Legalizacja samowoli budowlanej w ustawie z 13.02.2020 r. o zmianie ustawy - Prawo budowlane oraz niektórych innych ustaw

The aim of the article is to evaluate the legal solutions adopted in the Act of 13 February 2020 amending the Construction Law and some other acts in the field of legalization of unauthorized construction. The cited Act is another example of the legislator's activities aimed at reducing the number of illegal constructions in Poland. Contrary to the regulations which is currently in force, the Act creates a single, clear legalization procedure, introducing, at the same time, unknown construction law, simplified procedure for legalization the so-called old illegal constructions. Legalization is still a phenomenon negatively assessed by the legislature, combined with the obligation to pay the legalization fee. The Act lacks solutions improving the detection of illegal constructions and the execution of demolition orders. Justified juridical doubts, in the aspect of compliance with the principle of equality before the law, are also caused by the formulation of provisions devoted to the legalization of illegal constructions, in which 20 years have passed at least since the construction was completed.

Celem artykułu jest ocena rozwiązań prawnych przyjętych w ustawie z 13.02.2020 r. o zmianie ustawy - Prawo budowlane oraz niektórych innych ustaw w zakresie legalizacji samowoli budowlanych. Powołany akt stanowi kolejny przykład działań ustawodawcy ukierunkowanych na ograniczenie liczby samowoli budowlanych w Polsce. W odróżnieniu od dotychczas obowiązującej regulacji ustawa tworzy jedno, czytelne postępowanie legalizacyjne, wprowadzając jednocześnie nieznaną prawu budowlanemu uproszczoną procedurę legalizacji tzw. starych samowoli budowlanych. Legalizacja nadal pozostaje zjawiskiem negatywnie ocenianym przez ustawodawcę, połączonym z obowiązkiem uiszczenia opłaty legalizacyjnej. W ustawie zabrakło rozwiązań usprawniających wykrywanie samowoli budowlanych oraz egzekucję nakazów rozbiórki. Uzasadnione wątpliwości jurydyczne, w aspekcie zgodności z zasadą równości wobec prawa wywołuje także sformułowanie przepisów poświęconych legalizacji samowoli, w których od zakończenia budowy upłynęło co najmniej 20 lat.

Tematyka zasad prawa budowlanego stanowi punkt wyjścia do szczegółowych rozważań, związanych z treścią poszczególnych przepisów prawnych oraz prawidłowością rozstrzygnięć zapadających w procesie budowlanym. Wyodrębnienie zasad prawa budowlanego ma na celu nie tylko oddziaływanie na zachowanie określonych podmiotów w kierunku podjęcia określonych zachowań, ale co warto zauważyć, zasady te służą do wprowadzenia określonych wartości, które są przedmiotem szczególnej ochrony w procesie budowlanym.

The gloss to the judgment of the Supreme Administrative Court of 20 December 2018 (II OSK 249/17) concerns the issue of determining the appropriate entity obliged to draft and submit a replacement construction project in order to conform the works to compliance with the state compatible law. In opinion of the Supreme Administrative Court, the competent public administration organs are obliged to impose the obligation to perform the specific actions only in relation to the current owner of the property who has the legal title to dispose of the property on which the building is located.

Glosa do wyroku NSA z dnia 20 grudnia 2018 r. (II OSK 249/17) dotyczy kwestii ustalenia właściwego podmiotu zobligowanego do sporządzenia i przedstawienia projektu budowlanego zamiennego w celu doprowadzenia robót do stanu zgodnego z prawem. Zdaniem NSA właściwe organy administracji publicznej mają obowiązek obciążenia obowiązkiem wykonania określonych czynności tylko w stosunku do aktualnego właściciela nieruchomości, posiadającego tytuł prawny do dysponowania nieruchomością, na której posadowiony jest obiekt budowlany.

Przedmiotem opracowania jest zagadnienie wolności budowlanej, ukazanej na tle obowiązków odnoszących się do utrzymania obiektów budowlanych. Źródłem wolności budowlanej jest konstytucyjna zasada ochrony własności, zapewniająca właścicielowi ochronę przed bezprawnym naruszeniem jego prawa i nadmiernym władztwem organów administracji publicznej. Jednakże korzystanie z wolności budowlanej nie oznacza zupełnej swobody w użytkowaniu obiektu budowlanego, bowiem ma ona swoje granice zakreślone w realizacji wartości wskazanych w Konstytucji RP. W opracowaniu została dokonana analiza zgodności obowiązków dotyczących utrzymania obiektów budowlanych z Konstytucją RP.

The subject of the study is the issue of freedom construction, shown against the background of obligations related to the maintenance of buildings. The source of freedom construction is the constitutional principle of ownership, which provides the owner with protection against the unlawful violation of his right and the excessive authority of the public administration. However, the use of the freedom of construction does not mean complete freedom in the use of the building, because it has its boundaries in the realization of the values indicated in the Constitution of the Republic of Poland. An analysis of the conformity of obligations concerning the maintenance of buildings objects with the Constitution of the Republic of Poland was carried out.
