnie bądź w ramach ugrupowań takich jak Unia Europejska) w reakcji na zmieniającą się naturę granic terytorialnych i wyzwania jakim współczesne granice muszą sprostać. W pierwszej kolejności zidentyfikowano kluczowe uniwersalne uwarunkowania tych zmian, które wpływając na naturę i charakter współczesnych granic, silnie oddziałują też na stosowane strategie kontroli granicznych. Wskazano, że obecna dynamika i złożoność charakteru oraz instrumentów kontroli granicznych aplikowanych przez państwa europejskie wynikają przede wszystkim z trzech kluczowych czynników: 1/ przyspieszenia procesów globalizacyjnych i reakcji państw, na te procesy; 2/ intensyfikacji procesów integracji regionalnej (w Europie w szczególności zachodzących w ramach UE); 3/ wzrostu zagrożeń terrorystycznych dla bezpieczeństwa wewnętrznego państw oraz silnego sprzęgnięcia – w retoryce i działaniach politycznych – terroryzmu z problematyką imigracji. Czynniki te mają charakter procesualny; oddziałują na granice państw europejskich równolegle, choć z różnym stopniem intensywności w odniesieniu do poszczególnych państw czy w określonym zakresie czasowym; niekiedy się uzupełniają, a w innych okolicznościach procesy te „konkurują” ze sobą. W efekcie ich oddziaływania strategie kontroli granic mają wieloetapową strukturę i obejmującą instrumenty wykraczające poza działania kontrolne wykonywane bezpośrednio na terytorialnie zdefiniowanych granicach oraz realizowane wyłącznie przez służby kontrolne danego państwa w rzeczywistości realnej. Kontrole graniczne nie są już aktami, ale permanentnymi procesami zdeterytorializowanej kontroli prowadzonej tak w rzeczywistości realnej, jak i wirtualnej.

The aim of the article is to present changes of the border control applied by European states (especially within the European Union) over the last few decades, as their reaction to the redefinition of territorial borders and new challenges in the international order. First of all, the key determinants of these changes were identified, which influenced the nature of contemporary borders and strongly affect the applied border control strategies. The dynamic and complexity of the process are an effect of three factors: 1) the intensification of globalization and reactions of nations states to it, 2) deepening and widening of the regional integration processes (in Europe within the European Union), 3) the increase of terrorist threat (terrorism as an important treat to European security) and the linkage of terrorism with migration. All these factor are dynamic, and influence interstates borders and their functions thought their impact on particular borders are different in scope and time. As a result of their impact, border control strategies have a multi-stage structure (multiplication of controls) and encompass instruments going beyond control activities carried out directly on territorially defined borders (externalization and internalization border controls). In addition, border controls are not only carried out by border guards in physical reality, but we are witnessing the strengthening of the importance of virtual control practices through large electronic databases. Nowadays, border control is no longer a single act, but a permanent process carried out everywhere, in physical and virtual reality. We are living in the world of bordering and it is not important which border you cross, but who you are. Thus, borders are simultaneously open (debordering) for someone and closed (rebordering) for another one.
Niniejszy artykuł podejmuje problematykę kontroli mobilności i jej związku z suwerennością terytorialną państwa narodowego. Opierając się na teoretycznej analizie suwerenności terytorialnej w globalizującym się świecie, przyjęto założenie, zgodnie z którym rosnąca współzależność państw w erze transgranicznych przepływów osobowych i postindustrializacji nie jest równoznaczna z zanikiem suwerenności. Sprawia ona natomiast, że wykonywanie funkcji państwowych w dziedzinie kontroli granicznej, a zwłaszcza kontroli mobilności rozumianej jako nadzór nad transgranicznym przepływem osób, staje się coraz bardziej złożone. Wnioski wskazują, że pomimo liberalizacji przepływów ludzkich, które są cechą wyróżniającą globalizację, państwa dążą do zachowania swoich prerogatyw w dziedzinie kontroli ruchu osobowego, postrzeganej jako domena ich suwerennej władzy. Umiędzynarodowienie, ekstraterytorializacja, selektywna restrykcyjność, prywatyzacja i outsourcing mechanizmów kontroli mobilności są głównymi przejawami reakcji państw narodowych na procesy globalizacji, motywowanej chęcią utrzymania monopolu w zakresie decydowania, kto może wjechać na ich terytorium. Wymienione płaszczyzny reakcji państw narodowych na presję wywieraną na ich granice w ramach globalizującej się rzeczywistości wskazują raczej na ekspansję lub multiplikację działań państwa w wielu sferach kontroli i nadzoru, mających świadczyć o rosnącym zasięgu suwerennej władzy państwa narodowego, rozciągającej się daleko poza podlegające terytorium. Tym samym kontrola mobilności rozumiana jako nadzór nad transgranicznym przepływem osób nadal jest uznawana za jedną z najważniejszych cech sprawnie działającej władzy państwowej, rozciągającej się na podlegającym jej terytorium, a rządy narodowe dążą do maksymalizacji korzyści płynących z partycypacji w procesach globalizacyjnych, przy zachowaniu możliwie szerokich uprawnień kontrolnych.

This article explores the relation of mobility control to the territorial sovereignty of the national state. Based on a theoretical analysis of sovereignty in the globalizing world,it claims that growing interdependence of states in the era of transnational flows and postindustrialization is not tantamount to the disappearance of sovereignty. It only makes the exercise of state functions in the field of mobility and border control increasingly complex. Despite the liberalization of cross-border flows that are the distinguishing feature of globalization, states strive to preserve their prerogatives of border control which is a domain of their sovereign power. Internationalization, extra-territorialization, selective restrictiveness, privatization and outsourcing of border control mechanisms are the main manifestations of the reactions of nation states to globalization processes, caused by the desire to maintain the monopoly on deciding who may enter their territory. The article concludes that limited sovereignty mentioned in the context of the European Union Member States means that sovereignty should now be seen as being distributed among various entities. In this approach, sovereignty in the field of mobility control is not a zero-sum game; the state remains sovereign although the power and control of border crossing associated with it are currently located on various levels.
The paper presents transformations that the Polish border have passed, from the period after World War II, when the pre-war location and extent of the Polish state have changed as a result of arbitrary decision of the leaders of the Soviet Union, Britain, and the United States, until today, when the status and the functions of the border of the Third Republic were changed as a result of Polish membership in the EU and the Schengen area. The emphasis is put on three modifications of the political status and the control function of borders. The first one is related to establishing very restrictive rules of border protection and border crossing (typical for communist countries) not only by third country nationals (TCNs) but also by Polish citizens. The second one is an effect of a radical change of rules of border protection and control as a part of systemic and economic transformation in Poland in the early 1990s. Then the Polish border was open for liberal movement of people and goods. The third change of the Polish border is a result of the process of integration of Poland with the EU and the Schengen area. Generally speaking, the change meant the transformation of the Polish border in internal and external borders of the EU, what fundamentally transformed its control function and political status. All these changes of the Polish state border highlight the changeable nature of Polish state and its sovereignty.

W artykule ukazano przeobrażenia, jakie przeszły granice Polski od okresu powojennego, gdy w wyniku arbitralnych decyzji państw trzecich zostały zmienione przedwojenne usytuowanie i zasięg państwa polskiego, aż do dnia dzisiejszego, gdy status i funkcje granic III Rzeczpospolitej uległy gruntownej zmianie w wyniku członkostwa w UE i strefie Schengen. Szczególny nacisk położono na analizę trzech zasadniczych zmian statusu politycznego i funkcji kontrolnych tych granic. Pierwsza odnosi się do ustanowienia typowych dla ówczesnych krajów komunistycznych restrykcyjnych zasad ochrony i przekraczania granic tak przez obywateli polskich, jak i obywateli państw trzecich. Druga związana jest z radykalną zmianą zasad ochrony i kontroli polskich granic wraz z transformacją ustrojową i gospodarczą Polski na początku lat 90. XX w., polegającą na względnym otwarciu wszystkich polskich granic na przepływ ludzi i towarów. Trzeci proces przeobrażeń polskich granic stanowi efekt integrowania się Polski z UE i jej przystąpienia do strefy Schengen. Polega na dywersyfikacji polskich granic na granice wewnętrzne i zewnętrzne UE, co istotnie zmienia nie tylko ich funkcje kontrolne, ale także status polityczny. Ukazanie powyższych zmian uzewnętrznia zmieniającą się naturę polityczną polskiego państwa i jego suwerenności. Analizy prowadzone są w ujęciu politologicznym, w oparciu o źródła instytucjonalno-prawne i literaturę przedmiotu.
Artykuł przedstawia propozycję nowego spojrzenia na sposób definiowania unijnej polityki odnoszącej się do funkcjonalnego wymiaru jej granic zewnętrznych. Stanowi tym samym kontrpropozycję dla wąskiego definiowania zakresu tej polityki, ograniczanego do kwestii kontroli granicznych i zasad przekraczania granic. W ujęciu tym polityka granic UE stanowi rodzaj politycznej ramy dla trzech, prowadzonych na gruncie odrębnych polityk sektorowych, programów unijnych działań ukierunkowanych na: – współpracę transgraniczną społeczności lokalnych, mieszkających na terenach przygranicznych; – ustanowienie wzmocnionych kontroli i ochrony granic; – stabilizację unijnej (za)granicy. Jest to trójaspektowa, wewnętrznie zróżnicowana polityka, której realizacja – w zależności od aspektu – odbywa się za pomocą instrumentów finansowych, prawnych bądź politycznych. Propozycja ta stanowi bardziej kompleksowe podejście do analizowania unijnej polityki wobec granic zewnętrznych i daje możliwość spojrzenia na poszczególne odcinki tych granic pod kątem poziomu izolacji obszarów przygranicznych, stopnia „szczelności” reżimu kontroli granic oraz „przyjazności” bądź „wrogości” relacji utrzymywanych z państwami sąsiedzkimi. Wydaje się, że taka perspektywa w większym stopniu jest w stanie oddać zróżnicowany charakter poszczególnych odcinków unijnych granic zewnętrznych oraz określić, jaki jest ich rzeczywisty stopień otwartości bądź zamkniętości.

The paper presents a proposal of a new perspective as regards the way of defining the EU’s policy concerning the functional dimension of its borders. Thus, it comprises a counterproposal to the narrow definition of the whole policy, limited to the issues of border control and the principles of border crossing. In this approach, the EU’s border policy constitutes a kind of political framework for three programmes, implemented under three separate sectors of this policy, programmes of the EU activity oriented towards: cross-border cooperation of local communities; the establishment of tightened control and border protection and finally the stabilisation of the EU outside its borders. This is a three – dimensional, internally diverse policy of the EU, the implementation of which – depending on the dimension – is carried out by means of financial, legal or political instruments. This proposal constitutes a more complex approach to the analysis of the EU policy towards its borders and provides the opportunity to consider a particular EU border from the perspective of the level of isolation of border areas, the degree of permeability of the border control regime and of the “friendliness” or “hostility” of relations with neighbouring countries. It seems that such a perspective can better convey the diverse character of the EU’s external borders and determine their actual level of openness or closeness.
Cross-border security is part of both external and internal security of a state; hence the responsibility for it is usually divided. Similarly, the responsibility for Polish border administration is split in both subjective and objective sense. The Constitution of the Republic of Poland in art. 146 indicates that the Council of Ministers, and in particular the Minister of National Defence, the Minister competent for Internal Affairs and the Minister competent for Public Finance shall ensure external and internal security as well as public order in the state. To a lesser extent, the responsibility for state security is also shared by other ministers supervising central administration bodies that have state border protection within their scope.In addition, very important functions directly or indirectly related to border security are carried out also by voivodes.In the current paper, the author presents individual institutions and state bodies involved in cross-border security of the Republic of Poland, demonstrating their impact on the overall level of this security.
The article contains an analysis of the origins and development of new regulations concerning the European Border and Coast Guard of 2016 and 2018 in order to better understand its tasks and development in the light of the European policy objectives and European law. The authors pay particular attention to the state of ontological uncertainty and lack of security manifested by the residents and states of the European Union. Thus they consider the challenges to the Union’s internal and external security. They analyse new initiatives, both legal and political, the aim of which is to limit the threats associated with uncontrolled irregular migrations, organised crime and terrorism. Examining the EU’s new proposal concerning the European Border and Coast Guard, the authors point to its main objects, innovative nature of the proposed solutions as well as a substantial policy change that can be seen in the new proposal. When analysing the proposal and its amendments from a criminological perspective, the authors indicate a new interpretation of the concept of intelligence-led policing as well as its implementation with regard to the EU’s border and security policies, both in their internal and external aspects. When examining the most important premises of the organisational, institutional and operational mandate of the EBCG, the authors not only examine the establishment of the EU’s new border police, but also confirm the need to define a strategy for the operation of the Service, especially with regard to its operational activities and intelligence, in order for the Service to effectively and fully implement its mandate, at the same time making a major contribution to fighting threats to a broadly defined security of the EU (terrorism, uncontrolled migrations, organised crime). What is essential to this is the introduction of a sustainable — respectful of cultural differences but also effective — way to create policing policies as well as use of new technologies to monitor borders, in line with the adopted intelligence policy. In addition, further bi- and multilateral cooperation with relevant bodies and services of third countries should be maintained and developed, especially taking into account the existing good cooperation practices. In the article the authors analyse the regulatory framework of the new regulation specifying the role and threats of the new Service with regard to personnel and insufficient financing, and point to other difficulties associated with the insufficient implementation of the solidarity clause so far. They also point to the urgent need to formulate a methodology, strategy and relevant training enabling border guards to use the so-called cultural profiling (taking into account the migrants’ cultural and ideological differences) as part of their statutory activities, and at the same time ensuring the highest standard of fundamental right protection.
El asunto del tráfico ilegal de trabajadores mexicanos a los Estados Unidos tomó mucho vigor por el año de 1994; casi al mismo tiempo de la puesta en marcha del Tratado de Libre Comercio para América del Norte (TLCAN). Según muchos mexicanos, todavía hace unos 40 años se podía caminar por las cercanías de la amplia línea fronteriza, esperar la llegada de la noche y pasar al otro lado, sin grandes complicaciones. Pero a mediados de los ochenta las finanzas mexicanas se derrumbaron, el gobierno mexicano se declaró en bancarrota, en el país hubo quiebra de fábricas, de empresas y una fuerte disminución de puestos de trabajo; además, se redujo el poder adquisitivo y la falta de oportunidades de desarrollo. Todo lo anterior estimuló y aumentó el tráfico ilegal de mexicanos a Estados Unidos, y el asunto puso en estado de alerta a la Patrulla Fronteriza estadounidense.

The case of illegal traffic of Mexican workers to the United States increased rapidly in the year 1994, almost at the same time as the implementation of North American Free Trade Agreement (NAFTA).According to a lot of Mexicans, forty years ago it was possible to walk close to the front line, wait for the dusk and cross the border without great effort. However, in the middle of 1980s the Mexican financial records deteriorated, the government declared bankruptcy and Mexican economy suffered a sudden reduction of workplaces. The opportunities of development disappeared and the possibility of purchase got reduced. All the above mentioned phenomena stimulated and increased the illegal traffic of Mexicans to the United States and consequently put the American Border Patrol on the alert.
The Schengen legislation is an integral part of the EU law, which translates into a right to free movement within the “borderless area”. This right can be, however, restricted, especially in the light of threats to public safety and order – and, less frequently, to public health. The restriction imposed on account of the above has become an event without precedent in Schengen’s history of over 30 years. The legal measures implemented on borders are absolutely exceptional on a global scale. One of them is the temporary restoration of control at the internal borders of the EU Member States. The other is the “restriction on non-essential travel to the EU”, meaning, in fact, closing of the EU external borders to citizens of third countries. One could propose a thesis that even the most significant achievements in the process of integration, including the Schengen Area, are temporarily inactivated in the face of an unpredictable supra-European threat. The mission of the EU and its Member States is to establish a new set of rules that will help the Schengen Area survive the early phase of the pandemic by suspending its main principles for some period of time. Will these new rules be extended? And if so – on what conditions? How will it affect the future of the Schengen Area? These issues have not yet been featured and discussed in scientific publications given the recency and relevance of the subject, neither have they been presented in a legal-dogmatic context.

Dorobek prawny Schengen jest integralną częścią prawa UE, co zapewnia uprawnienie swobodnego przemieszczania się po „obszarze bez granic”. Jednak może ono zostać ograniczone, szczególnie w sytuacjach zagrożenia bezpieczeństwa i porządku publicznego – rzadziej zdrowia publicznego. Ograniczenie z tego względu stało się wydarzeniem bezprecedensowym w ponad 30-letniej historii strefy Schengen. Wprowadzone środki prawne na granicach są absolutnie wyjątkowe na skalę światową. Pierwszym z nich jest tymczasowe przywracanie kontroli na granicach wewnętrznych państw członkowskich. Drugie to „ograniczenie innych niż niezbędne podróży do UE”, czyli de facto zamknięcie granic zewnętrznych UE dla obywateli państw trzecich. Można postawić tezę, że nawet najistotniejsze osiągnięcia integracji, w tym strefa Schengen, przestają praktycznie czasowo funkcjonować w obliczu nieprzewidywalnego ponadeuropejskiego zagrożenia. Zadaniem UE i państw członkowskich jest ustalenie nowych zasad, które pozwolą przetrwać strefie Schengen w początkach pandemii poprzez tymczasowe zawieszenie jej kluczowych zasad. Czy i pod jakimi warunkami mogą one ulec przedłużeniu? Jak to wpłynie na przyszłość strefy Schengen? Kwestie te nie doczekały się jeszcze publikacji naukowych ze względu na aktualność tematyki, a tym bardziej jej ujęcia w kontekście dogmatycznoprawnym.
Analizy zawarte w niniejszym artykule mają na celu odtworzenie, wyjaśnienie i ocenę stanowiska polskiego rządu w sprawie zasadniczych elementów unijnej polityki migracyjnej i azylowej zaproponowanej przez Komisję Europejską w Nowym pakcie o migracji i azylu. Artykuł omawia zatem potencjalne priorytety i cele unijnej polityki migracyjnej i azylowej z punktu widzenia polskiego rządu, artykułowane zarówno w trakcie trwających prac nad dokumentem KE (2018–2020), jak i po jego opublikowaniu we wrześniu 2020 roku. Zamierzeniem artykułu nie jest jednak przedstawienie stanowiska polskiego rządu w sprawie konkretnych, szczegółowych rozwiązań zawartych w propozycjach legislacyjnych KE, zapowiadanych w nowym pakcie o migracji i azylu. Artykuł pozwala jednak określić, co strona polska uważa za pożądane, tolerowane i akceptowalne, a co jest całkowicie nie do przyjęcia z punktu widzenia proponowanych obecnie zmian w polityce migracyjnej i azylowej UE. W związku z tym wskazano i wyjaśniono główne priorytety polskiego rządu dotyczące reformowanej polityki. Dwa pierwsze z nich dotyczą przeciwdziałania nieregularnej imigracji poprzez wzmocnienie ochrony granic zewnętrznych oraz intensyfikację współpracy z krajami trzecimi (w szczególności w zakresie readmisji i powrotów), co oznacza akceptację postulatów KE. Z kolei trzeci z omówionych priorytetów strony polskiej dotyczy kwestii azylowych i sprzeciwia się propozycjom KE w tym zakresie.

The analysis aims to reconstruct, explain and evaluate the position of the Polish government on the essential elements of the EU migration and asylum policy proposed by the European Commission in the New Pact on Migration and Asylum. Thus, the article discusses the potential priorities and objectives of the EU migration and asylum policy from the point of view of the Polish government, articulated both during the ongoing work on the EC document (2018–2020) and after its publication in September 2020. However, the article is not intended to present the Polish government’s position on the particular, detailed solutions contained in the legislative proposals of the EC due to the New Pact on Migration and Asylum. Although, it allows identifying what the Polish side considers desirable, tolerable and acceptable, and what is utterly unacceptable in terms of the proposed changes to EU migration and asylum policy. Therefore, the main priorities of the Polish government regarding the reformed policy are indicated and explained. The first two concern counteracting irregular immigration by enhancing the protection of external borders and intensifying cooperation with third countries (in particular as concerns readmissions and returns), which means approving the postulates of the EC. At the same time, the third priority opposes the EC’s proposal addressing asylum issues.
Solidarity as one of the main values of the European Union is also recognizedamong the guiding principles of the EU asylum policy. In the period of the migrationcrisis, this principle was the most important for the EU Member Statesand very difficult to implement. The purpose of this article is to analyze the concept of solidarity, as enshrined in the Lisbon Treaty, as well as in the positions of the Member States and EU institutions. The article highlights the current debate, initiated by the Visegrad group under the Slovakian Presidency in the Council, around the proposed “flexible” or “effective solidarity” in asylum policy. Thus, the author contributes to understanding the ways, problems and prospects of refugees’ relocation, as well as the upcoming reform of the Dublin system. Based on the study of the summits conclusions, Council meetings in its various formats, the EU leaders’ statements, the author considers that divergence not only of the Member States positions, but also those of the EU institutions on the specific forms of participation in managing migration and asylum could entail more fragmentation and differentiation within the Union. At the same time, the author reveals the contradiction in the Visegrad countries’ position: while dreaming about re-nationalization of asylum and engaging in confrontation with the Commission the CEE countries by no means intend to introduce and maintain border control within the Schengen area.

Солидарность – одна из базовых ценностей Европейского союза признана в то же время руководящим принципом политики ЕС в сфере убежища. В период миграционного кризиса этот принцип оказался наиболее важным и одновременно трудновыполнимым для государств-членов ЕС. Цель статьи – проанализировать суть понятия солидарности, как это зафиксировано в Лиссабонском договоре, а также в заявлениях, современных документах и позициях государств-членов и институтов ЕС. Автор анализирует дискуссию, инициированную Вишеградской группой во главе с председательствовавшей Совете ЕС Словакией, по концепции «гибкой» или «эффективной солидарности», и тем самым вносит вклад в понимание современной ситуации в Европейском союзе относительно способов, проблем и перспектив урегулирования миграционного кризиса и его последствий, а также предстоящей реформы Дублинской системы убежища в ЕС. На основе изучения документов саммитов, заседаний Совета в его различных форматах, заявлений лидеров стран ЕС автор делает вывод о расхождении позиций не только между государствами-членами, но и институтами ЕС по вопросам участия государств-членов в решении проблем противодействия новым угрозам безопасности, что может иметь последствием усиление фрагментарности и дифференциации внутри Союза. В то же время автор выявляет противоречие в позиции вишеградцев: мечтая о ре-национализации политики убежища и вступая в конфронтацию с Комиссией ЕС, страны ЦВЕ вовсе не намерены вводить и сохранять пограничный контроль внутри шенгенского пространства.
